Page 1 of 6 Minutes of the Planning Board of the Township Of Hanover July 10, 2018 Chairman Eugene Pinadella called the Work Session Meeting to order at 7:00 PM in Conference Room A and The Open Public Meetings Act Statement was read into the record. Board Secretary, Kimberly Bongiorno took the Roll Call. In attendance were Members: Absent were Members: Also present were: Byrne (Arrived at 7:05), Critchley, Deehan, De Nigris, Dobson, Ferramosca,, Nardone, Olsen, and N/A Township Engineer Gerardo Maceira and Township Planner Blais Brancheau I. RESOLUTIONS 1) CASE NO. 18-1-1 APPLICANT/OWNER: OSTER HANOVER PROPERTIES, LLC LOCATION: 201 RIDGEDALE AVE. CEDAR KNOLLS BLOCK: 1801 LOT: 4 ZONE: I-5 Applicant sought preliminary and final site plan and C variance approval in order to construct a one-story, approximately 9,000 sq. ft. Kiddie Academy child care center. Parking is proposed in the front and side yards of the property. An approximately 5,060 sq. ft. playground area is proposed in the rear yard. Other improvements include landscaping, fencing, and sidewalks. Building mounted signage and a freestanding monument sign are also proposed. Application approved with conditions June 26, 2018. A motion to memorialize the resolution was moved by Member De Nigris and seconded by. Members Critchley, Dobson, Olsen, De Nigris, Ferramosca,, and Chairman Pinadella all voted in favor of memorializing the resolution. II. Page 2 of 6 A motion to approve the June 12, 2018 minutes was moved by Member Nardone and seconded by Member Critchley. All members present voted in favor of approving. III. DRAFT ORDINANCE RE: SIGN REGULATIONS OFFICE AND INDUSTRIAL ZONE DISTRICTS: BLAIS BRANCHEAU - Properties with less than 100,000 sq. ft. of gross floor area will be permitted one sign for each lot. - Properties with at least 100,000 sq. ft. of gross floor area will be permitted two wall signs for each wall facing a public street, on up to two walls, maximum four wall signs total, plus one wall sign indicating the street address of the property. - One free standing sign for each driveway providing access to a public street, but not more than two freestanding signs, shall be permitted. Such signs are not required to be located at the driveway entrance. - For properties with at least 100,000 sq. ft. the content of principal signs located on properties used for more than one business establishment shall be limited to information identifying the name of the overall development on the property, the name of up to two businesses, and/or the nature, logo, trademark or other identifying symbol of said development or business, and/or the street address of the property. The name of individual businesses shall not be permitted on such signs. - For building mounted principal identification signs, the vertical dimension shall not exceed three feet. A motion to send the sign regulations for office and industrial zone districts to the Township Committee was moved by Member Ferramosca and seconded by Member Critchley. Members Nardone, Deehan, Critchley, Dobson, Byrne, De Nigris, Ferramosca,, and all voted in favor of sending to the Township Committee. IV. DRAFT ORDINANCE RE: NEW BUSINESS OPENING SIGNS BLAIS BRANCHEAU - Discussed situations and time frames signs would be allowed. - None of the signs can be illuminated. - Can be displayed for 30 days after you get your permit, can only be for 60 days after they open, no longer. The Board questioned grand re-openings, new management, and new ownership signs. Mr. Nardone - Suggests a packet in CO applications explaining temporary sign regulations.

