The CSM reconfigures the existing Lot into two Lots, the first (Lot-1) is 1.7244 acres (75,113 sq. ft.) and has an existing single family home and outbuilding on the property, the second (Lot-2) is 3.2299 acres +/- (140,696 sq. ft.) and has an outbuilding that is going to be converted to a single family residential structure when the property is acquired. 5. All of the buildings on both Lots do meet the Zoning Code setback requirements for the R-2 (Suburban Residential District). 6. One of the conditions of the subdivision of the property is that the building permit for the conversion be applied for and approved prior to the Town signing the CSM. 7. Both of the Lots created by the proposed CSM do meet the minimum Zoning Code requirement for the R-2 (Suburban Residential District). 8. Lot-1 of the proposed CSM does have an existing residential ingress and egress access point from Oakridge Road. 9. Lot-2 of the proposed CSM does have an existing agricultural ingress and egress access point from Oakridge Road that will need to be converted to a residential ingress and egress access point as part of the conversion of the garage on the Lot to a single family residential structure. 10. The CSM dedicates 2,391 sq. ft. of Right-Of-Way across the north side of Oakridge Road for a distance of approximately 342.22 +/-. Staff Recommendations: Staff recommends approval of the proposed CSM subject to the following conditions: 1. The CSM must show the Town s right to farm language. 2. Application for and approval of a building permit for the conversion of the garage on Lot-2 of the proposed CSM to a residential structure. 3. Approval of the Re-zoning Application submitted for the same property. Page 5 of 10

The property is not in the County s Wetland Identifier. 10. The land use is consistent with the Town s adopted Land Use Plan. Staff Comments: 1. Based on detailed review of the Town s Zoning Code of Ordinances followed by discussions with the County s Zoning Department staff, the Town s Planning Consultant, and the Town s Building Inspector (Zoning Officer) the Administration has come to the conclusion that in the Zoning Code compliant a storage facility can be seen as an accessory use to the farming process, or in the alternative, the agricultural storage building can be seen as the principal use to the farming of the property. Staff Recommendations: Staff believes that the proposed agricultural storage facility does not require a Conditional Use Permit and recommends that the Plan Commission table the Application with no further action. The property Tax ID is # 006-0405-04. 2. The property consists of approximately 23.180 acres. 3. The property is in the Neenah School District (3892). 4. The property is in the Department of Natural Resources Special Well Casing Area. 5. The property is currently Zoned A-2 (General Agricultural District) by the Town. 6. The property is currently Zoned A-2 (General Agricultural District) by the County. 7. The property is out of the County s Floodplain Zoning Area. 8. The property is in the County Shoreland Zoning 300 foot buffer (staff believes that this restriction has been removed by determining that the waterway on the property is not navigable). 9. The property is not in the County s Wetland Identifier. 10. The land use is consistent with the Town s adopted Land Use Plan. Staff Comments: Page 8 of 10

1. The CSM does not change the existing use of the property and therefore it is consistent with the Town s approved Future Land Use Plan. 2. The CSM does not show the Right to Farm Language required by the Town. 3. The CSM creates one new Lot by dividing Lot-1 of CSM 6785 (see attached copy) into 2 Lots. The first, (Lot-1) is 5.634 acres (245,411 sq. ft.) and has an outbuilding that is currently being constructed on the site. The second is the parent parcel that contains a residential structure with a number of outbuildings. 4. Once divided, the outbuilding now under construction would require a Conditional Use Permit in the A-2 (General Agricultural District). In order to remove any potential cloud from the title to the property the owner has applied for a Conditional Use Permit with the Town. 5. All of the buildings on the parent parcel do meet the Zoning Code setback requirements for the A- 2 (General Agricultural District). 6. Lot-1 of the proposed CSM does have an existing agricultural ingress and egress access point from Center Road. 7. It is the Administration s understanding that the stream on the parent parcel has been determined to be not navigable and therefore not subject to the County s 300-foot Shoreland Buffer. Staff Recommendations: Staff recommends approval of the proposed CSM subject to the following conditions: 1. The CSM must show the Town s right to farm language. 2. Documentation of the approval of the proposed CSM by any overlying unit of government having jurisdiction. E. Discussion/Recommendation: Plan Commission review and consideration of draft Future Land Use Maps for the eastern quadrants of the Town of Clayton and the related Map Legend Classifications. Attached please find copies of the Future Land Use Maps for the eastern quadrants of the Town of Clayton. Staff has developed the Draft Future Land Use Map using the Outagamie County Airport Overlay Zoning District and the Town s plans for municipal sanitary sewer and municipal water utilities to provide services to the eastern quadrants of the Town. Staff will be ready to review the maps and answer any questions the Commissioners may have. Additionally, staff would like to review and rationalize the Map Legend Classifications with the Commission. Staff is having some difficulty with the Future Land Use Map classifications of Agricultural/Rural Residential and the Zoning Map classifications of R-1 (Rural Residential) and R-2 (Suburban Residential). From staff s perspective, the R-1 (Rural Residential) and R-2 (Suburban Residential) are distinguished by the type of development: R-1 (Rural Residential) is done by Certified Survey Map and R-2 (Suburban Residential) is done by Plat, however, because of the need for on-sight wells and septic systems the end result of the process is virtually identical. This process is likely to change with the provision of municipal utilities in the eastern quadrants of the Town. The Plan Commission may wish to consider some changes to both the Zoning Map Legend Page 9 of 10

and the Future Land Use Map Legend. Staff is considering several recommendations and will be ready to discuss the issue with the Commission. Lengthy discussion (one hour) regarding the future land use map. Planner Jaworski reviewed the map in detail. Farmland Preservation issues in the Town of Clayton. Discussed how commercial business affects how the roads get wore down. The Town of Clayton is in the process of trying to hook up to existing water systems in surrounding communities. Gave some ideas on the potential of splitting up some lots into commercial and/or rentals, residential, etc. areas. VII. VIII.
