Lee Mayor Kate Hartley Director TO: All Interested Parties PURPOSE AND PROPOSED ACTION: This is to give notice that the San Francisco Mayor's Office of Housing and Community Development (MOHCD) as the Responsible Entity for projects subject to regulation by 24 CFR Part 58 (Environmental Review Procedures For Entities Assuming United States Department of Housing and Urban Development [HUD] Environmental Responsibilities) has determined that the Mission Bay South Block 6 West project is partially located in the 100-year floodplain. MOHCD will be identifying and evaluating practicable alternatives to locating the action in the floodplain and the potential impacts on the floodplain from the Proposed Action, as required by Executive Order 11988 and HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management. The Proposed Action is the approval. of the release of 35 Section Eight Project Based Vouchers at the proposed site by HUD. The proposal is for the development of 140 units of affordable housing, as well as residential amenities and parking at Mission Bay South Block 6 West within the Mission Bay neighborhood of San Francisco (Block 8711, Lot 020). The project site at l.l acres (47,917 square feet), overlays the ] 00-year floodplain at less than an eighth of an acre in its northeastern-most corner along China Basin Street. There are three primary purposes for this notice. First, people who may be affected by activities in floodplains and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information about floodplains can facilitate and enhance federal efforts to reduce the risks associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the federal government determines it will participate in actions taking place in floodplains, it must inform those who may be put at greater or continued risk. Thank you, Shelley CASE NO. 2017-006766CUA 2394 Folsom Street Hearing December 21, 2017 Dear Planning Commission, I live next to the proposed site of this new restaurant and brewery at Shotwell and 20th Streets. I am opposed to it. This project application shows a grave error in calculating the ratio of eating and drinking establishments and misrepresents the neighborhood appeal. Our neighborhood already has many restaurants and several bars and we do not need any more. We have a lot of street noise at night from people who come from out of the area and behave badly with yelling and violence. Already our pedestrian intersections (on route to schools) are often clogged by hired car services, as are the roadways. This behavior should be curtailed rather than encouraged. Introducing a new drinking establishment that seats 165+ people (which is way too big for our neighborhood) will encourage loud drunken behavior. On top of that, the brewery would smell really bad and will affect the air quality in my rent controlled apartment. What we do need is more food markets and day-time businesses since over the years the corner markets have been lost to high-end restaurants or salons. The Planning Commission should adhere to the Mission Area Plan and the Planning Code and reject this project. The Project Plans/Eating & Drinking Concentration Survey submitted by the project sponsor contains a serious error on page A0.7. To meet the Planning Code standards, the survey should compare eating and drinking frontage to all commercial frontage in the 300 radius. The survey submitted does not do this. It compares existing eating and

drinking establishments to all frontage, including residential, public school, and fire station buildings. I believe, based on my estimates of business frontage through observation, that if this survey is done properly, the existing eating and drinking frontage will exceed the 25% standard in the Planning Code, making this project out of the scope of the city plan. The application states that the project brings needed services to the neighborhood, but how can this be when there already exists a bar or restaurant on most of the retail corners in the area? The restaurant layout in the application shows 165+ seats. That is a huge restaurant, not a neighborhood scale establishment, that will require hundreds of people coming coming from out of the area to the residential neighborhood each night. It is a misrepresentation to say that patrons will take the 12 Folsom (which stops service at 11:30 pm) or the 14 Mission to arrive. Some of the existing smaller-scale bars and restaurant patrons currently arrive by car services which block crosswalks and roadways, creating pedestrian hazard (one block from a high school) and traffic congestion. The addition of hundreds of new people in the area can only worsen this circumstance, and the applicant s assertion that patrons will arrive by public transit and will not affect traffic or parking in the area is not realistic. The applicant claims that there will not be adverse affect on nearby housing and neighborhood, but the proposed site is near enough to my apartment that I will have to smell the brewery inside my apartment, and it will make the surrounding area smell bad. Currently there is much late-night street noise, violence, and traffic congestion that will worsen with the addition of more drunk people. I, like many of my neighbors, am a working person that needs to sleep at night. Adding more night-life to this residential/commercial neighborhood tips the concentration of activity toward nighttime at the expense of the residents. The applicant s supporters are chiefly organizations from outside of the area although the application states that the project will benefit the neighborhood. This does not make sense. As an individual who has lived on the block many years, I do not want a huge, late-night eating and drinking establishment that fouls the air added to the block. Neighbors who I have spoken to have expressed similar opposition to the proposed brewery and restaurant. The mixed commercial/residential zoning should not disregard the high concentration of residents in the area for the benefit of the commercial. I ask the Planning Commission to further scrutinize this request and properly apply San Francisco s planning code and Mission Area Plan and reject this application. Thank you, Shelley

I am in solidarity with the tenants of 2722-2724 Folsom Street, one of whom shared background information about the property with me. I urge you to confirm the staff recommendation to disapprove the Conditional Use Authorization to merge the two legal ground floor rent controlled apartments into one apartment. Such a merger would lead to the involuntary dislocation of one or both households so you should reject it without delay.

