STATEMENT OF ISSUE The Lake Placid Caladium Festival Association, Inc. is requesting that the Board waive its Landfill tipping fees for waste collected during the Annual Caladium Festival and Annual Car Show. The festival is scheduled for July 27, 28 and 29, 2018. The Board minutes indicate that the Lake Placid Caladium Festival Association, Inc. s request has been approved for the past sixteen (16) years. RECOMMENDED ACTION Move to approve waiving the Landfill tipping fees for the Annual Caladium Festival and Annual Car Show scheduled for July 27, 28 and 29, 2018. HIGHLANDS COUNTY COUNTY COMMISSION AGENDA ITEM DATE OF ACTION REQUEST: June 19, 2018 PRESENTER: SUBJECT/TITLE: Tasha Morgan, Assistant County Administrator Request approval to move forward with the sale of two (2) County owned surplus properties and provide the Chair the authority to execute the Sale and Purchase Agreements at the time of closing. STATEMENT OF ISSUE In 2018 the Board approved the sale of various County owned properties. Staff initiated a sale of certain properties initiated through the County's competitive bid process, in accordance with Florida Statutes 125.35. The County received and opened bids on those properties on May 29, 2018 and is recommending the sale of the following two (2) properties: * C-36-36-29-A00-0030-0000 / 201 Lake June Dr (TD001589) - Offer to Purchase $4,730.00 * C-04-34-28-050-0630-0060 / 4000 Mendoza Ave (TD000175) - Offer to Purchase $5,611.00 In accordance with Ordinance 16-17-08 the Notice of Intent to Accept Offer was posted on May 29, 2018. CSC Minutes 5.16.18 Agenda Item 5: Committee Reports Recap Committees need to meet over the summer so that progress continues and picks up when the Council reconvenes in August. Contact Luzed Cruz when planning a committee meeting so it can be publicly noticed, and guidance can be provided on communications with other voting board members. Community Needs & Data Aisha Alayande Report Card will be updated to better reflect our community and will include a three-year tracking tool. Committee is not currently planning to meet over the summer, but progress will continue. Partner Program Review & Support April Rolle Distribute a survey regarding Aunt Bertha to all Council members. The survey will be disbursed today by Luzed Cruz to all members. Surveys need to be completed by the end of May. New Initiatives & Service Gaps Carly Wohl Committee structure to be based around the BOCC fiscal year to provide for a process for formal funding requests to the BOCC when needed. Committee will determine if project requests are needed, if a gap in service exists, is an agency currently addressing the need, how to best fill the gap. Discussion followed regarding our community s approach to addressing the needs of children affected by adverse childhood experiences (ACE S). STATEMENT OF ISSUE Grant funds are awarded to Advocacy Centers Statewide by the Florida Network of Children s Advocacy Centers (FNCAC). The amount is determined annually based upon the number of children serviced at the Children s Advocacy Center in Highlands County. The funds are disbursed to the FNCAC by the Florida Department of Children and Families to be used by the Children s Advocacy Center s for services provided to children. The Children s Advocacy Center has received notification that they will receive $1,062.43 as their allotment from the Child Advocacy Trust Fund Award and action is needed to receive the revenue into the Children Advocacy Center s current year s budget. Funds will be used for Direct services to victims of child abuse or their family members in Highlands County. Example: Mental Health Services. Funds must be spent before June 30, 2019. RECOMMENDED ACTION Move to accept a grant from the Florida Network of Children s Advocacy Centers for Direct Service Provision and authorize the Board Chairman, Community Programs Director, and Children s Advocacy Center Manager to sign the contract agreement for the period of July 1, 2018 through June 30, 2019. Child Advocacy Trust Fund Award Agreement Agreement made the date set forth below, between the Florida Network of Children s Advocacy Centers, Inc., a not-for-profit corporation qualified to do business in Florida (hereinafter referred to as the FNCAC ), and Highlands County, a political subdivision of the State of Florida (hereinafter referred to as the COUNTY ): Recitals WHEREAS, the FNCAC has entered into a contract effective July 1, 2018 (hereinafter referred to as the Contract) with the Florida Department of Children and Families (hereinafter referred to as DCF ) providing for the disbursement of funds from the Grants and Donations Trust Fund to the FNCA; and WHEREAS, a portion of the funds disbursed to the FNCAC by the Department of Children and Families under the Contract are to be used to fund services by Children s Advocacy Center s for services provided to children and non-offending caregivers; THEREFORE, the FNCAC and the COUNTY, in consideration of the mutual promises contained in this Agreement, agree as follows: Section 1. Term of Agreement. The term of this Agreement shall be for one year, commencing on July 1, 2018 and shall continue until all of the obligations set forth in this Agreement have been completed. Section 2. Date of Award. The date of the award from the FNCAC to the COUNTY shall be the date written below. Section 3. Amount of Award. The amount of the funds awarded the COUNTY under this Agreement from the FNCAC shall be one thousand sixty dollars and forty-three cents ($1,062.43). Any funds awarded the COUNTY that are not utilized by June 30, 2018 shall be refunded to the FNCAC. Section 4. Services Funded by Award. The COUNTY agrees to