Town of Harmony Board Meeting Minutes Monday, June 4, 2018 Approved by the Town Board on July 9, 2018 Harmony Town Hall, 440 N Hwy 14, Janesville WI Chairman Bergman called the meeting to order at 7:00 p.m. In attendance: Chairman Bergman, Supervisors J. Klenz, B. Barlass, M. McNall, D. Quarterman, Attorney Moore, Attorney Oellerich, Clerk Tollefson, and Treasurer Check. Motion to approve the agenda was made by Supervisor B. Barlass; second by Supervisor J. Klenz; carried by a voice vote. Pledge of Allegiance Minutes from the May 7, 2018 Town Board Meeting approved as submitted. Bill Jensen from Rural Insurance, the Town s agent, introduced himself to the Board. Public Comment Mary Mawhinney from the Rock County Board introduced herself and complimented the poll workers on the excellent job they did with the past election. Clerk Tollefson thanked the Board and Lisa Tollefson for their patients over the last 8 plus months as she filled in for him. The board also thanked Lisa for her work. Bill Barlass thanked the 4H group for the work they did on the Cemetery clean up. The Board agreed that we should give them a gift certificate to a pizza place for their efforts of cleaning up the Cemetery during the rain. Deputy Bordner introduced herself and asked if there were any questions or concerns in the Township. Supervisor Barlass mentioned the speeding on County A. The Deputy said they had speed trailers out in the area to try and control speed. Open Public Hearing on ordinance amending Chapter 1 of the Code of Ordinance of the Town of Harmony Zoning Ordinance and revising the same to comply with the requirements of Chapter 91 Wisconsin State Statutes for Farmland Preservation. The public hearing was opened at 7:09 pm. Attorney Oellerich explained starting last fall the Town submitted zoning changes to the State of Wisconsin to eliminate the A1A and moving these parcels to A1. The State did not want the elimination of the A1A zoning. Resident Steve Voda challenged the zoning change from A1A to A1 for Parcels 6-7-76A and 6-7-24 as he has not claimed these in farmland preservation and does not intend to.

Chairman Bergman explained he had a conversation with Steve Voda on these properties and whether they are zoned A1 or A1A, based on their location in the Township being adjacent to developments it would not be a concern changing the zoning on these parcels in the future to accommodate development. Attorney Moore explained the County changed its farmland preservation plan and the changes to the ordinance were written to remain consistent with the County s plan. Attorney Moore also stated that if DATCP has no concern with these parcels remaining in A1A the parcels could remain in A1A. Resident Harold Hanauska stated that he too had properties that were moving from A1A into A1 that are adjacent to developed areas. These properties include 6-7-22, 6-7-24.1 and 6-7-18.2. Close Public Hearing Public hearing was closed at 7:29 pm by Chairman Bergman. Discussion and possible action on amending Chapter 1 of the Code of Ordinance of the Town of Harmony Zoning Ordinance and revising the same to comply with the requirements of Chapter 91 of Wisconsin State Statutes for Farmland Preservation. Motion to adopt the change to the ordinance with the changes to the 5 properties 6-7-18.2, 6-7- 22, 6-7-24, 6-7-24.1 and 6-7-76A leaving these parcels as A1A was made by Supervisor J. Klenz; second by Supervisor M. McNall and carried by a voice vote. Discussion and possible action on storm water issues along Henke and Rotamer Roads. The discussion is about parcel # 6-7-102 and the flooding that happens on that property with regards to the culvert that is beneath Rotamer Road. The parcel is owned by Steven J Voda. Norm Tadt of Rock County Land Conservation was introduced by Chairman Bergman. Norm went through cost estimates to slow the water down as it enters and exits the culvert. Costs are between $5300 and $9500. Norm explained the concern that Mr. Voda has with the water running into his property as it is causing some erosion along the field. Options included excavation of the two culvert ends and placement of 70 yards of rock. Another option was the same as the first and also included a 500 foot berm between the culvert and the fields low area. Attorney Moore stated the question is, whether it is the Town s responsibility or the land owners to remedy the situation, and he sees no legal basis that Town should be responsible for the cost to remedy the situation. Part of the question that was brought up was the removal of the fence rows over time which may slowed the water movement. After discussion the decision as to whether it is the Townships responsibility to remedy or giving permission to the land owner to make repairs in the right of way which the property owner owns. The motion was tabled to a future meeting as several Town Board Supervisors would like to view the area in question.

