The wooded site has rolling topography with two residential and one commercial structure located on it. The site is zoned General Business along Jackson Avenue and Neighborhood Business on the northern section of the site that is to be used for required parking. The land use\character along the portion of the Jackson corridor where the subject property is located is a mixture of general business, office and residential. n an effort to maintain the sites topography and preserve as many existing trees as possible, the petitioner is requesting two variances. The request for a 5' 11' height variance and the extension of the present retaining wall along the front right-of-way is an effort to conserve many of the site's natural features but will result in limiting the site's area available for development. The site's natural characteristics are unique and are not common with other property in the immediate area and granting the variances would not be contrary to public interest. The proposed development is a mixed use project comprised of 85 hotel rooms, 15 condominiums on the top floor and one owner suite that may be sold. The hotel's commercial uses and amenities include a restaurant, conference room, fitness center, and indoor swimming pool. A two level

Approve based on the findings that a hotel with 16 condominiums on the top floor is an appropriate use of the subject property and that approval of the request will not adversely affect public interest. This approval is conditioned to limit condominium u'se to the top floor. 1298B - 5' 11" height variance where 38 feet is permitted and a variance from Section 148.07 to permit extension of an existing retaining wall where 4 feet is permitted. The pro~osed hotel is located on the north side of Jackson Avenue between North 4t Street and the city's new bike trail on the abandoned railroad rightof way. The site is zoned General Business along Jackson Avenue and Neighborhood Business on the northern section of the site that is to be used for required parking. The land use\character along the portion of the Jackson corridor where the subject property is located is a mixture of general business, office and residential. n an effort to maintain the sites topography and preserve as many existing trees as possible, the petitioner is requesting two variances. The request for a 5' 11' height variance and the extension of the present retaining wall along the front right-of-way is an effort to conserve many of the site's natural features but will result in limiting the site's area available for development. The site's natural characteristics are unique and are not common with other property in the immediate area and granting the variances would not be contrary to public interest.
