If ownership has recently changed and the property ownership is not the same as shown on the assessor s records, a copy of the grant bargain/sale or quitclaim deed must be submitted. 4. Required if located within the public utility tariff area for water and/or sewer service. 5. If the proposed development is commercial or industrial and not served by the public utility tariff area for water and/or sewer, then the applicant must attach proper verification demonstrating commercial water rights have been applied for and an engineered commercial septic system has been installed. NCC 12.08.010: Permit Required 8. Dust Control Plan required per NCC 15.28.090: Construction Activities Procedures and Standards for Zoning Review Applications: A. A Zoning Review Application must be submitted to the Planning Department prior to the construction of any building, including the placement of a manufactured home; and any construction that involves modifications or expansion of an existing building; or prior to establishing any other land use which may not require a building permit. B. A Zoning Review Application approval is valid for 180 days from the date of approval, and will expire if not commenced for the proposed use or plan of development for which the Zoning Review was obtained. The Zoning Administrator may extend a Zoning Review Application for good cause. Upon the issuance of a building permit or approval to construct from other federal, state or county agencies the Zoning Review must track along the same expiration timeframes and policies as the building permit or other approval. C. If the property is a corner lot and the proposed plan of development would change the property s current assigned address (addresses are based on the building s street frontage), a separate application to change the address must be approved by the Nye County Planning Department. D. The Nye County Planning Department may have approved your Zoning Review application; however, you must refer to any restrictive covenants (CCR s, Declaration, etc.) of record that may prohibit the proposed use on this lot or which may require adherence to stricter development standards. The Nye County Planning Department does not provide legal or business advice. Any approval issued by the Planning Department is related only to the land use and the proposed development as described on the approved application. You must comply with any and all Federal, State, County or Town regulations that may pertain to your business. There are additional requirements for liquor licensing, fireworks, brothels, gaming, etc. E. A Zoning Review Approval by Nye County Planning Department does not correlate to an approval by any organized Homeowner s Association/Architectural Review Committee. Anyone developing within an area that may be governed by any such organized Homeowner s Association/Architectural Review Committee should contact that organization. F. The Nye County Planning Department may have approved your Zoning Review application; however if you are in the tariff area of a utility company and applying for an Individual Sewer Disposal System (ISDS) on this application, you must contact the utility company and comply with Nevada Administrative Code (NAC) 444.786 regarding the installation of that ISDS before the actual installation of that ISDS. G. The operation of an ISDS on the property must be discontinued within 90 days after receipt of notice from either Nye County or UICN that sewer service is immediately available to serve the property. Such notice must be sent via U.S. mail to the owner of record. Sewer service must be deemed to be immediately available to the property when the sewer system is within 400 feet of the nearest property line (NAC 444.786) and such facilities can be accessed by a gravity flow line.
