Introduction In any private community, rules and regulations must exist to help ensure quality of life and to maintain an aesthetically pleasing community, which intern keeps real estate values high. These Rules and Regulations have been adopted in an attempt to be fair and considerate to all. We must never lose sight of the fact that the community belongs to everyone and should be enjoyed to the fullest extent. First and last we must be good neighbors. The following Rules and Regulations are enforced internally via the Shearon Farm Single Family HOA Board of Directors. The objective is to provide fair and impartial enforcement of the rules and regulations. Any violations seen by a homeowner or tenant should notify the Board of Directors as a means to address the violation and/or levying monetary fines.

Board of Directors The HOA Board of Directors is elected each winter (January) by the homeowners and is charged with executing the Declaration of Covenants and Restrictions of the HOA. The covenants are not optional and are binding on all homeowners. The HOA Board of Directors established the Architectural Review Board (ARB), Beautification Committee, Covenant Review Committee, Outreach Committee, Social Committee, and Neighborhood Watch Committee to help get the community more involved. All members who serve on the HOA Board and Committees are volunteers. Please contact the HOA Board of Directors if you would like to volunteer for a committee position or would like to serve on the HOA Board of Directors. All HOA Board of Director positions are 3 year terms and Committee members are at will. The fee for FY12 is $180 (annually) and payment of the fees is mandatory. Instructions will be provided to the homeowners prior to the 1 st of January on how to pay the assessment. In previous years, we have used an on-line tool to collect association dues. Note: Failure to pay the required homeowner's association fees may result in late fees and a lien on your property. A Word to Homeowners If you own the property, you are responsible at all times for the compliance of your family, your fmaily s guests, contractor, sub-contractor or invitees, to these rules and regulations. If you are a landlord, please reference the section below. These Rules and Regulations or Fine Schedule, may be amended or revised by the HOA Board of Directors in an effort to keep all materials both relevant and current. A Word to Landlords and Tenants If you rent your property, you are responsible at all times for the compliance of your tenant, your tenant s guests, contractor, sub-contractor or invitees, to these rules and regulations. If you are a tenant, you should read this document carefully, remembering that it is in addition to any other rules or restrictions in the lease agreement as exist for the house in which you are renting. For the mutual acknowledgement and protection of both the landlord and tenant, it is strongly urged that a copy of these Rules and Regulations be attached to and made a part of every lease agreement. These Rules and Regulations or Fine Schedule, may be amended or revised by the HOA Board of Directors in an effort to keep all materials both relevant and current.

Rules and Regulations Article 1 General Violation Fine Schedule for Section 1 & 2 WARNING $50 $100 $250 Section 1 Section 2 Those violating any of the Rules and Regulations contained herein, or as may be enacted from time to time by the HOA Board of Directors, will be subject to fines, or other such penalties as the HOA Board of Directors may from time to time impose. Where a breach of a rule or regulation also constitutes an unlawful act, the HOA Board of Directors reserves the right to actively pursue all lawful remedies in addition to any penalties outlined herein. Fine Schedule for Section 3 & 4 WARNING $50 $75 $100 Section 3 Section 4 All applicable municipal, state, or federal codes and statutes are incorporated herein by reference, as are the Shearon Farm Homeowners Association s Declaration of Covenants and Restrictions No community resident may at any time be the guest of another community resident for the purpose of accessing or using any community facility. (e.g. Master Association Pool) Fine Schedule for Section 5 & 6 WARNING $50 $100 $150 Section 5 Section 6 Any non-resident who repeatedly violates any rule or rules, regulation or regulations, may be barred and prohibited by the Board of Directors from entry into the community. During such period of barring and prohibition, should such non-resident be found within the community, they shall be prosecuted for trespassing. NO hunting of any kind is permitted within the community. No rifles or pistols of any kind may be fired at any time. These rules include air and gas powered rifles or pistols. Bows, crossbows, and arrows are not permitted. (Note: Fishing is permitted)