use the funds awarded under this Agreement to fund only direct services to victims of child abuse or their non-offending family members. The COUNTY further agrees that the funds awarded under this Agreement will add to and/or enhance, but not duplicate, services provided by state agencies. The list of direct services that this award will fund is attached to this Agreement as Exhibit B, which is incorporated herein by reference. Services may only be funded subsequent to the date of the award. Section 5. Compliance with Statutory Requirements. By signing this Agreement, the COUNTY affirms that it complies with all of the standards set forth in Section 39.3035(1), Florida Statutes, and the screening requirements set forth in Section 39.3035(2), Florida Statutes. If, during the term of this Agreement, the COUNTY fails to comply with the standards or screening 1

requirements set forth in subsections (1) and (2) of Section 39.3035, Florida Statutes, the COUNTY shall immediately notify the FNCAC. Failure to comply with those standards and screening requirement shall require the COUNTY to refund all unused funds awarded under this Agreement to the FNCAC. Section 6. Duty of COUNTY to Collect and Submit Data. As long as this Agreement remains in effect, the COUNTY shall collect and submit to the FNCAC no later than the fifth (5 th ) day of each month a Monthly Activity Report setting forth the number of augmented and unduplicated units of service delivered under this Agreement. The Service Details must accompany the Monthly Activity Report. All Monthly Reports shall be submitted via TrackIt. Section 7. Budget. Upon the execution of this Agreement, the COUNTY shall submit to the FNCAC, on the form attached to this Agreement as Exhibit A, which is incorporated herein by reference, a budget and a narrative describing how the funds awarded under this Agreement will be used during the fiscal year. Section 8. Civil Rights Requirements. In accordance with Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act of 1990, or the Florida Civil Rights Act of 1992, as applicable, the COUNTY shall not discriminate against any employee (or applicant for employment) in the performance of this Agreement because of race, color, religion, sex, national origin, disability, age, or marital status. Further, the COUNTY agrees not to discriminate against any applicant, client, or employee in service delivery or benefits in connection with any of its programs and activities in accordance with 45 CFR, Parts 80, 83, 84, 90, and 91, Title VI of the Civil Rights Act of 1964, or the Florida Civil Rights Act of 1992, as applicable and CFOP 60-16. These requirements shall apply to all contractors, subcontractors, subgrantees or others with whom it arranges to provide services or benefits to clients or employees in connection with its programs and activities. The County, if employing fifteen or more employees, shall complete the Civil Rights Compliance Checklist, CF Form 946 within thirty (30) days of execution of this Agreement and annually thereafter in accordance with CFOP 60-16 and 45 CFR, Part 80. Section 9. Emergency Preparedness Plan. If the tasks to be performed pursuant to this Agreement include the physical care or supervision of clients, the COUNTY shall, within thirty (30) days of the execution of this Agreement, submit to the FNCAC an emergency preparedness plan which shall include provisions for records protection, alternative accommodations for clients in substitute care, supplies, and a recovery plan that will allow the COUNTY to continue functioning in compliance with the executed Agreement in the event of an actual emergency. For the purpose of disaster planning, the term supervision includes a child who is under the jurisdiction of a dependency court. Children may remain in their homes, be placed in a nonlicensed relative/non-relative home or be placed in a licensed foster care setting. No later than twelve (12) months following the DCF s original acceptance of a plan and every twelve (12) months thereafter, the COUNTY shall submit a written certification that it has reviewed its plan, along with any modifications to the plan, or a statement that no modifications were found necessary. The DCF agrees to respond in writing within thirty (30) days of receipt of the original or updated plan, accepting, rejecting, or requesting modifications. In the event of an emergency, the DCF may exercise oversight authority over the COUNTY in order to assume implementation of agreed emergency relief provisions. 2

Section 10. Emergency Support to the Deaf or Hard-of-Hearing. The COUNTY and its subcontractors shall comply with section 504 of the Rehabilitation Act of 1973, 29 U.S.C. 794, as implemented by 45 CFR Part 84 (hereinafter referred to as Section 504), the Americans with Disabilities Act of 1990, 42 U.S.C. 12131, as implemented by 28 CFR Part 35 (hereinafter referred to as ADA), and the Children and Families Operating Procedure (CFOP) 60-10, Chapter 4, entitled Auxiliary Aids and Services for the Deaf or Hard-of-Hearing If the COUNTY or any of its subcontractors employs fifteen (15) or more employees, the COUNTY shall designate a Single-Point-of-Contact (one (1) per firm) to ensure effective communication with deaf or hard-of-hearing clients or companions in accordance with Section 504 of the ADA, and CFOP 60-10, Chapter 4. The COUNTY s Single-Point-of-Contact and that of its subcontractors will process the compliance data into the DCF s HHS compliance reporting database by the 5th business day of the month, covering the previous month s reporting, and forward confirmation of submission to the FNCAC. The name and contact information for the COUNTY s