MURFREESBORO PLANNING COMMISSION STAFF COMMENTS, PAGE 1 APRIL 4, 2012 3.a. PRD Amendment [2012-405] for approximately 22.6 acres along Florence Rd. known as Seward Crossing (f.k.a. Filmore West), Ole South Properties Inc. applicant. The subject property is located along the west side of Florence Rd. and consists of the Seward Crossing Subdivision and the undeveloped land that was part of this original development tract approved for zoning in 2005 under the name of Filmore West PRD. The name of the development was subsequently changed to Seward Crossing although the zoning approval has remained the same. Not long after approval of the zoning plans for the first section of the development were submitted and ultimately approved for construction and construction soon progressed. This subdivision was among the casualties of the economic recession that has been experienced during the last several years and the original developer is no longer involved. The applicant has purchased lots 6 thru 14, 17 thru 23, 26 thru 28 and 33 thru 37 for a total of 24 lots from the bank that found itself as owner of the property. Due to the shallowness of the lots, the applicant is finding it difficult to find acceptable building plans that will meet the requirement for a 35 foot setback for the garage door and has made application to amend the PRD zoning to allow instead a 25 foot setback for the garage door which is the same as the rest of the structure. The applicant also desires to be able to use cementitious siding on the fronts of buildings and count it the same as other masonry. The applicant has provided revised exhibits for the program book as would apply to the development. The application is an amendment to the standards and will not affect the number of lots, their size, street patterns or any other requirement of the PRD approval. The original application filed by Ole South Properties was for only the lots that the applicant has purchased. During its meeting on March 21 after discussing the matter, the Planning Commission determined to include the remainder of the subdivision and tract in the application for the public hearing. There are already seven houses either completed or under construction within the development that have been constructed or approved for construction under the current standard. There remain potential for 61 lots in the undeveloped portion of the development and it is unknown when these lots may be developed. Most of these lots will have the same depth issue that is prompting this application. In order to effectively study the matter the entire development tract is being included. The Planning Commission may determine to recommend approval for some, all, or none of the area. The Planning Commission will need to conduct a public hearing on the matter after which is will need to formulate a recommendation for the City Council. 2
