POLICY ON ACCEPTABLE USE OF INSETA NAME, TRADEMARKS AND LOGOS BY STAKEHOLDERS 1

1 Purpose This policy has been developed to inform authorised users of acceptable usage of the name INSETA and its trademarks and to prohibit unauthorised usage thereof. The word INSETA is the trade name of the Insurance Sector Training Authority and together with all the logos set out in annexure A attached hereto is part of INSETA corporate image. This policy document, read together with annexure A sets forth the policy regarding the usage of the INSETA name, trademarks and logos. 2 About INSETA name, Trademarks and Logos The INSETA name, trademarks and logos set out in annexure A have been lodged with the Registrar of Patents and Trademarks for registration in South Africa. Any stakeholder granted authorisation to use the INSETA name, trademarks or logos is responsible for the correct usage thereof. Should there be a violation of this policy; the individual organisation that committed the violation will be held liable. 3 Specifications The specifications for the use of the INSETA name, trademarks and logos are contained in Annexure A to this policy. 4 Authorised usage of INSETA name, trademarks and logos The use of INSETA accreditation logo is supported as part of the campaign to encourage learners to enrol with Skills Development Providers who are accredited by INSETA. INSETA general practice with regard to requests for the use of the INSETA name, trademarks and logos is that in bona fide cases of accreditation, permission for the usage thereof may be granted in writing by the INSETA CEO. 4.1 The Accreditation logo The accreditation logo is supplied on written request, to INSETA-accredited Skills Development Providers. The logo may be used to display the accreditation status of the Skills Development Provider with INSETA. The logo may be used to display the accreditation status of the provider only for learning programmes relating to its scope with INSETA. The accreditation logo is supplied on written request, to INSETA-accredited Skills Development Providers. 4.2 The Assessor and Moderator registration logos The registration logo is supplied to INSETA-registered assessors and moderators upon written request from INSETA ETQA. The logos may be used by INSETA s constituent assessors and moderators to display their status only in respect of their approved scope of unit standards and/ or qualifications with INSETA. 4.3 All other requests for the usage of the INSETA name, trademarks and logos All other requests for the usage of the INSETA name, trademarks and logos must submitted by the stakeholder in writing to INSETA and approved by the INSETA CEO in writing. The written application must be fully motivated and contain copies of each item which will be used to bear the INSETA name, trademark or logo. Any artwork generated must be approved and signed off in writing by the INSETA CEO as part of the application process. Any approval granted by the will be restricted to the items approved in the application. 3

5 Unauthorised usages of INSETA name, trademarks and logos Unauthorised use of INSETA name, trademarks or logos is defined as follows: 5.1 Any use of INSETA name, trademarks or logos in the absence of the written authority as set out in clause 4 of this policy; 5.2 Any incorrect usage of INSETA name, trademarks or logos, which conflicts with the written authority issued, or breach of the conditions of use and/ or specifications; 5.3 Any use of the INSETA name, trademark or logos under circumstances where the right to such usage has been revoked or acknowledged in writing by INSETA. 6 Revocation of the rights to use INSETA name, trademarks and logos The INSETA reserves the right to withhold or withdraw the rights to the use of its name, trademarks or logos in the event of any one of the following events taking place: 6.1 Outstanding conditions of accreditation/ Assessor and Moderator registration In the event a Skills Development Provider, assessor or moderator has outstanding conditions attaching to their accreditation or registration award, permission to use the INSETA name, trademarks or logos will be revoked. Permission will be granted again only once all conditions have been satisfactorily fulfilled. 6.2 Breach of INSETA policies or conditions of use 6.2.1 INSETA may in writing withdraw a Skills Development Provider s right to use the INSETA name, trademarks and logos if it believes, based on evidence, that there has been a transgression of the INSETA accreditation policy or any of the related procedures; or if the Skills Development Provider engages in any activity that may bring INSETA into disrepute. 6.2.2 INSETA may withdraw an assessor or moderators rights to use the INSETA name trademarks and logos if it believes, based on evidence, that there has been a transgression of the applicable Code of Conduct, assessment and moderation policies, or if the assessor or moderator engages in any activity that may bring the INSETA into disrepute. 6.2.3 INSETA shall send out a notice of withdrawal of the right to usage of the INSETA name, trademarks and logos to the person or institution as registered with INSETA, advising the relevant person or institution of the decision. 6.3 Revocation of any rights to use the Inseta name, trademarks and logos granted prior to the commencement of this policy INSETA reserves the right to revoke any permission granted to any stakeholder prior to the commencement of this policy to use the INSETA name, trademark or logos if such approval was not in line with the spirit of this policy. The stakeholder can then reapply for permission in terms of the procedure set out in section 4. 7 Legal Remedies The INSETA name, trademark or logos are the legal property of INSETA. INSETA reserves the right to institute civil or criminal action against any person, organisation or entity found to be using the INSETA name, trademarks or logos in violation of this policy. 4

Where the Skills Development Provider who has been given written permission by INSETA would like to reconstruct the INSETA name, trademarks and logos, reference must be made to the INSETA Corporate Identity Manual (available on the INSETA website). All specifications in the manual regarding the reconstruction of the INSETA name, trademarks and logos must be strictly adhered to. Please ensure that these colours are never altered.