single-point-of-contact shall be furnished to the DCF s grant or contract manager within fourteen (14) calendar days of the effective date of this requirement. The COUNTY shall, within thirty (30) days of the effective date of this Agreement, contractually require that its subcontractors comply with Section 504, the ADA, and CFOP 60-10, Chapter 4. A single-point-of-contact shall be required for each subcontractor that employs fifteen (15) or more employees. This single-point-of-contact will ensure effective communication with deaf or hard-of-hearing clients or companions in accordance with Section 504 and the ADA and coordinate activities and reports with the COUNTY s single-point-of-contact. The single-point-of-contact shall ensure that employees are aware of the requirements, roles & responsibilities, and contact points associated with compliance with Section 504, the ADA, and CFOP 60-10, Chapter 4. Further, employees of providers and their subcontractors with fifteen (15) or more employees shall attest in writing that they are familiar with the requirements of Section 504, the ADA, and CFOP 60-10, Chapter 4. This attestation shall be maintained in the employee s personnel file. The COUNTY s single-point-of-contact will ensure that conspicuous notices which provide information about the availability of appropriate auxiliary aids and services at no-cost to the deaf or hard-of-hearing clients or companions are posted near where people enter or are admitted within the agent locations. Such notices must be posted immediately by the COUNTY and its subcontractors. The approved notice is available at: http://www.myflfamilies.com/aboutus/services-deaf-and-hard-hearing/dcf-posters. The COUNTY and its subcontractors shall document the client s and companion s preferred method of communication and any requested auxiliary aids/services provided in the client s record. Documentation, with supporting justification, must also be made if any request was not honored. The COUNTY shall distribute client feedback forms to clients or companions and provide assistance in completing the forms as requested by the client or companion. 3

If clients or companions are referred to other agencies, the COUNTY must ensure that the receiving agency is notified of the customer s or companion s preferred method of communication and any auxiliary aids/service needs. The DCF requires each contract/subcontract provider agency s direct service employees to complete training on serving our clients who are deaf or hard-of-hearing and sign the attestation of understanding. Direct service employees performing under this Agreement will also print their certificate of completion, attach it to their attestation of understanding, and maintain them in their personnel file. Section 11. Entire Agreement. This Agreement constitutes the entire Agreement between the parties concerning the subject matter herein and all prior representations, statements, negotiations and undertakings are superseded or restated herein. No amendment to this Agreement shall be effective unless it is in writing and signed by the COUNTYand an authorized corporate officer or employee of the FNCAC. Section 12. Assignment. Neither this Agreement nor any duties or obligations under this Agreement shall be assignable by the COUNTY without the prior written consent of the FNCAC. ATTACHMENT B Definitions of Direct Services Provided By Children s Advocacy Centers Case Management and Advocacy: Case management and advocacy services include the following activities: support at all stages of investigation and prosecution attendance and/or coordination of interviews and/or case review greeting and orientation of children to the CAC provision of education about the coordinated, multidisciplinary response providing updates to the family on case status, continuances, dispositions, sentencing, offender release from custody assessment of the child s/family s attitudes and feelings about participation in the investigation/prosecution provision of court education/support/accompaniment providing tours of the courthouse/courtroom securing transportation to interviews, court, treatment and other case-related meetings assistance in procuring concrete services (housing, protective orders, domestic violence intervention, food, crime victims compensation, transportation, public assistance etc.) providing referrals for mental health and medical treatment, if not provided at the CAC. For purposes of reporting, only count one case management service per child, regardless of the actual number of case management/advocacy services provided. Therefore, the number of case management/advocacy services cannot exceed the number of unduplicated children reported. Mental health services: Therapy services is defined as specialized trauma focused mental health services provided to the child victim and designed to meet the unique needs of the child victim. Therapy services will be counted by session by the hour, an individual session for a child victim of one hour is one session, and a group session of an hour of child victims will be counted as a session for each child victim. If the session last 15 minutes, it will be counted as a ¼ of a service. The family members/parents receiving therapeutic services will be counted in Section 4 Ancillary Services Provided by CAC. Crisis intervention services are defined to mean short-term intensive services or intervention by a professional to a child victim that focuses on a single or recurrent problem(s) that is overwhelming or traumatic in nature. Psychological Evaluation is defined as a concise description of an individual s current psychological and neurological functioning by a licensed psychologist or credentialed school psychologist for the purpose of providing relevant and professionally sound opinions in matters where a child's health and welfare may have been or may be harmed 6

