\ SIERRAS OF EVERGREEN SECTION Sierras of Evergreen has standards of conduct and practices of operation that have been established over the years. These standards of conduct and practices are covered under Rules and Regulations and are for the comfort, care, enjoyment, and peaceful coexistence of all occupants. This manual outlines the Rules and Regulations that have been established by the Boards of Sierras of Evergreen for the benefit of all Owners including Tenants (as defined in Article 1 of the Condominium Corporation Bylaws). Article 3, 4, 5 and 43 of the Sierras of Evergreen Corporation 0519103 Bylaws gives the Board of Directors the authority, under Duties of the Owner, Duties of the Corporation, Power of the Corporation, and Violation of By-laws to prepare and manage these Rules and Regulations. Article 2C of the Sierras of Evergreen Corporation 0519103 Bylaw states, If there is any conflict between the Bylaws and the Act; the Act prevails and therefore if there is any conflict between the Rules and Regulations and the Bylaws, The bylaws and/or the Act prevails. ACTIVITY ROOMS/COMMON AREAS Pursuant to Article 61 Use and Occupancy Restrictions and Article 63 Use of Common Property of the Bylaws of Evergreen Condominium #0510913, the Board of Directors passed the following Rules and Regulations. 1. All common areas (e.g. the gym, the pool/spa, craft room, Hobby Shop, 2 nd Floor Hobby Shop, +15, games room, outdoor courtyard, reading and sitting areas) are the property and responsibility of the Condominium Corporation. As such these rooms or areas are for the unrestricted use of all Owners/Tenants as long as it is used for the purpose each room/area is designated for. This includes, but is not restricted to, classes, in services, personal use, and group use. 2. Equipment in any of these rooms or areas is owned by the Condominium Corporation and are there for all Owners/Tenants to use. The user is responsible for the equipment and is to use it for its intended purpose only. All rooms/areas are to be used at Owner s own risk. 3. No one Owner/Tenant or group of Owners/Tenants may restrict any other Owners/Tenants from using any of the Activity rooms/areas and/or any equipment contained therein. COMMON AREA STORAGE Pursuant to Article 61 Use and Occupancy Restrictions, of the Bylaws of Evergreen Condominium #0510913, the Board of Directors passed the following Rules and Regulations. 1. No personal goods, supplies, equipment, furniture, fixtures, or materials of any kind, are to be stored in any common storage area. DECORATING Pursuant to Article 61 Use and Occupancy Restrictions, of the Bylaws of Evergreen Condominium #0510913, the Board of Directors passed the following Rules and Regulations. 1. Seasonal ornaments to celebrate the usual holidays or events, such as but not limited to Christmas, Thanksgiving, Grey Cup, Easter, Stampede, and Canada Day, can be displayed on hallway doors for a specific period of time using over-the-door hooks or 3M removal hooks and not attached to the door, door frames, or hallway walls. 2. Artwork, decorations, adornments or furnishings placed in the hallways and/or common areas, without Board of Directors permission, will be considered Condominium property and will be removed. EVERGREEN ROOM Pursuant to Article 5 Powers of the Corporation, of the Bylaws of Evergreen Condominium #0510913, the Board of Directors passed the following Rules and Regulations. 1. Owners/Tenants must pay a rental fee and a damage deposit to rent the Evergreen Room. 2. Your rental booking includes the Evergreen Room, attached kitchen & 2 nd floor bathrooms ONLY. Guests are not permitted in any other part of the building. 3. The Evergreen Room may not be booked for Wedding Receptions. 4. Owners/Tenants are 100% responsible for any damage done by themselves or their guests. 5. The front entry of the Amenities Building must remain locked AT ALL TIMES. If guests are arriving at different times, Owner/Tenant must supply a doorman. ABSOLUTELY NO DOOR is to be propped open for unlimited access! 6. Smoking is not permitted on any Common Condo property including the Courtyard & the Evergreen Room balcony Smokers MUST go to the street to smoke. 7. Candles are not permitted unless they are battery operated. 8. You may warm food using the stove top and over but there is NO COOKING permitted. EXERCISE ROOM Pursuant to Article 5 Powers of the Corporation, of the Bylaws of Evergreen Condominium #0510913, the Board of Directors passed the following Rules and Regulations. 1. All equipment in the exercise room is the common property and responsibility of all Owners/Tenants of Sierras of Evergreen Condominium. The exercise room is for the EXCLUSIVE USE of the Owners/Tenants of Sierras of Evergreen. 2. Any equipment that is in the exercise room has been approved by the Board of Directors. No unapproved equipment is allowed as this would have a negative effect on our insurance. 3. GROUPS AND COMMITTEES Pursuant to Article 5 Powers of the Corporation, of the Bylaws of Evergreen Condominium #0510913, the Board of Directors passed the following Rules and Regulations: 1. In the event a capital reimbursement is required, it must be pre-approved by the Board of Directors, using the appropriate form. It is the responsibility of the Group or Committee to get pre-approval. 