Take a moment to read these, complete, sign and return them to Common Interest Management Services. We have reserved the date of for your party, between the hours of, and. When you return your completed and signed agreement and questionnaire, please also enclose two checks made payable to Mariner's Green #3. One check will be for the refundable deposit, the other will be the non-refundable fee for temporary exclusive use of the Clubhouse. When we receive your checks and completed forms, we will program your pool key fob to allow you access to the Clubhouse on your reserved date. After your party ends, be sure to leave the Clubhouse clean and secure all windows and doors. Your refundable deposit will be returned once it is determined that you have abided by all the rules & regulations as stated in this agreement and have left the Clubhouse in satisfactory condition. CLUBHOUSE RENTAL AGREEMENT MARINER'S GREEN ASSOCIATION #3 Name Phone # Address Pool Key Fob # As a resident of Mariner's Green Association #3, I wish to reserve the Clubhouse for the date of, between the times of and for the purpose of. In return for the temporary, exclusive use of the Clubhouse, I agree to hold the Mariner's Green Association #3 harmless for any and all liability, loss, cost, damage and claims (including attorney's fees) arising out of or resulting from, any injury or damage, however occurring. I acknowledge that I shall be fully responsible and liable for any damage, of any nature or kind whatsoever, which may occur to the premises during the period of temporary exclusive use thereof, whether such damage is caused by myself and/or any guest or guests of mine. I acknowledge that if my party becomes out of control and police are called to the Clubhouse, the premises must be vacated immediately by myself and all guests present. I understand that this agreement covers rental of the Clubhouse and includes the temporary, non-exclusive use of the restrooms. This agreement does not cover the use of the sauna, swimming pool or other recreation facilities. I attest that I am an adult of at least twenty-one years of age. I agree to be present during the entire period of my Clubhouse reservation. Minors (persons less than twenty-one years of age) are not permitted under any circumstances to reserve the Clubhouse or complete this agreement. If I am renting the Clubhouse for a child of mine that is minor, I will be present for the entire period that the Clubhouse is reserved for my child's party. I understand that no live music is permitted. Maximum occupancy is 50 persons. Absolutely no alcohol may be served at parties attended by persons under twenty-one years of age. Page 2

Non-refundable fees for reservations: $100 per use Refundable cleaning & damage deposit: $250 for all functions. This deposit is deposited in the Association's bank account upon receipt. It will be refunded in full provided there are no rule infractions and the post-party inspection verifies that you have left the Clubhouse in satisfactory condition. The Clubhouse must be cleaned immediately after use (unless special arrangements have been pre-approved by the Board of Directors) or the deposit shall be forfeited. Cleaning the Clubhouse consists of the following: wiping tabletops before putting away tables and chairs policing restrooms vacuuming carpeting sweeping floors, and washing if necessary cleaning kitchen including oven, stove, countertops and sink Page 4
RULES GOVERNING THE USE OF THE CLUBHOUSE (REVISED 3-18-13) 1) RENTER DEFINED: Only a current resident (either owner/occupied or renter/occupied with owner s permission) called the Renter may rent the Clubhouse. 2) SCHEDULING AND CONFIRMATION: Scheduling the usage of the Clubhouse will be done by contacting MGA#3 s management company and confirmation will be done upon receipt of the contract, rental fee and deposit. Note the rental and deposit checks will be cashed and the deposit refunded (if appropriate) by MGA#3 check. 3) PURPOSE FOR USE: The room is for use by homeowners and residents and their guests only. The purpose for which the building is to be used is stated in the rental agreement. No commercial use of the building is permitted. Commercial businesses or persons engaged in activity for personal gains or profits are not eligible. 4) AGREEMENT: All Renters scheduling the building shall sign and return the Agreement prior to the rental being confirmed. This Agreement will also serve as an indemnification of MGA#3 against any and all liabilities and damages resulting from the rental of the clubhouse by the Renter, his/her guests or invitees. MGA#3 may, in the Board s sole discretion, elect to terminate this Agreement without prior notice, in the event that there is evidence that damage to the property appears imminent, or if there are blatant violations to the Rules or terms of this Agreement. This Agreement must be signed at least ONE WEEK before the planned event. 5) FEES: A) The Renter shall pay a use charge of $100.00 B) The Fee must be paid for at the time the agreement is signed. C) The Fee is non-refundable unless a cancellation is received at least 48 hours prior to the scheduled event. 6) SECURITY DEPOSIT: A) The Renter shall submit a $250.00 security deposit no later than the time the agreement is signed. B) After the inspection of the building, Renter s deposit will be refunded within ten (10) business days, if there were no violations of this agreement. C) The cost of any needed cleaning or repair of any damage will be deducted from the Renter's deposit as necessary, in the sole discretion of the Board of Directors. Renter agrees to pay any and all amounts over that of the deposit for loss of or damage to property in and around the building whether caused by the Renter or others during scheduled event. If such a loss exceeds the amount of the deposit, a lien against the homeowner s property may result if such damages are not paid timely. D) Use of the pool area, spa or sauna is not included in the rental of the building. The renter warrants with the deposit that the doors to the pool will be absolutely be kept closed. Opening either of these doors except for fire or emergency will instantly forfeit your deposit. Neither Renter nor guests may access the pool area during the rental period. Non-exclusive use of the restrooms is permitted. (continued on next page) 7) CLEAN & LOCK: The Renter has sole responsibility for the building during the scheduled event and the entire time that the Clubhouse is in the Renter's possession. The Renter is
responsible to assure that all doors and windows are locked and the lights and heat are off. Cleanup of the building shall be the responsibility of the Renter. 8) TRASH & GARBAGE: ALL trash and garbage must be removed by the Renter immediately after the event is over and before the end of the evening s termination time. 9) OCCUPANCY LIMIT - Occupancy is not to exceed fifty (50) persons. This limit is set by the City of San Mateo and enforced by the Department of Safety. 10) ALCOHOLIC BEVERAGES The serving of alcoholic beverages to minors (under the age of 21) shall not be permitted at any time. Renter assumes sole responsibility to assure that alcoholic beverages will not be served to minors. 11) HOURS OF USE, Building use must be terminated and building vacated no later than 11:00 P.M. Sunday through Thursday nights and no later than 12:00 A.M. (midnight) Friday and Saturday nights. 12) LOUD MUSIC: No loud music will be permitted. Music must not exceed reasonable noise levels or at any time become a nuisance to others. The discretion of your neighbors will be used to determine if the noise level is too high. Doors must be closed anytime music is being played. Failure to honor this rule could result in the forfeiture of the security deposit. 13) PARKING: Guests to your event should be instructed to park their vehicles in designated spaces only. NO double parking or parking so as to block any resident s driveway. Illegally parked vehicles may be towed by the Police Department. Failure to honor this rule may result in the forfeiture of the security deposit. 14) DOOR CHARGES: No moneys are to be exchanged at the door of the Building. 15) The Renter is responsible for observing all Federal, State and Local laws. The Renter hereby agrees that he/she has read and understands the foregoing conditions and agrees to abide by them as they relate to the use of the MGA#3 Clubhouse. Renter further acknowledges and is aware that failure to comply as herein agreed may, in the sole discretion of the Board of Directors, result in the loss of Renter s security deposit as well as forfeiture of Renter s future right to use of the Clubhouse.
