Terms and Conditions : The total price does not include: 1. Stamp duty and Registration Charges. 2. Any tax paid or payable by the company and / or it s contractors or by the way of Value added tax, State Sales Tax, Central Sales Tax, Works Contract tax, Service tax and Educational cess or any other taxes by whatever name called, in connection with the constructions of the said complex. 3. The proposed allottee/s shall pay, in addition to the total price, a price equal to the proportionate share of taxes. The proportionate share been calculated in the ratio of the super built-up area of the said plot. The proposed allottee/s/s has applied for the provisional allotment of Commercial unit with knowledge with all laws / notifications and rules applicable in this area in general and this group housing project in particular which has been explained by the company representativeand understood by him/her. The proposed allottee/s/s has satisfied himself / herself about the interest and the title of the company in the land on which the said unit are been constructed and has been understood all limitations and obligations in respects thereof. The proposed allottee/s agrees that there will not be any further investigations or objections by him / her in this respect. The proposed allottee/s agrees that he / she pay the price of the unit and other charges calculated on the basis of super built-up area which is understood to include pro-rata share of the common areas and other common facilities. Acceptance of deposit towards booking of the Commercial unit is subject to the rules and regulations of the scheme, salient features, brochure, application form etc. applicable from time to time. No unit will be considered tentatively allotted without payment of booking amount. The payment on or before due date, of sale price and other amount payable by the proposed allottee/s as per the payment plan accepted by the proposed allottee/s or as demanded by the company from time to time is the essence of this application and the buyer s agreement. Unit Nos., situation, approximate areas, rate/s contributions, etc., these details are as per separate effective sheet/plan as a part of the scheme brochure shows the total super builtup area of the unit, is considered towards all such common areas. i.e., common plots, terrace, club, internal roads, etc. is included in the said area. 5

The proposed allottee/s has made this application with full knowledge that the building plans, specification, location of units, floor plans and other terms and conditions are tentative and are liable to change, alteration, modification, revision, addition, deletion, substitution or recast at the sole discretion of the company as it may deemed fit and the proposed allottee/s has made this proposal with the full knowledge that the plans in which the units proposed for its location are yet not finalized, sanctioned by the competent authority. The company intents to increase the number of units in the said plan shall be seeking necessary approvals for the same. The proposed allottee/s agrees that the company is fully entitled to bring changes with the plans and the proposed allottee/s has no objection for the same. In case the company is able to make necessary changes in the plans then in such case, the company shall inform the proposed allottee/s about the same and bring whatever changes to the location of the proposed allottee/s if necessary. According this application and subsequent buyer s agreement shall stand modified to this effect. The intimation of option to shift location will be given to proposed allottee/s by the way of written notice. ESCLATION charges i.e. Basic rate difference on the following items, Steel Rs.28,000/- per M. Ton, Cement Rs.3,900/- per M. Ton, Aluminum Rs.140/- per kg. Bricks Rs. 2500/-per 1000 nos., Glazed Tiles Rs.18/- per sq. ft., Polished Kota stone Rs.18/- per sq. ft., Vitrified flooring Rs.28/-per sq. ft., Porcelain Flooring Rs.23/-per sq. ft., (Inclusive of all taxes, service charges and carting) Difference between the actual purchase prices and the Basic Rates will be adjusted either way at the time of offer for possession and shall be applicable to all type of contributions, including down payment and irrespective of payment plan. The proposed allottee/s agrees to pay additional as preferential charges for preferential location as described in this application and selection and as per the payment plan selected. If, due to any change in layout / or building plan, said unit ceases to be in a preferential location, the company / Organisers shall be liable to refund only the amount of preferential charges paid. If due to any change in the layout or building plan, the said unit becomes preferential located, then the proposed allottee/s agrees to pay the amount of preferential location charges as demanded by the company. The proposed allottee/s clearly understands that this application does not constitute an agreement to sell and he/she does not become entitle to the provisional and / or final allotment of the unit notwithstanding the fact that the company may have issued a receipt in acknowledgment of the money tendered with this application. It is only after he/she signs and executes the buyers agreement on the company s standard format agreeing to abide by the terms and condition laid down in that the allotment shall become final and binding Up to the company. If however he/she fails to execute and return the buyer s agreement within 30 days from the date of dispatch by the company then this application shall be treated as cancelled only at the sole discretion of the company and the booking amount paid shall stand forfeited. 6

