2017-309 BOARD OF COUNTY COMMISSIONERS SARPY COUNTY, NEBRASKA RESOLUTION FLOOD PLAIN DEVELOPMENT Nebraska Game and Parks, River Access Point at 21502 S Highway 31, (Tax Lot O, 12-12-10), Sarpy County, NE WHEREAS, pursuant to Neb. Rev. Stat. 23-104, the County has the power to do all acts in relation to the concerns of the County necessary to the exercise of its corporate powers; and, WHEREAS, pursuant to Neb. Rev. Stat. 23-103, the powers of the County as a body are exercised by the County Board; and, WHEREAS, the County Board of Commissioners has the authority to adopt a Zoning Regulation, which shall have the force and effect of law pursuant to Neb. Rev. Stat.' 23-114; and, WHEREAS, said Zoning Regulations require the County Board of Commissioners to approve applications for development permits within any Flood Plain District; and WHEREAS, the Nebraska Game and Parks Commission has applied for a Flood Plain Development Permit to construct a river access point including a parking lot and excavated launching benches at 21502 S Highway 31, Tax Lot O, 12-12-10, in Sarpy County as described in the attached Exhibit A; and, WHEREAS, the Sarpy County Planning Department staff reviewed the Nebraska Game and Parks Commission s application for a Flood Plain Development Permit for compliance with the Zoning Regulations on the property described in the attached Exhibit A; and, WHEREAS, said application is in compliance with Section 30, Flood Plain District of the Zoning Regulations and further, the Natural Resources District has no objection to the development permit; and, WHEREAS, the Planning Department staff made a recommendation of approval as noted in the attached Exhibit A, which Exhibit A includes the Planning Department report and the Natural Resources District comments. NOW, THEREFORE, BE IT RESOLVED BY THE SARPY COUNTY BOARD OF COMMISSIONERS THAT the Flood Plain Development Permit Application for the property described in the attached Exhibit A is hereby approved. The above Resolution was approved by a vote of the Sarpy County Board of Commissioners at a public meeting duly held in accordance with applicable law on the 29th day of August 2017. Application Overview Nebraska Game and Parks has requested approval of a floodplain development permit to construct a river access point including a parking lot and excavated launching benches at 21502 S Highway 31, Tax Lot O, 12-12-10. Comprehensive Development Plan The Sarpy County Development Structure Plan (Future Land Use Map) designates this area as Greenway. Zoning / Floodplain Regulations The area is zoned AG-FP (Agricultural District - Floodplain) The property is located in the floodway in an AE Flood Zone adjacent to the Platte River. (see attached map). Pursuant to Section 30.10 of the Sarpy County Flood Plain Regulations, uses having a low-flood damage potential and not obstructing flood flows shall be permitted within the floodway. Such uses include recreation areas and uses of a type not appreciable damaged by flood waters, not including structures for human habitation shall be permitted. The new construction must meet the minimum setback and zoning requirements at the time of building permit application. This request, as proposed, is in conformance with the Sarpy County Zoning Regulations. Natural Resources District The Papio Missouri River Natural Resources District (NRD) has no objections to the proposed application. The NRD recommendation letter is attached. Recommendation For the reasons stated above, staff recommends the Floodplain Development Permit be approved to construct a river access point including a parking lot and excavated launching benches at 21502 S Highway 31, Tax Lot O, 12-12-10.

HOR Subject: Flood Plain Development Permit Application The Nebraska Game and Parks Commission (NGPC) wants to improve recreational boating access along the Platte River and is proposing to construct a river access point for canoes and kayaks at the Schramm Aquarium State Recreation Area near Gretna, Nebraska, see Figure 1 - Vicinity Map. The proposed project would be located on the Platte River, near the east entrance to the park on Highway NE-31. The proposed project is located in Special Flood Hazard Zone AE; a portion of the Platte River where Base Flood Elevations have been determined by the Federal Emergency Management Agency (FEMA). Based on FIRM Panel 31025C0165G, the proposed project is at the edge of the Platte River floodway, and is in the extraterritorial jurisdiction of Sarpy County, Nebraska. Development in the floodplain must obtain a Flood Plain Development Permit. The proposed project includes a slope excavated into the left (north) bank of the Platte River, constructed such that the slope does not extend above the existing ground. See Figure 2 - Site Plan and Figure 3 - Project cross-section. Since project components do not project above the existing ground line, no hydraulic modeling will be performed. It is my opinion that the proposed project would satisfy the criteria for development in the floodplain criteria. The boat ramp and parking lot are at or slightly below the existing ground line and there will be no changes to the river cross-sectional area at the proposed project site. The proposed stream crossing is in the non-conveying portion of the river cross-section, is below the overbank ground elevation,. On behalf of the NGPC, we are requesting your review and consideration for approval of the attached Sarpy County, NE Flood Plain Development Permit Application for construction of the proposed boat launch facility at the east edge of the Schramm Aquarium State Recreation Area.
