INVITATION TO BID INSTRUCTIONS/TERMS AND CONDITIONS ITB 17-035 SALE OF 36 PASSENGER BUS MHMR Tarrant (MHMR) is soliciting bids for furnishing the merchandise, supplies, services and/or equipment set forth in this Invitation to Bid. THE ORIGINAL AND ONE (1) COPY OF COMPLETED BID MUST BE RECEIVED IN THE PURCHASING DEPARTMENT AT 3840 HULEN STREET, SUITE 205 FORT WORTH, TEXAS 76107 ON OR BEFORE 2:00 P.M. ON SEPTEMBER 6, 2017 All bids, including a NO BID, are due in the Purchasing Department by the due date, in sealed envelopes or boxes. All bids must be clearly marked with the ITB Number, date and time of opening on the outside of the envelope/box. Original bid must be clearly marked ORIGINAL and contain all original signatures. FACSIMILE TRANSMITTALS OR OFFERS COMMUNICATED BY TELEPHONE OR EMAIL WILL NOT BE ACCEPTED OR CONSIDERED. Any bid received after the date and hour set for bid opening will be returned unopened. If bids are sent by mail to the Purchasing Department, the bidder shall be responsible for actual delivery of the bid to the Purchasing Department before the advertised date and hour for opening of bid. ALL BIDS MUST BE SIGNED WHEN SUBMITTED. ALL BIDS MUST BE RECEIVED BY THE PURCHASING DEPARTMENT BEFORE DATE AND TIME STATED ABOVE. BIDS RECEIVED AFTER THIS TIME AND DATE WILL BE REJECTED AND RETURNED TO BIDDER UNOPENED. Bidder selects means of responding to Invitation for Bid and, as such, bears sole responsibility for receipt by the Purchasing Department of bid by above deadline. MHMR reserves the right to accept or reject all or any part of a bid or any and all bids, to waive minor technicalities, and to award the bid to best serve the interest of MHMR. No oral explanation in regard to the meaning of the bid specifications will be made and no oral instructions will be given before the award of the contract. SPECIAL TERMS & CONDITIONS SPECIFICATIONS MHMR Tarrant is seeking sealed bids for the sale of a 36 Passenger Bluebird bus (2006). Bidders/Buyers are invited and strongly urged to inspect the property to be sold prior to submitting a bid. Failure to inspect the property will not constitute grounds for withdrawal of a bid after opening, or for any claim against MHMR Tarrant. Any interested party will be allowed to inspect the property for sale at date and time listed below for the purpose of qualifying the condition and location of the bus. SITE VISIT: Viewing will be at 9:00 AM, Wednesday August 30, 2017 Bus is located at 5000 Resource Drive, Fort Worth, Texas 76119. Bidder may submit a bid to purchase item as shown on the Bid Sheet. General Terms and Conditions 1. CONDITION AND LOCATION OF PROPERTY PROPERTY LISTED IS OFFERED FOR SALE "AS IS" AND "WHERE IS". MHMR makes no warranties, expressed or implied as to the quality, quantity, kind, character, condition, weight, size or description of any of the property or its fitness for any particular purpose or use. It is the responsibility of the Bidder to fully understand the condition of the property and take into consideration how the property is to be removed from its storage location. CONSIDERATION OF BIDS: MHMR reserves the right to reject any or all bids, to waive any informality in the bids and to accept the bid that is in the best interest of MHMR. 2. DEFAULT If Buyer fails to make full payment by the payment date, fails to remove all property by the specified date or if Buyer fails to comply with any other terms and conditions, the Buyer shall be considered in default and is subject to all rights and remedies available to MHMR under this agreement and under the law. The property that is the subject of a defaulted bid may be disposed of by sale to the next highest bidder, or it may be withdrawn from all consideration. 3. TITLE Title to the property shall transfer to the Buyer only upon receipt of full and final payment by MHMR Tarrant. REGARDING PAPERWORK All paperwork will be available for you when you go to pick up the property awarded pursuant to the bid. Title(s) will be transferred to the successful bidder's name ONLY. 4. PAYMENT Prior to taking possession of the property, Buyer shall make payment based upon its bid, in full, in the form of a cashier's check. Personal checks will not be accepted. 5. REMOVAL OF PROPERTY a. The Seller DOES NOT provide transportation or loading services for buyers to remove their merchandise. Any and all methods of lifting, towing, and hauling, as well as all other methods or requirements for the removal and transport of the materials, equipment and/or vehicles, is the sole responsibility of the buyer. The ownership of any and all items not removed by the final day of removal will revert back to MHMR and MHMR may resell or dispose of the property as they see fit. b. Buyer shall reimburse MHMR for any damage to MHMR s property caused by the removal of the purchased property. Any injury, damage or loss incurred during the removal of property portion of the transaction is solely the physical and financial liability of the Buyer. Property must be removed within ten (10) days of award. 8. RISK OF LOSS: After notification of award and prior to transfer of title, MHMR shall only be responsible for exercising reasonable care for the protection of the property. If property is lost, damaged or otherwise destroyed MHMR is not responsible for providing another property or make repairs. Under these circumstances, MHMR has a sole discretion in rescinding the award. After transfer of title; all risk of loss, damage or destruction to the property from any cause, or injury or death caused by the property, are the Buyer's responsibility. 9.