2. A yearly financial report must be submitted to the Board of Directors at the end of April each year. 3. GUEST SUITE Pursuant to Article 5 Powers of the Corporation, of the Bylaws of Evergreen Condominium #0510913, the Board of Directors passed the following Rules and Regulations: 1. Owners/Tenants must pay a daily rental fee and a deposit to rent a Guest Suite(s). 2. There is a maximum stay of two weeks for any Guest Suite rental. 3. A maximum of two Guest Suites per Owner/Tenant are allowed during peak times. 4. Under NO circumstance is an Owner/Tenant or a guest s pet allowed in the Guest Suites. 5. All guests must be accompanied by an Owner when using any of the facilities. 6. Owner/Tenant must be in residence in the complex when they have guests occupying Guest Suites. 7. NO SMOKING is allowed in the guest suite or any of the common areas. This includes the courtyard. 8. HOBBY AND WOODWORKING SHOPS Pursuant to Article 5 Powers of the Corporation, of the Bylaws of Evergreen Condominium #0510913, the Board of Directors passed the following Rules and Regulations: 1. Only Owners/Tenants may use the facilities of the Woodworking and Hobby Shops (hereinafter called The Shops ). Non-residents may be in the shop ONLY as a visitor and are not allowed to use any equipment. An Owner/Tenant must be in attendance. 2. The Shops are not to be used for commercial projects. 3. Owners/Tenants using the Shops do so at their own risk. The Condominium Corporation and the Board of Directors do not assume any responsibility, or liability, for accidents or injuries occurring in the Shops. NO CHILDREN under 18 years of age allowed. 4. No alcoholic beverages are to be stored or consumed in the Shops. 5. All flammable items marked with the Fire Hazard symbol must be locked in the fireproof cabinet. 6. All contaminated materials like rags, paper towels, etc., must be disposed of in the covered metal pail which is provided in the shop for that purpose. 7. The Shops door closest to the A elevator must be closed and locked at all times. 8. Metal cutting and/or grinding is not allowed in the Hobby Shop. Exception: the sharpening of hand tools. MOVING Pursuant to Article 5 Powers of the Corporation, of the Bylaws of Evergreen Condominium #0510913, the Board of Directors passed the following Rules and Regulations: 1. You must provide the Management Company or the moving coordinators a minimum of 4 day notice to the Designated Coordinator and complete a moving request form indicating your intended move in/out date. 2. You are permitted to park your moving vehicles in the Loading Zone in front of the building while you are moving in or out. You must park the moving truck so other vehicles can get past. Do not idle any vehicles in this zone! 3. Even if you are moving from one Suite to another, or purchasing and disposing of furniture or appliances, you must still register your move and arrange an inspection. 4. No moves may be made through the A Entry or the A Elevator. 5. Moving boxes are not to be thrown in the garbage bins. They must all be broken down, and removed to the City of Calgary recycling bins off site. 6. Before moving any household goods, in/out or within the condominium, a Security Deposit is required. PARKADE Pursuant to Article 61 Use and Occupancy Restrictions, of the Bylaws of Evergreen Condominium #0510913, the Board of Directors passed the following Rules and Regulations: 1. The speed limit in the Parkade is 15 km. 2. Vehicles must park between the lines. 3. Only private passenger motor vehicles can be parked in the parkade and are defined as car, minivan or light duty truck. 4. No propane vehicles or propane receptacles are allowed in the Parkade or storage areas. 5. Nothing is to be stored outside the storage unit (e.g., grocery carts, pet strollers, boxes, wood, etc. 6. Washing of vehicles is only permitted in the wash bay. Vehicle motors are not to be washed in the wash bay. 7. All Owners/Tenants are responsible to remove any liquids or grease that may drip from their vehicles on the Parkade floor. PET Pursuant to Article 61 a iii; Use and Occupancy Restrictions, of the Bylaws of Evergreen Condominium #0510913, the Board of Directors passed the following Rules and Regulations: 1. Every Owner/Tenant will be required to complete a "Pet Application" for their pet so the Condominium Corporation will have a complete record. 2. Failure to disclose a pet will be a breach of the Bylaw, and Sanctions will be applied. 3. A pet must be carried while on common property. 4. A pet shall not exceed a maximum weight of 20 lbs. POOL AND SPA Pursuant to Article 5 Powers of the Corporation, of the Bylaws of Evergreen Condominium #0510913, the Board of Directors passed and Alberta Public Health Act, Swimming Pool, Wading and Spray Park Regulation, Pool Standards, 2006 require the following Rules and Regulations: 1. The Alberta Public Health Act, Swimming Pool, Wading and Spray Park Regulation, Pool Standards, 2006 states Each bather must take a cleansing shower prior to entering the pool. This means everyone must shower head to toe before entering the pool or spa. 2. DO NOT SWIM ALONE There is no lifeguard on duty. Children up to 16 years and other guests must be accompanied by an Owner/Tenant at all times. 