THE CORPORATION OF LOYALIST TOWNSHIP BY-LAW NO. 2017-X 147 Church Street, Bath Being a By-law to amend By-law 414/78 for the purposes of including a statement explaining the property s cultural heritage value or interest and a description of the property s heritage attributes, as well as to include a legal description schedule. WHEREAS By-law 414/78 was enacted by the Council of the Corporation of the Village of Bath on April 3, 1978; WHEREAS pursuant to Section 30.1 (1) of the Ontario Heritage Act R.S.O 1990, C.0.18, as amended, the council of a municipality may, by by-law, amend a by-law designating property made under section 29 and section 29 applies with necessary modifications to an amending by-law as though it were a by-law to designate property under that section; WHEREAS the amendment to include a statement of cultural heritage value or interest and a description of heritage attributes is set out in Schedule B to this by-law; WHEREAS the amendment to include a legal description in a Schedule to the By-law is set out in Schedule A to this by-law; WHEREAS the requirement for Council to consult with its Municipal Heritage Committee pursuant to Section 29 (2) of the Ontario Heritage Act have been fulfilled; WHEREAS the Council of the Corporation of Loyalist Township has caused to be served on the owner of the property and upon the Ontario Heritage Trust, notice of intention to so amend the aforesaid real property and has caused such notice of intention to be published in the same newspaper having general circulation in the municipality; and WHEREAS no notice of objection to the proposed amendment has been served on the Clerk of the municipality; NOW THEREFORE the Council of Loyalist Township enacts as follows: 1) The municipal solicitor is hereby authorized to cause a copy of this amending bylaw to be registered against the property described as PT LT 10 CON BROKEN FRONT ERNESTOWN PT 1 29R7603; LOYALIST TOWNSHIP in the proper land registry office. 2) The Clerk is hereby authorized to cause a copy of this by-law to be served on the owner of the aforesaid property and on the Ontario Heritage Trust and to cause notice of the passing of this by-law to be published in the same newspapers having general circulation in the municipality. 1

SCHEDULE B TO BY-LAW 2017- Description of Property-147 Church Street, Bath 147 Church Street, Bath is a 1 -and- a- half story, side gabled residential building, with a one-story wing at the west gable end. It is located at the end of Church Street on the shore on Lake Ontario in the Village of Bath. Statement of Cultural Heritage Value or Interest 147 Church Street, Bath has architectural value because of its mix of styles that include both Regency and Greek revival characteristics in accordance with published architectural style guides for carpentry available in the 1825 to 1850 period. The interior woodwork in the building reflects the work and skill of local artisans in producing features reflecting both early 19th century vernacular features, as well as features showing the influence of architectural style guides. The building has associative value with Henry Lasher and his son John. Henry was a notary public and served on the Midland District Municipal Council between 1842 and 1843, the year of his death. By Henry s will, John received this front lot. John s career was as a merchant/ storekeeper until 1871. The building has contextual value as it is historically linked to its surroundings and has a strong relationship to both the Bath waterfront and the busy commercial Main Street. SCHEDULE B TO BY-LAW 2017- Description of Property-212 Church Street, Bath 212 Church Street, Bath is a rectangular building that has a main block with a gabled façade to the west. There is a bell tower located at the front center of the building. Located on the east side of Church Street, it is one of the first buildings seen when entering the Village of Bath from the north on County Road 7. Statement of Cultural Heritage Value or Interest 212 Church Street, Bath has architectural value in both the exterior and the interior of the church. The exterior is a tribute to the form of the Parish s second church, built between 1793 and 1795 and lost to fire in 1925. The interior of the worship area retains decorative treatment of the era of the December 1925 opening of the new church building. Historical and associative values in the community rest on its long-established role for an associated parish, first organized in 1787. The building was seen as a spiritual home for community members. The present St John s sits on the site of one of the first Anglican Churches in Upper Canada, built in 1787. The church s first minister was Reverend John Langhorn who was appointed missionary to Ernestown and Fredericksburgh townships in 1787. He was the first resident Anglican clergyman in the Bay of Quinte region and the second in what is now Ontario. 