through the interpretation of an individual's psychological testing, history, clinical interviews, behavioral symptoms, and observations. The licensed psychologist or credentialed school psychologist must see the children or parents face-to-face. Forensic and specialized interviews conducted in the COUNTY: A forensic interview is defined to mean a developmental and age appropriate interview conducted by staff designed to collect factual information from a child to determine if that child was the victim of a crime or witnessed a crime against another person. The forensic interview is conducted in a manner that is legally sound, of a neutral fact-finding nature, and is coordinated to avoid duplicative interviewing. A specialized interview is defined to mean an interview with a child or a member of the child s family for the purpose of gathering clinical data, family functioning, family history, or other information for assisting with the assessment of alleged child maltreatment. Specialized interviews are information gathering in nature, and include the development of a risk assessment, and may be more flexible, not following an interview protocol. The primary purpose of a specialized interview is not for a legal purpose. Medical evaluations: All children who are suspected victims of child abuse should be assessed to determine the need for a medical evaluation. A medical evaluation (exam or consult) is conducted by a qualified medical provider with pediatric experience and child abuse expertise to: 1. Help ensure the health, safety and well-being of the child; 2. Diagnose, document, and address medical conditions resulting from abuse; 3. Differentiate medical findings that are indicative of abuse from those which may be explained by other medical conditions; 4. Diagnose, document, and address medical conditions unrelated to abuse; and 5. Assess the child for any developmental, emotional, or behavioral problems needing further evaluation and treatment and make referrals as necessary. Medical evaluations are routinely made available on-site or through linkage agreements with other appropriate agencies or providers. 7

The Florida Crime Prevention Association is requesting $1000 from your agencies Law Enforcement Trust Fund to assist us with offsetting this year's conference cost. This year's conference will be held in Sarasota Florida during the week of October 22 nd 2018. For the past five years Palm Beach County Sheriff Ric Bradshaw has been generous with the funds from PBSO's law Enforcement Trust Fund {LETF} account and supporting the Florida Crime Prevention Associations annual training conference. Sheriff Bradshaw has provided the Florida Crime Prevention Association with grants ranging from $5000-$7000 annually, We are reaching out to other agencies this year so we can lessen the demand on the Palm Beach County Sheriff's Office. As you may be aware, the Florida Crime Prevention Association has been in existence since 1969 and provides a week long training conference for law enforcement professionals assigned to crime prevention and community outreach units within their agencies. The cost for providing this valuable training opportunity increases each year and we have been relying on funds from conference sponsorsjvendors, attendee registrations and our conference raffles to offset conference cost. Our goal is to maintain an affordable training conference for our attendees and their agencies. The Florida Crime Prevention Association is a state association and all attendees from local police and sheriff's departments are welcome. Langford, Jr., P.E., Assistant County Engineer Request to change the northern portion of Pine Tree Circle to Captains Way. STATEMENT OF ISSUE The GIS and E-911 Coordinators have determined that the northern portion of the roadway named Pine Tree Circle, from Ike Avenue to the previously vacated portion of this roadway, needs to be renamed due to life, health and safety concerns per Ordinance 14-15-05, Sec. 9-36. Renaming for Public Safety. Pine Tree Circle residents affected by this course of action were notified of the intent to rename the roadway by Pre-Notification letters dated March 27, 2018 and April 3, 2018 sent via USPS certified mail. The GIS Department received two (2) Public Safety Roadway Renaming Petitions, Form 8-Y. The E-911 and GIS Addressing Departments reviewed the suggested road names and Captains Way was chosen as the selected road name. The Engineering staff has confirmed that Captains Way is not being used elsewhere in the County. Both the E-911 Coordinator and the County Engineer have reviewed and approve this new road name. RECOMMENDED ACTION Move to approve the request to change the northern portion of Pine Tree circle to Captains Way from the point of beginning to the vacated road segment. AGREEMENT FOR INSURANCE AGENT OF RECORD FOR EMPLOYEE HEALTH BENEFITS THIS AGREEMENT, made this day of June, 2018, by and between the Board of County Commissioners of Highlands County, Florida, (hereinafter called Board ), and The Gehring Group, Inc., (hereinafter called Agent or Agent of Record ). WHEREAS, the Board issued a Request for Proposals, RFP # 18-025, which is incorporated herein by reference, for the Insurance Agent of Record for Employee Health Benefits; and and WHEREAS, the Agent submitted a Proposal in response to the Board's Request for Proposals; WHEREAS, the Agent desires to render certain services as described in the Scope of Services, attached hereto as Exhibit A, and the Agent