In residential zoning districts, a minor use permit, including design review, is required in order to ensure that the container is designed to be compatible with and complement existing dwellings on the same or adjacent parcels. Short Term Shelter Non-profit organizations Modify to read: A Short Term Shelter for the temporary housing of homeless and lowincome persons at churches may be authorized by the Zoning Administrator in any zoning district. The Short Term Shelter may be used for up to 30 consecutive or nonconsecutive days in any given year. The maximum occupancy shall be 125 persons at any given time and occupancy shall comply with the Fire Code. Services shall only be offered between the hours of 3:00 p.m. and 9:00 a.m. A Temporary Use Permit may be issued by the Zoning Administrator for any proposal to exceed these criteria. 1.9.4.A. Modification of Nonconforming Structures Add Modification to Repair and Maintenance of Non-Conforming Structures. (This change clarifies that modifications can be made to non-conforming structures that would not typically be considered repair or maintenance.) 3

Room Rental and Vacation Rental, Single-Family Dwelling In residential and mixed use zoning districts, the rental of rooms in any single-family dwelling involving multiple rental agreements in the same residence is permitted for up to two (2) rooms individuals. If more than two (2) individuals rent rooms are rented within the single-family dwelling, a Room Rental Permit by the Director is required. A maximum of five (5) rooms individuals may qualify to rent rooms within any single-family dwelling in the residential and mixed use zoning districts, subject to a Room Rental Permit pursuant to the findings in Section 6.5.6. 5.9.3.C.1.a Yard Parking Add: Yard parking requirements shall be subject to those standards approved by Ordinance SZC-2013-0012 on October 22, 2013. 5.10.1.J.2.c Banner/Feather Flags Add: 5.10.1.N.8.b Lighting standard for Digital Billboards Fight the Light ECOS c. Signs known as feather flags or banner flags are prohibited. Amend 5.10.1.N.8 as follows: b. Illumination. Digital billboards may be internally or externally lit; the light cast through reflection or glare onto surrounding objects, or illuminance, is measured in footcandles. Signs shall not be illuminated at more than 0.3 foot candles above ambient light, as measured using a foot candle meter at a distance of 250 feet from the sign face. Each display must have a light sensing device that will adjust the illuminance of the sign as ambient light conditions change. c. Luminance. Through LED technology, digital billboards directly emit light, or luminance, the intensity of which is measured in nits. Luminance levels shall not exceed 7,500 nits during daylight hours and 300 nits at night. Each display must have a light sensing device that will adjust the luminance of the sign from dawn to dusk. 5.10.1.N.8.c 5.10.1.N.2 Separation of Digital Signs. 5.10.8.H.9 6.1.3.A signage Sign District and Master Sign Program Community wide interest for CPAC appeal Jim Wiley Add subsection 9: Signs approved as part of a Master Sign Program pursuant to 5.10.1.R may be exempt from these provisions. Add the following definition of community-wide interest as a finding for a CPAC appeal: Community-wide interest means that the project could potentially adversely affect properties beyond the immediate neighborhood (properties within 500 feet), in terms of traffic, noise, aesthetics, drainage, or other impacts. In addition, the project would set a precedent for a use of land that has policy implications for the larger community. 6.4.2 Minor Use Permits County Counsel Add Section 6.4.1.B.3 to read: 3. Noticing requirements for minor use permits shall follow the procedures outlined in the User Guide. 6
User Guide Section Four, Step 9. 6.4.6.D.1 Title IV Special Development Permits Use of term obsolete in Title IV Nick Avdis Amend Table 4-2 to show F (Notice of filed application is required) and A (Notice is required if the Director grants approval.) for Minor Use Permit. Add subsection g. Noticing Requirements for Minor Use Permits. Public notice of the consideration of a proposed minor conditional use permit in all zones shall be provided by the Zoning Administrator by mailing such notice to the property owners within three hundred feet of the exterior boundaries of the property under consideration. The public notice shall: a) Be sent no later than 14 days after acceptance of a complete application; b) Invite interested persons to notify in writing the and Environmental Review Division of any concerns, comments or to make a request to be further notified of actions relating to the proposed minor use permit during a fifteen-day comment and review period commencing with the date of the notice; c) Specify that only those specifically requesting to be further notified of actions relating to the application will be so notified of decisions or appeals; d) Specify that at the end of the fifteen day comment and review period, the Zoning Administrator's final decision will be issued, e) Specify that after the issuance of the Zoning Administrator decision, there is a ten-day appeal period. Modify language as follows: The appropriate authority may issue a Special Development Permit to allow deviations from any development standard in this Title. Use of the word obsolete to describe the AC, TC, SC zones in Title IV may have a negative connotation. Change the description to Zone Categories No Longer in Use 7
