Zoning History: n ay 22, 2002 the Board of upervisors, upon a favorable recommendation by the Planning ommission, approved rezoning (ase 020186) of the request property to esidential (-12) and eighborhood Business (-2), plus proffered conditions on an existing -2 tract and relief to street access requirements for more than fifty (50) lots. onditions of approval limit density (maximum 217 lots) and access; establish minimum architectural standards for dwellings; and require certain road improvements and dedication of a pedestrian trail easement. urrent equest: In residential districts, a model home (sales office) is permitted provided that, in addition to its permanent use as a dwelling, such home may be used as a temporary real estate office. In this case, the temporary sales office is being operated in a travel trailer parked on the property without the requisite zoning approval. ince the travel trailer is not a dwelling, sales is not permitted. his request seeks to permit the temporary sales within the travel trailer for four (4) months. (Proffered ondition 1) he Zoning rdinance further permits model homes (sales offices) in residential districts provided that the offices only market property within the development where they are located; the offices are incidental to construction activity taking place within the development; the offices are not the primary real estate office for the company marketing the development; and the offices are not used as construction offices or for storage of construction equipment and/or materials. Proffered conditions are offered to ensure these restrictions are met in this case. (Proffered onditions 2, 3 and 4) In a few cases, modular office trailers (not travel trailers) have been approved for use as model homes (sales offices) on a temporary basis. hese approvals have been granted for a set time period to ensure the use is temporary. modular office unit is similar to temporary office trailers/units that are permitted as a restricted use in residential districts by the ordinance when they are incidental to construction activities taking place on the property. travel trailer is designed to be used for temporary occupancy for travel, recreational or vacation use, not as a temporary office. he ordinance permits parking of travel trailers for use/occupancy with conditional use approval in eneral ommercial (-5) istricts and moderate and heavy industrial areas. hese more intense uses are not considered compatible with existing and future residential development. I ppropriate alternatives exist within the ordinance to provide for a model home (sales office) for this development. he use of a travel trailer for a sales office is incompatible with surrounding residential use and could set a precedent for similar requests. iven these considerations, denial of this request is recommended. 4 120206-15-P-P