hereby certifies it has the qualifications, experienced staff, and resources to perform those services; and WHEREAS, the Board has selected the Agent based upon the submitted Proposal as a qualified applicant to perform the requested Agent of Record services. NOW THEREFORE, in consideration of the mutual covenants and promises contained herein, the parties hereto agree as follows: ARTICLE 1 TERM The term of this Agreement shall be for a term of one (1) year, commencing on June 19, 2018, and this Agreement may be renewed for five (5) additional one (1) year terms by agreement, in writing, of the parties. The contracted services with the current coverage will begin on July 1, 2018. ARTICLE 2 SCOPE AND RESPONSIBILITIES The Board engages the Agent and Agent agrees to perform in a good and professional manner the services stated in RFP # 18-025 and attached herein as Exhibit A. The Agent agrees to act as the Agent of Record, who will provide services that ensure the board obtains the lowest-cost coverage while maintaining the best available benefits. ARTICLE 3 TIME REQUIREMENTS FOR SERVICES The Agent o must be available to meet as needed, at a minimum of twelve times a year, with the Board of County Commissioners, County staff, the officials and employees of the other public entities that will receive services in connection with this Agreement, the Insurance Committee, or the general employee population for any insurance related needs that may arise. ARTICLE 4 COMPENSATION 4.1 The compensation provides for services described in this statement of services (Attachment A) at the rates shown below:

Any cost or expenses, including attorney's fees (including appellate, bankruptcy or patent counsel fees), incurred by the Board to enforce this Indemnification shall be borne by the Agent. This Indemnification shall also cover all claims brought against the Board, its elected officials, employees, agents, or volunteers by any employee of the Agent. The Agent s obligation under this Indemnification shall not be limited in any way to the agreed upon Agreement price as shown in this Agreement or the Agent s limit on or lack of sufficient insurance protection. Upon completion of all services, obligations and duties provided for in this Agreement, or in the event of termination of this Agreement for any reason, the terms and conditions of this Indemnification shall survive indefinitely. ARTICLE 6 INSURANCE 6.1 Required Insurance. Agent shall have and maintain in full force and effect the following insurance during the initial Term and all renewal Terms of this Agreement and shall furnish to the Board, Certificates of Insurance documenting that insurance coverage has been obtained which meets the following requirements: a. Workers' Compensation. Agent of Record shall have and maintain workers compensation insurance for all employees for statutory limits in compliance with Florida law and Federal law. Page 2 of 11

This insurance policy must include Employer s Liability with a limit of $100,000 each accident, $500,000 disease (policy Limit), and $100,000 disease (each employee). b. Commercial General Liability. Occurrence Form Required: Agent shall have and maintain commercial general liability (CGL) insurance with a limit of not less than $1,000,000.00 each occurrence. If such CGL insurance contains a general aggregate limit, it shall apply separately to the work performed pursuant to this Agreement in the amount of $1,000,000.00. Products and completed operations aggregate shall be $1,000,000.00. CGL insurance shall be written on an occurrence form and shall include bodily injury and property damage liability for premises, operations, independent Agent of Records, products and completed operations, contract liability, broad form property damage and property damage resulting from explosion, collapse or underground (x, c, u) exposures, personal injury and advertising injury. Fire damage liability shall be included at $100,000.00. c. Commercial Automobile Liability Insurance: The Agent shall have and maintain automobile liability insurance with a limit of not less than $1,000,000 each accident for bodily injury and property damage liability. Such insurance shall cover liability arising out of any auto (including owned, hired, and non-owned autos). The policy shall be endorsed to provide contractual liability coverage. d. Professional Liability Insurance: The Agent shall have and maintain professional liability insurance with a limit not less than $1,000,000 per occurrence. If coverage is provided on a claims-made basis, the retroactive date shall be prior or equal to the effective date of any Agreement with the Board. The coverage shall be renewed or include a tail or discovery, or continuous renewal of coverage for a period of 3 years following the termination of the Agreement entered into in connection with this RFP. 6.2 Additional requirements: a. Certificates of Insurance shall be signed by a person authorized by that insurer to bind coverage on its behalf. All Certificates of Insurance must be on file with and approved by the Board before commencement of any work activities. The formal insurance certificates shall name "Highlands County, a political subdivision of the State of Florida and its elected officials, agents, employees and volunteers as "Additional Insureds" on all policies except Workers Compensation and Professional Liability. b. Agent shall provide notification to the Board by overnight delivery return receipt requested, hand delivery or confirmed facsimile thirty (30) days prior to giving or within three (3) days after receiving notice of cancellation, modification, non-renewal, or any other lapse in coverage of any required insurance policies. c. All insurance policies except Professional Liability shall be primary, and all insurance policies shall be written on forms acceptable to the Board and placed with insurance carriers approved Page 3 of 11