Discussion and possible action on Development agreement for Stoney Ridge Subdivision. Ron Combs of Combs and Associates presented the storm water runoff plans for the Stoney Ridge development. Plans for this have been submitted to Rock County Land Conservation Department. Road Construction plans have been submitted to the Rock County Planning Department. Ron Combs also stated the Developers agreement states everything that they have agreed to and what Rock County says they have to do. Sam Billhorn, a resident and member of the home owners association for the existing part of this subdivision wanted to ensure that this new part of the development would not create more water problems. Ron Discussed that the pond at the south end of the development would be restructured to prevent issues. Supervisor J. Klenz inquired about the older section of Lilly lane and the condition of the road, after the construction of the new roads is completed. Ron Combs agreed to have the road videotaped prior to construction and again after to see what damage was done. Ron stated at the most the developer would do, is to put a top coat on this older section of road. Sam Billhorn also commented on the sightlines for the intersection of Lilly Lane and MH Townline road. The Township is already inquiring about the sightlines for this intersection. With removal of Trees or cutting them back. Sam Billhorn also commented on the cul-de-sac on Robins Crest to ensure that when Lilly Lane and Robins Crest meet up that a 2% grade be given to this area for ease of driving. Ron said they would make sure this is looked at. Attorney Moore stated the Motion would be to approve the developers agreement as submitted with a revision to section 3 to file a surety bond in Luo of a letter of credit and a revision to Section 1A that the developer shall video tape the existing portion of Lilly Lane prior to construction so as to allow any damages to be reimbursed to the Town of Harmony. Chairman Bergman so moved to the motion read by Attorney Moore with a second by Supervisor J. Klenz. The motion carried by a voice vote. Ron Combs also mentioned that the flooding issue at the South end pond is being fed by a culvert that crosses under the ice age hiking trail. Discussion and update from fence committee and the Town of Harmony Attorney This is in regard to a fence line between the Timber Ridge subdivision and the property owner to the north. Letters are being drafted and estimates are being done to work towards completion of the repair of this fence line. Discussion and possible action re: easement for storm water culvert at 4104 N Lunar Dr Attorney Moore stated he visited the property with Supervisor J. Klenz and will be drafting an easement for the culvert in the near future. Discussion and possible action on the retainer with Nowlan & Mouat LLP, for attorney services from June 1, 2018 through May 31, 2019.

Attorney Moore will be stepping down as the Town s Attorney and Michael Oellerich will be taking over responsibility as Attorney for the Township. There were no price changes in the retainer from 2017. Supervisor B. Barlass made a motion to approve the retainer with Nowlan & Mouat LLP; Seconded by Supervisor M. McNall and carried by a voice vote. Discussion and possible action on road work and brush cutting for 2018. Supervisor J. Klenz mentioned that a neighbor in Starview Heights wants to replace his driveway and would like to know the height the culvert needs to be when the driveway is completed. Norm Tadt stated he would figure out the size and depth of the culvert and get back to Supervisor J. Klenz and the home owner. Chairman Bergman asked the Attorneys if the Township had any liability with regard to a tree that had fallen from a park area in the Timber Ridge Subdivision on to a neighbor s lot and did some damage. Both Attorneys stated no. Discussion and possible action on moving Town Clerk s office to the Town Hall Clerk Tollefson stated he was planning on moving the Town Clerks office from his home to the Town Hall at some point in July. The Township would need to purchase a safe as there are papers and documents that need to be secured in a fireproof safe. Clerk Tollefson is looking for the best deal on a good size safe. Concerns on availability of the clerk are a concern. Clerk Tollefson stated there are numerous options to remain in contact with the public at any hour such as a Tracphone or an answering machine that we can retrieve from any phone. The clerk would still be available when needed 24 hours a day. No Board member was concerned with the move. Discussion and possible action on setting the date for the July town board meeting. After discussion it was decided to leave the July Town Board Meeting on the First Monday of the month. July 2, 2018. Zoning officers report As Read by Chairman Bergman. 5 permits issued in May.. Building Inspectors Report Read by Chairman Bergman. April showed 3 permits issued. Approval of Bills Motion to approve the bills made by Supervisor B. Barlass; seconded by Supervisor J.
