IN THIS RESOLUTION THE FOLLOWING DEFINITIONS SHALL APPLY: CONDEMNATION SUIT: Cause No. cc-10-02807-a, in County Court at Law No. 1, and styled City of Dallas v. Bank of America, N.A. as Trustee, et al, filed pursuant to City Council Resolution No. 09-1618. PROPERTY: Approximately 28.52 acres of land situated in City Block in the City of Dallas, Dallas County, Texas, as described in said condemnation suit. PROJECT: Elm Fork Athletic Complex project OFFICIAL OFFER: $2,150,000.00 AWARD: $2,400,000.00 DESIGNATED FUNDS: $608,791 payable out of Trinity River Corridor Project Funding: 1998 Bond Funds, Fund No. 6P14, Department PBW, Unit N964, Activity TRPP, Program No. PB98N964, Object 4210, Encumbrance No. PBW98N964H1; and $1,041 209 payable out of 2006 Bond Funds: Fund No. 8T00, Department PKR, Unit T074, Activity PKLA, Program No. PKO3KOO5, Object 4210, Encumbrance No. PKR09019103; and $250,000 payable out of 2003 Bond Funds: $6,067.21 Fund 4R00, $159.102.73 Fund 5R00 and $84,830.06 Fund 6R00 each from Department PKR, Unit K005, Activity RGPK, Program PK03K005, Object 4210, Encumbrance No. PKRO9O1 9103; and $500,000 payable out of Texas Parks and Wildlife Grant Funds: Fund No. S130, Department PKR, Unit P504, Activity PKLA, Program No. PK03K005, Object 4210, Encumbrance No. PKR09019105 WHEREAS, the official offer having been made and refused, the City Attorney instituted a condemnation suit for the acquisition of the Property for the Project; and WHEREAS, the Special Commissioners in Condemnation appointed by the Court in the Condemnation Suit made an award which the City Council wishes to deposit with the County Clerk of Dallas County, Texas, so that the City may take possession of the Property; and
COUNCIL CHAMBERS!03078 December 8. 2010 WHEREAS, the City Council desires to authorize the City Attorney to settle the Condemnation Suit for an amount not to exceed the special commissioners Award; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DALLAS: SECTION 1. That the City Controller is hereby authorized and directed to issue a check, paid out of and charged to the Designated Funds, in the amount of the Award payable to the County Clerk of Dallas County, Texas, to be deposited by the City Attorney with said County Clerk. SECTION 2. That the City Attorney is authorized to settle said Condemnation Suit for an amount not to exceed the special commissioners Award. SECTION 3. That this Resolution shall take effect immediately from and after its passage in accordance with the provisions of the Charter of the City of Dallas, and it is accordingly so resolved.