If such suspension exceeds ten (10) calendar days, the Board may, in its sole discretion, terminate the Agreement for cause and Agent of Record shall be responsible for all direct and indirect costs associated with such termination. ARTICLE 7 FAILURE TO PERFORM The Agent shall be prepared to start providing services on July 8, 2018. Failure to complete the work as scheduled may result in written notice to the Agent terminating its right to proceed as to the whole or any part of this Agreement. Should the Agent be unable to supply services within a reasonable time or refuse to supply service, the Board may use the services provided by another Agent. The difference in the Agreement price of the services and that paid the new Agent for the services shall be charged to and paid by Agent by set-off against any amount owed by the Board to the Agent or, if none, shall be paid by the Agent to the Board within twenty (20) days after being invoiced by the Board. Agent shall not, however be responsible for delays in service due to acts of the board, strikes, acts of God or fire, provided the Highlands County Administrator is notified in writing by the Agent of such pending or actual delay. ARTICLE 8 ASSIGNMENT No assignment by a party hereto of any rights under or interests in this Agreement will be binding on another party hereto without the written consent of the party sought to be bound, and specifically, but without limitation, moneys that may become due and moneys that are due may not be assigned without such consent (except to the extent that the effect of this restriction may be limited by law). Unless specifically stated to the contrary in any written consent of an assignment, no assignment will release or discharge the assignor from any duty or responsibility under this Agreement. ARTICLE 9 SUBCONTRACTORS No subcontractor may be used to perform the services required by this Agreement without the written approval of the Board. ARTICLE 10 CONTRACT MANAGER The County hereby designates the person having the following position as the Board's Contract Manager for this Contract. The Contract Manager shall be responsible for oversight, administration, and coordination of performance of this Agreement for the Board. ARTICLE 11 TERMINATION Either party may, upon providing one hundred twenty (120) days written notice, terminate the Agreement at any time, with or without cause, and if this Agreement is terminated, the Board shall be liable only for payment in accordance with the provisions of this Agreement for the services performed prior to the effective date of termination. ARTICLE 12 ASSIGNMENT OF AGREEMENT The Agent of Record shall not assign, transfer, convey, sublet or sell any portion of this Agreement or performance thereof unless written consent is given, in advance, by the County Administrator. When applicable, Agent of Record shall comply with all new state and federal EEO regulations. ARTICLE 14 EMPLOYMENT ELIGIBILITY VERIFICATION 14.1 Definitions. As used in this Section. (a) Employee assigned to this Agreement means an employee who was hired after November 6, 1986, who is directly performing work, in the United States, under this Agreement. An employee is not considered to be directly performing work under this Agreement if the employee i. Normally performs support work, such as indirect or overhead functions; and ii Does not perform any substantial duties applicable to the Agreement. (b) Subcontract means any contract entered into by a subcontractor to furnish supplies or services for performance of this Agreement or a subcontract under this Agreement. It includes but is not limited to purchase orders, and changes and modifications to purchase orders. (c) Subcontractor means any supplier, distributor, vendor, or firm that furnishes supplies or services to or for Auditor or another subcontractor. (d) United States, as defined in 8 U.S.C. 1101(a)(38), means the 50 States, the District of Columbia, Puerto Rico, Guam, and the U.S. Virgin Islands. 14.2 Enrollment and verification requirements. (a) Agent of Record must be enrolled in E-Verify at time of contract award, and the Agent shall use E-Verify to initiate verification of employment eligibility of Page 5 of 11

i. All new employees. (A) Enrolled thirty (30) calendar days or more. Agent shall initiate verification of employment eligibility of all new hires of Agent, who are working in the State of Florida, whether or not assigned to this Agreement, within three (3) business days after the date of hire; or (B) Enrolled less than thirty (30) calendar days. Within thirty (30) calendar days after enrollment in E-Verify, Agent shall initiate verification of employment eligibility of all new hires of Agent who are working in the State of Florida, whether or not assigned to this Agreement, within three (3) business days after the date of hire; or ii. Employees assigned to this Agreement. For each employee assigned to this Agreement, Agent shall initiate verification of employment eligibility, to the extent allowed by the E-Verify program, within thirty (30) calendar days after date of contract award or within thirty (30) days after assignment to this Agreement, whichever date is later. (b) Agent shall comply, for the period of performance of this Agreement, with the requirements of the E-Verify program MOU. Termination of Agent s MOU and denial access to the E-Verify system by the Department of Homeland Security or the Social Security Administration or the U.S. Citizenship and Immigration Service is an event of default under this Agreement. 