VPOA RULES AND REGULATIONS Section A - Tenants and Lease/Rental Agreements 1. All Section 1, Townhouse lease/rental properties will be leased in compliance with the Woodcreek Village, Section 1, Deed Restrictions and the Texas State Property/Lease Laws. All Section 1A, Country Cabin, lease/rental properties will be leased in compliance with the Woodcreek Village, Section 1A, Deed Restrictions and the Texas State Property/Lease Laws. 2. All property owners are responsible for providing their tenants, prior to tenant movein, a current copy of the appropriate Deed Restrictions, the VPOA Rules and Regulations, and the information that before a tenant undertakes any type of exterior project, the lot owner must first submit and have approved a current Architectural Review Committee (ARC) Approval Form for the type of project to be undertaken. Section B - Common Area Vehicular Rules and Regulations 1. All parking and roadways are on common areas and vehicles shall not be driven, ridden, and parked anywhere except on designated vehicular roadways and parking areas. Vehicle exceptions are limited to vehicles owned or operated by utility and similar companies, construction material deliveries, and grounds or service companies. Any other vehicle exceptions must have prior approval by the VPOA Board. 2. No inoperable vehicle shall be stored anywhere on common area. After 72 hours, any vehicle that is inoperable due to general condition, expired registration and/or inspection shall be considered abandoned. No 10 day notice shall be required. 3. No vehicle maintenance work shall be done, except routine maintenance by a resident and to a resident vehicle. No maintenance work shall exceed two days or be done anywhere that disrupts, blocks, or limits the general flow of traffic and resident parking. After 72 hours, a vehicle still being worked on shall be considered inoperable. The resident shall remove and dispose of any debris or waste from vehicle maintenance in a safe and hazard free manner immediately after maintenance work is completed. No 10 day notice shall be required. 4. No designated common area parking places for motorized boats, recreation vehicles, large trucks, or trailers of any kind are available. These types of vehicles must not be parked or stored on common area parking. 5. Moving vans/vehicles and commercial vehicles may remain on common area parking only while loading and unloading. If overnight parking is required to complete loading or unloading, the van/vehicle must not be parked anywhere that disrupts, blocks, or Rules and Regulations Page 1 of 5 Village Property Owners Association, Inc.
limits the general flow of traffic or resident parking. Moving vans/vehicles and commercial vehicles must not be parked, left, or stored on common area parking, in excess of 48 hours. No 10 day notice shall be required. 6. Motorcycles, mini bikes, golf carts and other similar motorized vehicles may be ridden and parked on designated common area roadways and parking areas only. Section C - Pet Responsibility, Rules and Restrictions 1. Pets are restricted to domestic dogs, cats, and other small common household animals, birds, and fish. No snakes or poisonous reptiles shall be allowed. No dog trained or used as a fighting dog, or any type of hybrid dog or cat, such as a dog/wolf or cat/bobcat, shall be allowed. Pets must not be considered a threat or danger, real or implied, to other property owners, their family members, tenants, guests, employees or pets. No pets shall be raised, kept, bred, bought, or sold for commercial purposes. Any remaining animals in a litter, over the number of pets allowed per residence, shall be permanently removed from the subdivision by the age of three (3) months. The total number of pets per residence shall not exceed three (3) animals at any time. The number of dogs shall not exceed two (2). 2. Dogs, in Section 1, Townhouses, must be restricted to within a property owners back lot lines, either by a fence or a leash. Dogs in Section 1A, Country Cabins, must be restricted to within a property owners lot lines. 3. No property owner, with a common connecting sidewalk within his/her property lot lines, shall allow any pet free access to the common connecting sidewalk. 4. Pets allowed outside shall be limited to dogs and cats. No lot owner shall allow his or her lot to become unsanitary or obnoxious by the accumulation of pet excrement, or by the odor of the pet, its urine, pet shelter, or pet bedding. No pets shall be left outdoors overnight. No pets shall be left unattended, tied, or housed on common areas, or in vehicles. No pets shall be left unattended, tied, or housed on porches, balconies, or second story decks. 5. No dog shall be allowed to bark and/or howl to such an excess as to be considered a nuisance and disruption by other property owners, their family members, tenants, guests, and employees. 6. No pet shall be on the common area unless leashed, restrained, or under immediate control of the owner. Pet owners are requested to remove any of their dog s excrement from sidewalks, pathways, parking areas, other property owner yards, and any other pedestrian areas. 7. Section D - Exteriors, Yards, Patios, and Balconies 1. Exterior lights shall be non-glare, low wattage, and shall not disturb the comfort of others by glare or over illumination of other properties and common areas. 2. Signs shall be limited to leasing and sale signs in the front areas of a lot only. Yard signs shall be limited to one (1) sign, not to exceed two by three (2 x 3) feet in size or four (4) feet in total height, including the post. Front window signs shall be limited to one (1) sign, not to exceed two by two (2 x 2) feet in size. 3. No clothes lines shall be erected. No clothes or other fiber goods shall not be dried in public view. No clothing, towels, blankets, or other fiber and fiber-like goods shall be hung outside, in windows, or in public view. 4. No antenna or satellite dish shall be attached to any building or roof. All antennas and satellite dishes must be approved by the VPOA Architectural Review Committee (ARC) prior to installing. 5. Liability and safety issue items, including, but not limited to tools, children s toys, pools, and play equipment, sports, exercise, and camping equipment shall not be placed, left or stored in the front area of any property. 6. Yards, patios, porches, balconies, building exteriors, and other exterior areas shall not be used for storage, including, but not limited to the storage of household furniture, appliances, boxes, containers, large power tools, large sports and exercise equipment. No motorcycle, mini bike, golf cart or similar motorized vehicle shall be stored or parked on any property owners lot. 7. No trash, garbage, or rubbish, shall be allowed to accumulate on any property. No garbage or trash bags shall be left or stored outside. No trash cans and containers shall be kept in front areas of a lot. No dangerous, explosive, flammable, or toxic substance, object, or material shall be stored in exterior areas. Storage of commonly sold equipment, items, and substances used for household and exterior cleaning and maintenance shall be limited to the back areas of a lot and shall not be stored or left in public view or access. Small barbeque propane tanks are considered an exception, only when safely stored in back lot areas. In Section 1, Townhouses, barbeque grill use is limited to back lot areas, unless a variance has been approved by the ARC. 8. No exposed, exterior, utility service lines of any kind may be attached to any building or installed on any property. No sewer clean out drain may be used for a waste line or left uncapped on any property. 9. All property owners shall be responsible for their construction employees. All construction equipment, materials, and debris shall be contained and not obstruct sidewalks, common areas and other lots more than is reasonable for the type of Rules and Regulations Page 3 of 5 Village Property Owners Association, Inc.