This case raises some additional issues. First, this Conditional Use Authorization application did not require a Pre-Application Meeting. Without such a meeting, community members only learn about the application about 20 days before the Planning Commission hearing. 20 days is not enough time for people to learn the details of the proposal or to try to assist tenants that the proposal might harm. I advocate strongly that the Planning Department require a Pre-Application Meeting for any project that will need Commission action. I broaden my request to require Pre-Application meetings for projects that need action at a Zoning Variance Hearing. Second, this property includes two illegal units, one in the attic and a rear yard cottage. The Executive Summary indicates that the Department of Building Inspection finds no path to legalization for either unit. I suspect that whether DBI finds a path to legalization depends greatly on the motivation of the property owner. Here, someone was renting the cottage and now it is empty. I am not exactly sure if the property owner evicted or bought out the resident of the cottage. In any event, a housing unit that was once part of the city s housing stock no longer serves that useful purpose. This case highlights the need for oversight and reform of the DBI s determination of paths to legalization. Accordingly, I am sending a copy of this letter to DBI Director Tom Hui and to District 9 Supervisor Hillary Ronen. Finally, this case is one of four in the immediate vicinity that contemplate Planning Department and Commission action that would adversely affect rent-controlled tenants (2722 Folsom Street, 2782-2786 Folsom Street, 2906 Folsom Street/1 Horace Street, 3230-3236 24 th Street) that I learned about because I am on the Planning Department s Neighborhood Notification List. This neighborhood is rapidly transitioning from working class to affluent while property owners force long term residents from their homes. These four cases are the proverbial tip of the iceberg. I see occupied rent-controlled buildings with For Sale signs that months later are empty. This involuntary displacement is the result of escalating property values that increase incentives for property owners to evict or harass tenants. Your Department s approval of large market rate developments with a few below market BMR crumbs is accelerating this neighborhood conversion. In fact, the monthly housing costs of many of these so-called affordable units are higher than the existing rents in the neighborhood. This problem will only worsen as you approve more developments, many on converted PDR land, and the affordable monthly housing costs rise as Bay Area Median Income increases and as legislators and bureaucrats raise the allowable AMI percentages for BMR programs. It is also the fastest option to bring life to a too long vacant eyesore, creating more foot traffic for existing businesses. As a local resident, this proposal would meet a high demand for grocery stores, of which there are too few in this and adjacent neighborhoods, to fulfill the daily needs of residents and make the locale more desirable. I strongly believe it would also provide a valuable and all around well liked anchor tenant for that portion of the Polk street retail corridor which has started to fall into disrepair and has become less desirable as a retail destination as compared to Union Street which is much more vibrant currently. Homelessness is an emergency for each person without a safe, stable place to sleep, said Jeff Kositsky, Director of San Francisco s Department of Homelessness and Supportive Housing (HSH). We are looking to quickly expand our homelessness response system to provide new temporary shelter and permanent housing opportunities to serve 1,000 additional individuals. Acting Mayor Breed and the HSH made the announcement of the increased capacity while celebrating the opening of 70 new supportive housing units for homeless military veterans at the Auburn Hotel. Each of the 70 units at the Auburn Hotel will be outfitted with beds, microwaves, refrigerators and televisions and are designated for military veterans who formerly experienced chronic homelessness. The Auburn Hotel is the fourth permanent housing site to open in the past year that includes housing for military veterans. In the past 15 months, the City has provided nearly 150 permanent supportive housing units for veterans, through the openings of the Auburn, Crown, National and Winton hotels. The hotels are part of the City s efforts to end chronic veterans homelessness in San Francisco. The Auburn Hotel is being managed by Delivering Innovation in Supportive Housing (DISH), a nonprofit organization. Sorry for the late comment. I don t think that the stair penthouse to the roof deck meets the Residential Design Guidelines. Please see pages 38-39. It is not adjacent to a wall of the neighboring property. I would think too that this stairpenthouse would be very visible given the topography of Corona Heights. Given this is a single family home it seems like a hatch would be more appropriate. I know that the buildings on the other side of the site on Saturn have them, however two things. One, the other buildings are multi-unit buildings, and two, these buildings were constructed in the sixties, (1964) way before the RDGs were developed. I do hope you will mention this comment about the stairpenthouse to the Commissioners in your presentation today. This is just another observation, but I am puzzled by these projects that have two bedrooms on one level and are separate from the master bedroom. It was like this at 60 Russell and lots of others presumably all speculative projects. I know the Commission does not presume to tell people how to live, but it just seems impractical that a project like this would ever be appealing to a family with young children with bedrooms so far apart.it is probably not even advisable for families with adolescents and teenagers.

I'm asking you to oppose the CUA for 2722 Folsom street, which I believe your department has recommended. I've been to this property, which includes long-time tenants who would have nowhere to go if this CUA is permitted. That's what's been happening all over the Mission and the city, as thousands of Latino and African-American families, seniors and people with disabilities have been displaced. This property includes two ground floor rent-control apartments. With the property owner's plan to merge these units, these tenants will be evicted. I can't see any reason to do this other than to either make a lot of money, or to create a luxury unit for the owner himself. That would be cruel. I thought San Francisco had already rejected the merging of units when it means evictions for tenants. This immediate neighborhood is undergoing drastic changes, from a diverse working class community to having more and more rich, mostly white young people moving in, paying high rents or mortgages. They also bring a lot more cars, pollution, and congestion to the neighborhood. In the past, I've listed damning statistics of our changing neighborhood, numbers of evictions, numbers of rich people in and low-income people being pushed out. I'll skip the stats for now, since you already know them. What's happened in the Mission and in SF in general, with greatly increasing numbers of people who are homeless, and no options for real affordable housing for all the people who
