In addition to all state and county laws, Hi Roc HOA has adopted the following Rules and Regulations and Guidelines. Homeowners and residents are responsible for complying with the Rules and Regulations AND are also responsible for ensuring their guests or tenants comply with these Rules and Regulations. The Association is responsible for: 1. Supplying certain services and/or amenities to all properties with the boundaries of the subdivision (i.e., general clean up and improvements to common areas). 2. Monitoring all properties within the subdivision to the best of its ability, and to control infractions against the Declarations, Bylaws, and Rules and Regulations by owners and tenants as they might occur. 3. Review and approve plans of future developments within the subdivision. 4. Interface with governmental agencies to promote the subdivision and gain their assistance in developing programs which benefit the Association. The Homeowner is responsible for: 1. Maintenance and repair of his/her buildings, decks, stairs or walkways. In the event that the homeowner fails to adequately maintain these items, the Association may (after sufficient notice) contract to have the items corrected and assess the charges against the owner s account. 2. Procuring insurance for his/her home or lot. 3. Maintenance of broken water pipes under/on/in the home. 4. Animal control (your animal or your tenant's animal). 5. Ensuring that your residents, guests, and tenants are aware or have a copy of the Hi Roc Homeowners Association Rules and Regulations. Assessments, Penalties, Restrictions, Suspensions, Fines, and Liens 1. Unpaid dues or assessments; interest; fines; liens: Association dues, or assessments, which are billed annually, shall become delinquent if unpaid, 30 days after due date, or such other date as specified. The Association will charge a late fee of 10% on unpaid dues or assessments. The Association will also levy interest of seven (7) percent according to state law. Liens against the property of delinquent members may be filed, if dues or assessments, late fees and interest are unpaid for a period of 90 days. 2. Unpaid dues or assessments; Restrictions: Voting privileges for Hi Roc Homeowners Association members with dues or assessments more than six months in arrears shall be

suspended and will be ineligible to vote at annual or special meetings of the Association; nor shall such members be permitted to hold an elective office in the Association; may not serve on Association Committees, and, except for use of roads, may not use the common or recreational facilities owned by the Association. 3. Suspensions and Fines: The Hi Roc Homeowners Association Board of Directors may assess fines for violations of rules and regulations and/or may suspend the rights of any member, lessee or guest from the use of common and recreational facilities for a reasonable period of time for violations of rules and regulations regarding the use thereof, and/or in accordance with procedures established by Declaration of Hi Roc Plantation and the Laws of the State of Georgia. 4. Ninety (90) days after assessment due date, the account may be subject to additional charges including, but not limited to, cost of collection for reasonable attorney s fees and such other fees as are necessary to collect from the owner. NONCOMPLIANCE Violation of these Rules & Regulations will be communicated to the Owner stating the specific violation. If the noncompliance continues or is repeated after five (5) working days of such notice, the Owner will be subject to a daily fine of $50.00 daily per the recorded instruments, unless stipulated otherwise herein. Repeated violators of the same noncompliance will result in additional fines. Any fine assessed must be paid within 30 days of the date of written notice from the Board of Directors to the Owner. Fines unpaid after 30 days will be treated in the same manner as assessments and subject to an interest charge at the legal rate. Ninety (90) days after notice of a fine from the Board of Directors, the account may be subject to additional charges including, but not limited to, cost of collection for reasonable attorney s fees and such other fees as are necessary to collect from the owner. Checks returned for Non-Sufficient Funds are subject to an NSF charge which shall be in compliance with the Code of the State of Georgia. ARCHITECTURAL AND ENVIRONMENTAL CONTROL Recorded Hi Roc Plantation Declaration, Book 3565, Page 118, No building or exterior modifications shall be erected, placed, maintained, or altered on any Lot until the plans (construction and or specification plans) have been submitted to and approved in writing by the Board of Directors or by an architectural committee composed of three (3) or more representatives appointed by the Board of Directors. The plans should include the following information regarding the external design, types of materials, colors and location in relation to surrounding structures and topography. The minimum heated square footage of all Residential Structures shall be over 2,500 square feet. Reference herein to "Architectural Control Committee" shall refer either to the aforesaid Committee, if appointed and constituted, or to the Board of Directors, whichever happens to be acting at the time. In the event the Architectural Control Committee fails to approve or disapprove any design, ~ 2 ~