3. The Condominium Corporation is not responsible for any accident or injury to anyone using the facilities. 4. Persons with any infectious or communicable disease, or open wound are prohibited from using the pool or spa. 5. All children must be toilet trained; No diapers of any sort, including Swimmers. This includes adults requiring absorbent underwear. 6. Children s hours are between 2:00 PM to 8:00 PM. (16 years and under) 7. No food or drink (except water) allowed in the pool or spa area (lower deck). All containers must be plastic. 8. Absolutely no alcohol allowed. 9. No shoes allowed beyond the washrooms (except bath shoes/flip flops that were carried to the pool or spa area and put on before showering). 10. Pets are not allowed. 11. Spitting, spouting water, blowing the nose, or discharging bodily waste into the pool or spa is strictly prohibited. 12. Boisterous or rough play, running, jumping, or excessive noise is forbidden in the pool and spa areas, showers, or dressing rooms. 13. No outside water toys or floatation devices may be brought in to the pool or spa. 14. RENOVATION Pursuant to Article 3 f. Duties of Owner, Article 5 i. Powers of the Corporation, and Article 61 Use and Occupancy Restriction the Board of Directors passed the following Rules and Regulations. 1. A Request for Approval of Renovations is required for ANY and ALL renovations. To obtain permission, a letter and the completed form with detailed plans, specifications, and drawings of the work to be done must be received by the Board of Directors and Property Management Company 15 days prior to commencing work. 2. No changes may be made to flooring without prior approval of the Board, and any hard flooring installations must have acoustic underlay of sufficient quality to insulate the unit below from floor-traffic noise. 3. No hard flooring in bedrooms. 4. No changes may be made to the building exterior. 5. No preparatory work may be carried out on any common property without prior permission from the Board of Directors. 6. Owner is NOT to provide the contractors with a FOB for access. 7. Any damage to common property will be charged back to the Owner. 8. All construction must comply with all fire regulations. 9. Renovations must be carried out preferably on weekdays between the hours of 8:30 AM and 6:00 PM. 10. No materials are to be moved through the Amenities Building A Lobby. SECURITY Pursuant to Article 1 ii unit, Article 5 i & o, Powers of the Corporation, of the Bylaws of Evergreen Condominium #0510913, and the Condominium Property Act of Alberta, Section 9 (2&3), the Board of Directors passed the following Rules and Regulations: 1. For safety reasons, all unit entrance door locks require the approval of the board before they are changed and must be keyed to the Condominium Corporation Master Key. A board member will provide the Master Key when the locks are changed. 2. The Master Key will only be used with permission by a board member and one other person (another board member preferably) or when there is an emergency such as fire, or water escape. Therefore, there are instances when entrance to a suite will be made without proper notification. If a concern has been raised regarding the welfare of a resident, a check will be done by the Calgary Police Service or E.M.S. accompanied by a Board member. If anyone uses a master key from the Locked Key Cabinet, a notice will be left behind in the unit giving the time and reason for entry. 3. As the Sierras of Evergreen is a locked, secure condominium, entrance doors to the Sierras of Evergreen are not to be propped open unless there is someone present the entire time the door is propped open. UNIT RENTAL Pursuant to Article 50, Leasing of Units, of the Bylaws of Sierras of Evergreen Condominium #0510913, the Board of Directors passed the following: 1. The Condominium Corporation requires an Owner who leases the Owner s Residential Unit after October 1, 2014 to a new Tenant, to pay to and maintain with the Condominium Corporation, a deposit of $1000.00. The owner is responsible for any damages over and above the deposit. 2. The Owner of a Residential Unit shall give the corporation written notice of the name of the Tenant leasing the unit 20 days prior to the commencement of the tenancy, including Acknowledgement and Agreement by Tenants, (form provided in Forms section). 3. Within 20 days after ceasing to lease the Owner s Residential Unit, the Owner shall give the Condominium Corporation written notice that the Owner s Residential Unit is no longer leased. VIDEO SURVEILLANCE SYSTEM Pursuant to Article 5 Powers of the Corporation, of the Bylaws of Evergreen Condominium #0510913, the Board of Directors passed the following Rules and Regulations. The Freedom of Information and Protection Act requires that the Board advise Owners/Tenants of the following: 1. Two members of the Board have access to the computer and the video images stored on it. 2. Surveillance cameras are recorded 24 hours a day and are triggered by movement. 3. Video images will be shared with police as needed and will be stored for six months. 4. Unauthorized disclosure of video images will result in resignation of Board member. 5.