construction project being done. No hand tools and/or small power tools shall be left in public view or access over night. Large power tools (unconnected to a power source), saw horses, ladders, scaffolding, dumpsters, and small construction trailers for tool and material storage and/or debris may remain in place during the duration of the construction project. All construction equipment, materials, and debris must be removed within 7 days from project completion. All property owners must have submitted a current ARC Approval Form to the VPOA ARC and the form must have been approved before any work is started. 10. No property owner shall allow shrubbery, fences, or personal items to obstruct, block, cover, and/or limit the access of other residents, service personnel, and/or maintenance personnel to any other lot, common area, and/or common connecting sidewalk. 11. All property owners must keep the exterior areas within their property lot lines in a neat, attractive, healthful and sanitary condition for the benefit of all property owners and to protect the property values of the Woodcreek Villages. 12. No detached, vinyl, plastic, or Rubber Maid type storage units are allowed. All storage units must be approved by and built to the specifications of the ARC. 13. No sale, activity, trade, or business shall be conducted or open to the pubic that increases the flow of traffic into the subdivision or that disturbs the safety, comfort, or serenity of the other residents. 14. No artificial flowers or plants or any type of wildlife or bird netting shall be used in exterior areas, unless approved by the ARC. No item shall be nailed or permanently attached to any tree. No glass, plastic, ceramic, or breakable items shall be hung in trees or shrubbery, and any item shall be subject to removal upon request by the Association. No empty plant pots, stands, planters, or containers shall be left or stored in the front exterior areas of any lot. No front lot area shall be so obstructed with items as to hinder maintenance by the grounds service. No damaged or broken items shall be kempt or stored on a lot Section E - Common Area Use 1. No event and/or social gathering shall be held on common area for members of the general public or that encourages the attendance of the general public. 2. No personal property shall be left or stored on the common area overnight. 3. No pools of any type, including child pools, shall be located on the common area. 4. No boats shall be left or stored on the common area. When available, an assigned, designated storage location for one non-motorized boat, 13 feet or under in length, may be requested by and assigned to a property owner. 5. Bicycles shall be hand walked, not ridden, on common connecting sidewalks or individual residence sidewalks. Bicycles may be ridden on roadways, parking areas, outer paths along the creek, and on less heavily used pedestrian paths and areas. Bicycles must always yield the right of way to pedestrians. 6. Property owners, their family members, tenants, guests, employees and/or pets must not in block, limit, enclose, obstruct or encroach on any part of the common area, including but not limited to green spaces, sidewalks, common connecting sidewalks, paths, areas between buildings, parking areas, and roadways. Section F General Information All violations of the Rules and Regulations by property owners, their family members, tenants, guests, employees, and pets shall be the sole responsibility of the property owner. Payment of all financial costs associated with and resulting from said violations shall be the sole responsibility of the property owner. Unless otherwise stated in a section or individual rule and regulation, a 10 day written notice shall be mailed, in the form of Delivery Confirmation, to any property owner in non-compliance, and that notice shall be the only notice sent or required. Property owners may be accessed a non-compliance fine of $10.00 a day starting 10 days from the date of notice. On behalf of the Association, the VPOA Board may, at its discretion, take any legal action that is allowable by law to enforce these Rules and Regulations and collect non-compliance fines. Any request for a Rule and Regulation exception, an extended notice period, and/or waiver/reduction in fines shall be determined by the VPOA Board on an individual property owner basis and shall not affect the compliance of other property owners. In the context of these Rules and Regulations, any reference to the word, front, (as in front lot lines, front yards, front areas) shall refer to, describe, and mean any area that would be considered, by a member of the general public, to be the front of the residence and where a front entrance would commonly be located. * These Rules and Regulations approved by a vote of the general membership at the Annual Membership Meeting on Jan. 31, 2009, and shall retire and replace all previous Rules and Regulations.