materials, colors and location within forty-five (45) days after all required plans and specifications have been submitted (and fees, if required, have been paid), approval will not be required and this provision will be deemed to have been fully complied with. The Architectural Control Committee is authorized where it deems appropriate to charge a review fee for any submission to defray the costs of reviews it conducts or authorizes. It is the intent of this Section that all buildings and structures within the Property shall be constructed of attractive exterior materials of high quality. In its review of submissions, the Architectural Control Committee shall evaluate the construction standards and building materials for all proposed construction on the Lots to insure that they are in conformance with such objectives. Accessory buildings, enclosures, appurtenant structures to, or extrusions from any building or structure on any Lot shall be of similar or compatible materials, design and construction. Exterior finishes once approved shall not be altered without the express consent of the Architectural Control Committee. EFFECTIVE DATE These Rules and Regulations and any subsequent amendments shall be effective on the date adopted by the Board of Directors unless a later effective date is approved. The Rules and Regulations may be amended or repealed in whole or in part by a majority vote of the Board of Directors. Common Areas The natural and wooded areas are declared to be protected growth areas. Unauthorized encroachment is prohibited. Parking 1. No cars shall be parked on the streets between the hours of 12 midnight and 7am. 2. All garage doors shall remain closed when not in use. 3. No major repairs to any motorized vehicle shall be made or performed on any driveway or front, side or back yard of any lot. Repairs should be confined to the garage. 4. No commercial vehicle (tractor-trailers or box trucks) shall be parked in resident s driveway, street in the front of the home, or in common areas overnight. (Code Enforcement will be notified.) 5. No vehicle shall be parked, permanently or temporarily, on any exterior area of the Lot other than on the primary driveway serving the residence. Vehicles may not be parked or stored anywhere in the yard. 6. Motor homes/rv may not be parked in the subdivision. 7. Residents must notify the Neighborhood Watch (hirocwatch@outlook.com) by email of parties if the party will have excessive parking or goes past 12 Midnight. 8. Small utility trailers may be parked behind the house. ~ 3 ~

Pets (Animal Control will be contacted.) 1. All pets must be on a leash when walking per Rockdale County Leash Laws; even in front of your home. When walking your animal, please carry a pooper scooper or bag to collect your pets waste. 2. No dogs shall walk freely throughout the subdivision. Dogs wandering without its owner will be subject to being picked up by Animal Control. 3. An owner may keep and maintain a maximum of 4 domesticated pets such as dogs, cats, or other usual and ordinary household pets (Declarations Section 3). Dangerous animals shall not be permitted on the common elements at any time. Commercial Breeding is prohibited. 4. No livestock or poultry of any kind shall be raised, bred, or kept on any Lot. (Declarations Section 3). 5. If a pet is a nuisance or creates a nuisance, the Board may require its permanent removal from the premises. Lawns/Lots 1. Lawns must be maintained and manicured to include paper removal and other debris. 2. Grass clippings are not to be left in the street or blown into the storm drains. This is a violation of Rockdale County Code. 3. Trash cans are not to be left at curbside for more than 24 hours. As stated by Rockdale County Code: The owner, occupant and lessee of all property, jointly and severally, are required to remove all litter and place the litter in proper container. (Code Enforcement will be notified.) 4. All recreational equipment (i.e. portable basketball hoops, soccer goals, etc.) may only be used on private property (driveways). 5. Outdoor clotheslines are prohibited on properties. (Declaration Section 15) 6. Television antennas are prohibited. Satellite dishes shall be placed in the least visible location. (Declaration Section 11) 7. Loitering and Trespassing upon any lots in the neighborhood is unlawful according to both Local Ordinances and State Codes. Owners are encouraged to contact the Sheriff immediately if they see anything suspicious on any lot. 8. No Lot shall be used or maintained as dumping ground for rubbish. If, in the opinion of the Board, an owner fails to maintain his property in a neat and orderly condition or otherwise neglects his property and allows unsightly conditions to develop, the Board, after five (5) days written notice to the owner, may, but is not obligated to, take steps to remedy the problem at the owner's expense. This includes vacant lots. Noise 1. Excessive noise, such as made by stereos and musical instruments, is prohibited. (Declaration Section 17) 2. A 10:00 p.m. QUIET CURFEW is in effect. Neighboring owners have the explicit right to contact the Sheriff if noise is excessive (can be heard on their property). ~ 4 ~

3. Musical equipment in residentially zoned areas. It shall be unlawful for any person to operate or cause to be operated on private property within a residentially zoned area musical equipment which causes such music, speech or sound to be plainly audible to a person of ordinary hearing ability beyond the property line of the property from which the sound is originating. (Code of Rockdale County) Property Rental 1. All rental agreements shall be documented with a written lease that is expressly subject to the provisions of the Declaration of Covenants and restrictions, the By-Laws, and Rules and Regulations. Leases must also provide that the failure of the lessee to fully comply with the terms and conditions of the Declaration of Covenants and Restrictions shall constitute a default under the lease. 2. A copy of the Lease Agreement must be provided to the Association within 30 days to avoid fines for noncompliance. 3. Owners are required to supply tenants with a copy of the current Rules and Regulations prior to move-in. Miscellaneous 1. Residents should contact Snapping Shoals (at no charge) to replace light bulbs in street lights. 2. No structure of a temporary character, trailer, basement, tent, shack, garage, barn, or other outbuilding shall be used on any lot at any time as a residence, either temporarily or permanently (Declaration Section 12) 3. Defacing common property is prohibited. 4. All seasonal holiday decorations, including lights, may be installed 30 days prior to the holiday and must be removed by no later than 30 days following the holiday, with the exception of winter holiday decorations which may be installed beginning November 15 th. OFFICIAL VERSION OF RULES AND REGULATIONS The Association Coordinator shall maintain a current and accurate set of the Rules and Regulations, which shall be available for inspection and distribution to HOA Homeowners/Members. SERVICE OF NOTICE Whenever any notice is required by the Rules and Regulations to be served on any person or entity, the mailing of such notice to his or her last known address as shown on the records of the HOA shall be deemed the official mailing address and official notice. THESE RULES AND REGULATIONS CAN BE CHANGED OR ADDED TO BY THE BOARD OF DIRECTORS. ~ 5 ~