212 Church Street has contextual value supporting the character of the area of residences, social life, and education, established north of the commercial main street and waterfront with wharves and manufactures. SCHEDULE B TO BY-LAW 2017- Description of Property-353 Main Street, Bath 353 Main Street, Bath is a timber frame, two story, rectangular structure with a gabled, roof. It has a classic American Colonial layout and is located on the south side of Main Street in Bath, Ontario. Statement of Cultural Heritage Value or Interest 353 Main Street, Bath has architectural value because it is one of the best examples of an intact federal style commercial and residential building in the province of Ontario. Built in 1816, it features a gable roof and ornate classical details that are representative of a Roman temple. The interior is divided by a center hall plan with a commercial function on the east side and a refined residential side to the west. 353 Main Street has historical and associative value to George Ham who was an important regional character in early Upper Canada. He was a successful merchant, a sergeant in the militia during the War of 1812 and rising to Lt. Colonel by the time of the Rebellion in 1837. He was a Justice of the Peace, and later in Cobourg a member of the Police Board. Most notable were several exchanges between he and Marshal Bidwell who was the 'brains' behind the Reform Movement. Probably George's political ambitions were scuttled by a family lawsuit brought by his father-in-law in 1826. Bidwell was Speaker of the House of Upper Canada for a decade, and coined the term 'Family Compact'. No doubt George was a primary model for the Family Compact. The building has contextual value because it would have been a major landmark within the community being a commercial building on the Main Street of Bath. The building has a strong relationship to the streetscape of Bath, which includes its size, scale and massing. SCHEDULE B TO BY-LAW 2017- Description of Property-370 Academy Street, Bath 370 Academy Street, Bath is 1 -and- a half story building with a three-bay center block set between smaller set back single bay wings, situated on the north side of Academy Street in the Village of Bath. Statement of Cultural Heritage Value or Interest 370 Academy Street has architectural value because of its expression of the Loyalist Neo-Classical style of the first quarter of the 19 th century. The house was built by 1819. The house acquired associative value with the Davy family by its being owned by Peter Davy from about 1835. Its location is on the Loyalist grant Lot 10 received by Peter s father, John. John began subdividing the lot before his death in1808. Peter had town lots and streets surveyed and laid out the streetscape for most of Bath. Other land owners followed his initiative and 31 residents petitioned the Provincial Government to constitute the Town of Bath. The Legislative Council discharged the Bath Bill on November 4th, 1818. Peter Davy was a merchant, inn keeper, mill operator and had dock yards and ships in the Village of Bath. The Davy family had a significant impact on the Village of Bath which helped shape the Village and contributes to our present understanding of the social economic and culture history of Bath. The building has contextual value because it has a strong relationship to the streetscape of Bath, which includes the massing, scale and setback of the building. This property is part of a compatible group of buildings that includes 193 Davy Street (Layer Cake Hall), 367 Academy Street (Peter R. Davy House) and 360 Academy Street (Albert Davy House). In addition, the entrance surround of the house was identical to the stone Davy Store on Main Street. Statement of Cultural Heritage Value or Interest 395 Main Street, Bath has architectural value through its demonstration of the Commercial Regency style, as characterized by the proportion of solids to voids on the main façade of the structure. This structure represents a successful businessman in the Village of Bath. Although not original, the porch is a character defining element that recollects the earlier double verandah as indicated in historic evidence. 395 Main Street has associative value through its connection to Gabriel Belfour (born 1811, Ireland). Gabriel Belfour was an important businessman in the Village of Bath in the mid-nineteenth century as a carriage maker during Bath s most prosperous period. This structure reflects his prominent position in the community. 395 Main Street demonstrates contextual value from its role in defining and supporting the character of the Village of Bath through its massing, scale and setback. This property contributes to an understanding of the Village of Bath to the present day due to its Commercial Main Street Regency style. SCHEDULE B TO BY-LAW 2017- Description of Property 402 Academy Street, Bath 402 Academy Street, Bath is located on the westerly north side of Academy Street. The church, built in 1859, has a rectangular main block with gable-end facade to the south. A bell tower, added in 1901, projects from the southeast quarter of the main building and accommodates the entrance. Statement of Cultural Heritage Value or Interest 402 Academy Street, Bath has architectural value found both in the exterior and the interior of the church. On the exterior, the simple, solid forms of the main building and its added tower are lightened by well-proportioned vertical openings. In the interior, the west, south, and east sides have balconies with pews matching those on the main floor. The older woodwork of the worship area and the wood paneling of the entrance vestibule reflect the respective times as this building evolved. Historical and associative values in the community rest on its long-established role for an associated congregation, first of Wesleyan Methodists who built the church in 1859, and later as the United Church after 1884. It has served as a shelter for the social and cultural life of Bath and served as a spiritual home within the community. 402 Academy Street has contextual value supporting the character of the Academy Street as an environment of residences, social life, and education, in contrast with the town s areas of business and commerce to the south.