Fine Schedule for Section 7 & 8 WARNING $25 $50 $100 Section 7 Section 8 Loud music, as well as disruptive, vulgar or offensive behavior of any kind is not permitted. Yards sales are limited to two annually per house, and only household and personal items may be sold. Please notify the Board of Directors prior to conducting the sale and prominently displayed during the sale. Fine Schedule for Section 9 WARNING $100 $250 $500 Section 9 A zero tolerance policy exists regarding any act of vandalism against any property within the Shearon Farm Homeowners Association. Person(s) found guilty of vandalism shall be subject to fines not to exceed $500, be liable for the full cost of repair to vandalized property, plus be subject to prosecution to the fullest extent of the law. Article 2 Renting and Resale Fine Schedule for Section 1, 2, 3, 4, 5 & 6 WARNING $50 $150 $250 Section 1 Section 2 Section 4 Section 5 Section 6 Owners MUST notify the HOA Board of Directors of the rental, lease, or sale of their property within one week of a fully executed agreement for same, so that resident registration and closing procedure packages may be promptly forwarded to new residents. A tenant registration fee of $250 is required for all new tenants, including tenants relocating within the community. The $250 fee is to be paid by the homeowner. Owners are responsible to ensure that ALL Tenants or Buyers are aware of and receive a copy of the Rules and Regulations. Owners must incorporate these Rules and Regulations as a part of any and all lease agreements. Ultimately, owners are responsible for the actions of their Tenants. Only one For Sale of For Rent sign is permitted per property. Signs will not total more than one (3) square foot in size. All signs violating this rule will be removed by Board of Directors. During Open Houses, one additional sign may be placed on the property being offered for sale for a maximum time frame of 4 hours. Owners are responsible to ensure the lawn is well maintained and neat and tidy at all times. Lawns that are not maintained will be subject to a fine as well as the Board of Directors requesting the yard be maintained. Note: Owners are responsible for the actions of their Tenants.

Article 3 Landscaping Fine Schedule for Section 1 & 2 WARNING $50 + Mowing Fee $100 + Mowing Fee $250 + Mowing Fee Section 1 Section 2 Section 3 Section 4 Section 5 Section 6 Section 7 Mowing: Turf shall be mowed as needed during the growing season; schedule may be altered due to inclement weather or temperatures. The length of the lawn should not exceed 5 inches in length. All lawns must be maintained by the homeowner or by a licensed professional. Trimming/Edging: Trimming/edging around all obstacles, fences, trees, flowerbeds, buildings, curbs and so forth so as to create a neat and finished appearance consistent with the turf height and limits shall be accomplished. Landscaping and flower beds: Shall be weeded as needed, kept free of grass and weeds. Mulch shall be maintained by top dressing to maintain coverage. Trees and shrubs: All trees and shrubs shall be trimmed and shaped at least annually and maintained for a neat appearance. Annual Maintenance: All lawns must be of a fescue, bermuda or zoysia variety. Due to annual growing seasons, the repair and/or replacement of the lawn should be done in the fall for fescue varieties and spring for bermuda or zoysia varieties. Owners are responsible to ensure the lawn is well maintained all times. After the Board receives a formal complaint, the homeowner will be contacted and given a maximum of seven days to mow the lawn. If the homeowner fails to comply, the association will mow it at the owner s expense plus the associated fee. Owners are responsible to ensure the lawn is well maintained and neat and tidy at all times. Lawns that are not maintained will be subject to a fine as well as the Board of Directors requesting the yard be maintained. Note: Owners are responsible for the maintenance of their property regardless of any agreement between the Landlord and Tenant. Article 4 Exterior Maintenance Fine Schedule for Section 1 & 2 WARNING $50 $100 $250 Section 1 Section 2 General: The exterior of a structure shall be maintained in good repair, structurally sound and sanitary so as not to pose a threat to the public health, safety, or welfare. Owners are responsible to ensure that properties adhere to the rules and regulations as this is not a responsibility of a tenant. Exterior Painting: All wood and metal surfaces, including but not limited to, window frames, doors, door frames, cornices, porches and trim shall be maintained in good condition. Peeling, flaking, and chipped paint shall be eliminated and surfaces repainted.

Section 3 Section 4 Section 5 Section 6 Stairways, Decks Porches, and Balconies: Every exterior stairway, deck, porch and balcony, and appurtenances attached hereto, shall be maintained structurally sound, in good repair, with proper anchorage and capable of supporting the imposed loads. Windows and Door Frames: Every window, door, and frame shall be kept in sound condition, good repair and weather tight. Doors: All exterior doors and hardware shall be maintained in good condition. Fences: All fences shall be maintained in good condition. Note: Owners are responsible for the maintenance of their property regardless of any agreement between the Landlord and Tenant.