14.3 Website. Information on registration for and use of the E-Verify program can be obtained via the Internet at the U.S. Citizenship and Immigration Service s Web site: http://www.uscis.gov. 14.4 Individuals previously verified. Agent is not required by this paragraph to perform additional employment verification using E-Verify for any employee whose employment eligibility was previously verified by Agent through the E-Verify program. 14.5 Subcontracts. Agent shall include, and shall require the inclusion of, the requirements of this Section, including this paragraph (14.5) (appropriately modified for identification of the parties), in each subcontract that includes work performed in the United States under this Agreement. ARTICLE 15 CHANGES/AMENDMENTS This Agreement constitutes the entire Agreement between the parties and supersedes any prior written or oral agreements. EXHIBIT A STATEMENT OF SERVICES The County has requested a qualified entity to act as its agent of record and The Gehring Group, Inc. has responded as an agent of record with thorough knowledge of the health insurance industry, insurance providers, products, underwriting, and reasonable costs. The Insurance Agent of Record will be responsible for the health benefits plan administration as described in this statement of services and will foster working relationships with Human Resources/Insurance departments within the County, each Constitutional Office and the participating outside Agencies in the health plan. The HCBCC is aware of rising health care costs and wishes to ensure it obtains the lowest cost coverages while maintaining the best available benefits. The Agent of Record will provide, according to best commercial practices: A. Annual review of employee health benefits for quality of benefit provided, cost effectiveness, competitiveness, and plan administration (by both the HCBCC and plan administrator). Make recommendations concerning any changes in terms, conditions, and limits. B. Assist with annual health benefit renewals, including negotiation of any change in contracts. C. If health benefits are marketed, prepare RFP specifications, identify appropriate markets, analyze Proposals submitted, make recommendations, and assist in negotiation of contracts. D. Provide such actuarial and/or consulting services as may be necessary to develop and communicate recommendations to include: 1. Written analysis with sufficient details to support conclusions and recommendations. 2. A discussion of any federal or state legislation affecting the funding of public health insurance programs. 3. Complete details on claim administration and cost containment features of the recommended program. 4. Any other information the agent deems appropriate. 5. Review the health vendors documents and communication materials for accuracy of coverage, terms, and conditions. E. Monitor ongoing contracts, including provider plan administration, provider compliance with contract, and incurred benefits. F. Provide estimates of renewal rates and assist County staff in preparation of budget figures for health benefits. G. Evaluate appropriateness of alternative financing mechanisms such as partial or self-funding, and assist in structuring such financing, including recommendations pertaining to retention levels, stop-loss limits, etc. Page 8 of 11

H. Provide information on employee benefit issues, trends, and proposed or new legislation. I. Be available to meet, as needed or at a minimum of twelve times a year with the HCBCC, County staff, the Insurance Committee, and the general employee population for any insurance-related needs that may arise. J. Assist in design and delivery of employee health benefits communication pieces, including presentations at the Health Benefits Fair and Employee Wellness Program. K. Additional responsibilities of the agent of record: Evaluation & Education Evaluate benefit plans on a regular basis to ensure a competitive, efficient & cost effective program. Review benefit levels, eligibility, and employee contributions and compare to standards for like entities. Assist in developing proposals and strategies for use in budgeting process. Renewal Negotiation Negotiate the pricing of benefits provided by carriers at each renewal. Analyze claims experience to determine trends and to project future costs. Evaluate plan design, funding, and administration alternatives for their potential to reduce cost or improve benefits. Competitive Bidding Solicit and evaluate proposals from other vendors as needed. Prepare bid specifications, negotiate terms, and make recommendations. Perform RFP for annual Stop-Loss renewal Prepare specifications for a health clinic and advise Insurance Committee with selecting the most appropriate option(s). Employee Communication Develop custom open enrollment and new hire communications to help employees better understand and appreciate their benefits. Assist in the coordination of Open Enrollment and Wellness events Conduct employee meetings as appropriate to explain major changes in coverage or to introduce a new carrier. Provide and administer one annual employee survey to determine areas of employee concern and/or needed improvement within existing benefits. Complete analysis of survey results and prepare and provide a concise report accompanying an action plan based on survey results. Enrollment Coordination Prepare applications or amendments for signature. Organize the submission to the carrier; obtain confirmation of approval. Oversee printing of identification cards, booklets, contracts and amendments. Provide integrated software for enrollments, changes, and auditing of coverage(s). Claims Resolution Assist employees in resolving claim problems. Work with the carriers, providers and collection agencies to ensure accurate and timely benefit payments. Page 9 of 11

