Provided in Attachment A is historical information on the development to date in Marina Garden Estates as provided to Council at a previous workshop on May 14, 2012. n response to comments provided at the May 14, 2012 Council Workshop, the owner and Polygon Homes revised the master plan for the remaining undeveloped areas in Marina Garden Estates as follows: Boatyard to remain in its current location. The existing building to be modified and renovated. Orientation of the proposed apartment buildings modified to reduce the massing on Admirable Boulevard. Commercial village building centrally located on waterfront with marina parking below. Apartment buildings located separately to the east of the commercial area. Public plaza added adjacent to commercial building. Addition of a children's play area at the northeast corner of the site adjacent to proposed townhouses. Minor modifications to the general townhouse and clubhouse footprint. The current proposal, as provided in Attachment B, contains: A commercial boatyard; A marina; A commercial village with 1,000 m 2 (10,764 ft2) of retail commercial and office space; A public plaza adjacent to the commercial village centre; 65 single family homes;
The Corporation of Delta Community Planning & Development Subject: Council Workshop - Marina Garden Estates Page 2 of 2 File No: ENQ00274 312 three-storey townhouse units (243 units with a 4.9 m (16 ft) building width and 69 units with a 6 m (20 ft) building width); A two-storey, 1,115 m 2 (12,000 ft2) clubhouse for strata owners; 260 residential units in three, four-storey apartment buildings on Admirable Boulevard; 100 residential rental units in a four-storey apartment building on the waterfront adjacent to the commercial plaza; and A linear park trail along the waterfront. The total number of units permitted in all neighbourhoods of Marina Garden Estates is 1,426. Of this total, 620 units have been constructed. The proposed development of the remainder area with 737 units would result in a total of 1,357 units. Next Steps: t is anticipated that a rezoning and subdivision application will be received in early October. The subject properties are not in a Development Permit area for the form and character of multiple-family residential development; however, staff will work with the owner and Polygon Homes to develop design guidelines for the proposed single family development and specific designs, subject to review by the Advisory Design Panel, for the proposed commercial plaza, apartment buildings and townhouses. Following receipt of an application, staff will advise Council, and will initiate a public consultation program with the surrounding residents to seek input and comments on the proposed land use changes. Harvie, Chief Administrative Officer The purpose of this memorandum is to provide Council with background information for the May 14, 2012 workshop with Captain's Cove Marina Ltd. and Polygon Homes regarding the proposed rezoning and final build-out of Marina Garden Estates. This memorandum includes historical information on the development to date in Marina Garden Estates and the preliminary proposal for land use changes in the area. Completed Phases Marina Garden Estates was approved for development in 1996 under Comprehensive Development Zone C.D. 98A, for a total of 1,426 dwelling units, a 220-room hotel, a marina, a neighbourhood pub, and limited commercial uses. Land uses are regulated by the Comprehensive Development Zone and a Land Use Covenant registered on the title of the lots. Approved building types are single family dwellings, duplexes, townhouses and stacked townhouses. The Master Plan of the neighbourhoods and area designations are provided in Attachment A. A table of unit allocations is provided in Attachment B. Eight neighbourhoods - including Neighbourhood 5, which is the golf course - have been constructed to date. Neighbourhoods 1, 2, and 3 were constructed prior to the approval of C.D. 98A, and contain 338 single family homes. Based on the approved zone and the Land Use Covenant, the owner could construct 695 townhouses and stacked townhouse units as follows: Neighborhood Permitted Number of Units 9 206 10 230 11 159 (plus 220-room hotel) 12 100 TOTAL 695 Proposed Amendments to Land Use Plan Captain's Cove Marina Ltd. will be working with Polygon Homes as a partner in the last phases of development, capitalizing on their experience with townhouse developments through Metro Vancouver including the Delsom development in North Delta. Polygon also constructed the Chesapeake Landing and Woodward's Landing developments (Neighbourhoods 4 and 7) in Marina Garden Estates. The owner wishes to build out the remaining four neighbourhoods in a different built form and with a slightly higher number of units; in effect transferring 34 of the un-built units from the earlier phases of development to Neighbourhoods 9 to 12. We note that the hotel is no longer included in the development plans. Some ground-oriented, localserving commercial space would be provided, but the type and amount of commercial activity is not known at this time. The proposed overall site plan for Neighbourhoods 9 to 12 is provided in Attachment C. The apartments in Neighbourhood 11 would be in three free-standing buildings, and the 88 units proposed for Neighbourhood 12 would be accommodated over commercial space in this location. f the current proposal were built out, the total number of units in Marina Garden Estates would be 1,348. This would be less than the maximum of 1,426 dwelling units permitted under Comprehensive Development Zone C.D. 98A and the Land Use Covenant registered on the title of the properties. Park Space A second significant change proposed is the deletion of a proposed 1.52 hectare (3.75 acre) park from Neighbourhood 10. This park space was to be located at the north east corner of Neighbourhood 10, and is identified as "Park C" on the Master Plan in Attachment A. This park area would be replaced with a public walkway/waterfront walk system along the foreshore area. The scale and nature of this walkway is yet to be determined, but will be developed in consultation with the Parks, Recreation & Culture Department. t is proposed to dedicate as public open space a strip along the east of the site (fronting Green Slough) up to 15 m (49 ft) wide, and a strip of up to 30 m (98 ft) wide along the north of the site on Deas Slough. Under this proposal, public open space in these remaining neighbourhoods would be increased by 0.8 hectare (1.98 acres). We note for Council that these areas are required riparian setback areas, and are unbuildable. A walkway already exists through the area under a statutory right-of-way for public access. The owner is requesting consideration of the deletion of the park space at the north-east of the site in recognition of the proposed dedication of the waterfront areas, as well as the recent dedication of 0.97 hectare (2.4 acres) of their land south of Neighbourhood 4 (Chesapeake Landing) as Delta park. This land contains a public walkway connection from Ferry Road to a bridge over the slough to Admiral Boulevard, and provides a public walkway for residents of Chesapeake Landing. We note that The Corporation of Delta assumed ownership of this land at the request of Captain's Cove Marina Ltd. in 2010. The location of the park dedication is shown in Attachment D.

Next Steps To pursue the proposed revisions, the owner would be required to submit an application for a rezoning and a subdivision application. The subject properties are not in a Development Permit area for the form and character of multiple-family residential development.