Page 3 of 6 - Described the sticker program for the enforcement of temporary signs. - Stickers have dates on them that make it easy to look at and determine if the signs are still allowed. The Board does not want temporary signs to be allowed to be lit. Mr. Nardone - There needs to be some type of enforcement of all of these rules. The Board discussed possibly ways of enforcement. The Board wants to work with Sean Donlon to come up with an enforcement policy for temporary signs. - Can do a separate ordinance on enforcement for all temporary signs. - Would like to talk to Mr. Donlon regarding enforcement. The Board decided to table this motion and ordinance until it is rewritten and they will review it again at the next work session. V. DRAFT ORDINANCE RE:RESIDENTIAL RECREATIONAL FACILITIES BLAIS BRANCHEAU - Based on comments from the last meeting this basically follows the same types of guidelines as pools. - Treehouses and children s play equipment that is less than 200 sq. ft. have been excluded from this ordinance. The Board wants to clarify with the police if bow hunting, paintball guns, and the like are allowed within the Township. - Is concerned with large pools and recreational facilities in side yards. - If it fits in the rear yard it should not be permitted in the side yard. - If it is in the side yard then screening/landscaping should be required to be provided.

Page 4 of 6 - Feels there should be screening required from the street. - Feels that screening is just being a good neighbor. The Board had a discussion on landscaping for pools in the side yard and ultimately decided that they do not want landscaping to be a requirement. - Will talk to the Police Department about projectiles and if it is not covered it will be added to this ordinance. - Basketball hoops are permitted in the front yard. - Discussed setbacks for basketball backboards. - Recreational facilities on residential property cannot be illuminated past 10pm. The Board discussed that no more than a third of your side or rear yard can be covered by outdoor recreational facilities. The Board decided to table this discussion until next meeting. VI. DRAFT ORDINANCE RE:YARD DEFINITIONS AND INTERPRETATION BLAIS BRANCHEAU - Discussed through lots. - This deals with odd shaped lots and unusual lot configuration. - Explained to the Board the current and suggested yard definitions. - Showed the Board on a map some of the areas in town with through lots. - If there is a neighborhood pattern then the zoning officer could call them rear lots. A motion to send the yard definitions and interpretations to the Township Committee was moved by Member Nardone and seconded by Member Byrne. Members Nardone, Deehan, Critchley, Dobson, Byrne, De Nigris, Ferramosca,, and all voted in favor of sending the ordinance to the Township Committee. VII. OTHER BUSINESS - Wanted to know if the amendment for lights on the parking deck ordinance was ever done. - If not he would like to write one up.

Page 5 of 6 - The Historic Preservation Plan is currently on hold because most of it is on the Corporate Mailings Property and they are still in court trying to get a higher density on the site. The Board wants this taken off of Blais s plate; direction on this matter needs to go to the governing body. - River Park is still stuck in legal. - The Red Bulls had been in touch with the owners of River Park and they are backing off because the owners want 80 Million and it was only on the books for 13 Million. - Asked what was happening with the housing obligation. - It is in court and we are asking for the court to say that we have met our housing obligation. - The court is undecided on what our obligation is. - Where it stands today is the judge would like to see the municipalities settle with the interested parties. - The judge would like this done before he retires next year. - The Court Master is supposedly giving guidance. - The Township has sent a letter to the County that they need to look at the infrastructure impacts upon the overall town and surrounding areas, the land may be there to accommodate housing but infrastructure is not. - The Court Master is currently looking at 13 units per acre. - The Court Master is not taking into account where these properties are and the existing conditions on the areas of land. Mr. Ferramosca - Whippany Village ownership is transitioning to a new group. - They want someone to come in and talk about implementing the plan.

Page 6 of 6 - Met with the fire company for Whippany Fire House. - The Starbucks people who are talking to them right now are having issues with the environmental issues on the site. - There are old oil tanks under the current fire house. - They are looking to get $150,000 off of the price due to the tanks under the fire house. - We are waiting on the drive through use ordinance until we see what happens with Starbucks. - Starbucks needs planned unit development in order to meet the parking requirement. - Explained to the Board that the Lidl project is not necessarily dead yet. - Is looking at Route 10 lots to see if any can be classified as area in need of redevelopment. The Board had an open discussion regarding the area around the Whippany Post Office and Billy s Red Room site. A motion to adjourn was moved by Member Ferramosca and seconded by Member Nardone.