Coordinate all changes to the benefit program. Educate employees on plan benefits and claim procedures to help improve the processing of future claims. Customer Service Provide assistance with billing and administrative needs, such as obtaining supplies, correcting billing errors, and seeking enrollment exceptions. Foster relationships with Human Resources/Insurance departments within each Constitutional Office and Outside Agency that participates in the health plan. The Agent of Record is expected to communicate directly with these entities. Compliance Support Provide assistance in complying with various federal and state requirements, such as ACHA, PPACA, COBRA, HIPAA, FMLA, and ERISA. Provide guidance on responsibilities, and explain consequences of non-compliance. Research technical issues and suggest useful resources. Provide training as required to the Contact persons listed below. Tracking Benefits Agent of Record will provide an electronic technology identified as BenTek which is equal to or better than PlanSource that is currently used. The system is flexible and an extensible health exchange and benefits engagement platform for benefits shopping, enrollment, billing and ongoing administration. The BenTek electronic technology will be used Health, Dental, Vision, Life, Employee Assistance Program, MDLive and Flexible Spending Account, and voluntary products such as AFLAC, TransAmerica or Nationwide (if possible based upon carrier enrollment requirements and capability). The electronic technology, if possible, should have the capability to interface with FinPlus, Superion or various payroll systems. Bentek software is a service from BenTek, Inc. that the Agent of Record has included in their compensation rates. The Agent of Record assures that the County can contract separately for services with BenTek, Inc. if this agreement is terminated. STATEMENT OF ISSUE Attached is a list of County Property, including vehicles and equipment, that needs to be declared Surplus prior to being disposed. In order to use the Internet auction process with Gov-Deals for office equipment and Insight Auctioneers for fleet equipment, the two-step disposal procedure must be waived by the Board of County Commissioners. In the past years, the auction process has consistently yielded a higher price on the Surplus items sold. RECOMMENDED ACTION Move to declare the attached list of County property as Surplus, waive the two-step Surplus Disposal Process, and allow the Surplus to be disposed of by utilizing the Boards contract with Gov-Deals and Insight Auctioneers auction service companies pursuant to section 274.05, Florida Statutes. HIGHLANDS COUNTY COUNTY COMMISSION AGENDA ITEM DATE OF ACTION REQUEST: June 19, 2018 PRESENTER: SUBJECT/TITLE: Benjamin A Dunn, Development Services Director Request approval of Budget Amendment 17-18- 112 and Resolution to Appropriate SHIP Disaster Funding. STATEMENT OF ISSUE The State Housing Initiatives Partnership (SHIP) is funded by the State of Florida Housing Trust Fund which derives its revenues from documentary stamp fees resulting from real estate transactions. State funds are distributed to Florida counties based upon population. No revenue from local ad valorem taxes is used for these purposes. Florida Housing has completed the evaluation process regarding the SHIP disaster funds for Fiscal Year 2017-2018 to address damage from Hurricane Irma and the influx of evacuees due to Hurricane Maria. Florida Housing s statutory authority allows them to hold back up to $5 million in SHIP funds in each fiscal year for disaster relief. With data provided to Florida Housing from FEMA and other sources, they were able to analyze the damage data and allocate these limited funds to the local government that were most significantly impacted. The State has allocated disaster funds to Highlands County in the amount of $150,000.00 for Fiscal Year 2017-2018. Funds will be expended through the Disaster Mitigation strategy approved under the Local Housing Assistance Plan (LHAP) covering that year. Budget Amendment 17-18-112- is being proposed to receive and appropriate a total of $150,000.00 awarded to Highlands County for FY2017-2018. RECOMMENDED ACTION Move to approve budget amendment 17-18-122 and resolution to appropriate SHIP Disaster Funding. FISCAL IMPACT The Fiscal Impact is an increase to Fund 166 (SHIP) and the overall budget in the in the amount of $150,000.00 to cost centers 5366 (SHIP Administration) and 5367 (SHIP Program) in the amounts of $15,000 and $135,000, respectively. STATEMENT OF ISSUE This budget amendment is being requested to appropriate insurance proceeds received from PGIT for the water damage sustained on April 23, 2018 at the Veteran Service Office. All repairs have been made and staff have been move back into their respective offices after being displaced for nearly 45 days. RECOMMENDED ACTION Move to approve budget amendment 17-18-114 and resolution to appropriate insurance proceeds for repairs to the Veteran Service Office following the water damage sustained in the building. STATEMENT OF ISSUE This budget amendment is being requested to appropriate insurance proceeds received from PGIT (Preferred Government Insurance Trust) for the replacement of a 16 Peterbuilt dump truck that was stolen on April 14, 2018 and never recovered. County staff are working with PGIT to review the claim amount. Additional insurance proceeds may be recognized following the review process.