The proposed allottee/s agrees that if as a result of any legislation, order or rule or regulation made or issued by the government or any other authority or if any competent authorities refuses, delays, withholds, denies the grant of necessary approvals for the said units, said buildings or if any matters, issues relating to such approvals, permissions, notices, notification by the competent authorities becomes subject matter of any suits / writ before a competent court or due to force major conditions, the company, after provisional and / or final allotment, is unable to deliver the unit, building to the proposed allottee/s for his /her occupation and use, the proposed allottee/s agrees that the company if decides in its sole discretion to refund then it shall be liable only to refund the amount received from him / her without any interest or compensation or whatsoever. The company shall endeavor to complete the construction of the said unit within 2 years from the date of execution of the buyers agreement subject to timely payment by the proposed allottee/s of sale price, stamp duty and other charges due and payable according to the payment plan applicable to him/her or as demanded by the company. The company on obtaining the certification of occupation and use from the competent authority shall hand over the said plot to the proposed allottee/s for his / her occupation and use subject to the proposed allottee/s having complied with all the terms and conditions of the buyers agreement. It shall be incumbent on the proposed allottee/s to comply with the terms and conditions of the unit buyers agreement failing which he / she shall fore-fit to the company the entire amount of earnest money, interest or delayed payment etc. and the allotment / buyers agreement shall stand cancelled and the proposed allottee/s shall be left with no lien, right, title, interest or any other claim of whatsoever nature in the unit or membership. The company shall thereafter be free to resell and/ or deal with the said unit in any manner whatsoever at its sole discretion. The amounts, if any, paid over and above the earnest money, processing fee, interest on delayed payments etc. would be refunded to the proposed allottee/s by the company only after realizing such amounts to be refunded on resale but without any interest or compensation of whatsoever nature. The proposed allottee shall pay any amount as demanded by the company towards the stamp duty, registration charges and any other incidental or legal charges for the execution and registration of the sale deed in favour of the allottee/s. The final sale deed shall be registered after the receipt of the sale price and any other dues towards maintenance, Electricity, extra work charges additional parking, maintenance deposit, etc. The demand letter / offer of possession letter issued by the company shall specify the period within which all such charges etc. are to be paid or cleared, in case if the proposed allottee/s fails to pay the above mentioned charges within the stipulated time period, the company in such case shall charge additional delay charges as per the set norms for the period of such delay. The proposed allottee/s shall undertake to execute the sale deed within 30 days from the date of the offer of possession, etc intimated by the company in writing, failing which the proposed allottee authorizes the company to charge any holding amount / charges for the period of such delay in execution of the sale deed. In the event the sale deed is not executed with 90 days of the company s written intimation of offer of possession,etc the proposed allottee authorizes the company to cancel the allotment and forfeit the booking amount and refund 7

the balance sale price paid by the allottee without interest and upon realization of the money from reallotment to any other member/party. The proposed allottee/s shall inform the company in writing any change in the mailing address mentioned in this application failing which all demands, notices etc. by the company shall be made to the address given in this application and deemed to have been received by the proposed allottee/s. In case of joint allottee/s all communication shall be sent to the first named allottee/s in this application. The provisional and / or final allotment of the said unit is entirely at the discretion of the company and the company has a right to reject any provisional and / or final allotment without assigning any reasons thereof. Rates subject to change without prior notice. If any revision in rates takes place even when decision-making process is in progress or full booking amount has not been paid, in those events, The Revised Rates shall become applicable. Project Consultants have rights to change or revise altogether, the scheme or part of the scheme or any details therein and make one or more sub-divisions of any unit or combine two or more units of the scheme and all such changes, revisions, subdivisions and/or combinations shall be binding to all.
