The business operates with a couple of sanding trucks and a couple pieces of heavy equipment that is stored inside a building during winter season. A letter of intent and site plan are attached. Background: The subject property is located at 763 Kapelus Dr. developed with two (2) commercial buildings. The property is subject to a Development Agreement ( DA ). Of interest, the DA requires the lot to be landscaped and asphalted. The property is zoned CH - Commercial Highway under the Zoning By-law, designated Highway Commercial under the Middlechurch Secondary Plan, and designated SC Settlement Centre under the Development Plan. Analysis: As the adjacent properties are primarily used for commercial purposes, the proposed use should not create a disturbance. The nature of the use on this specific property is compatible with the general nature of the surrounding area and should not have detrimental impact to the health or general welfare of people in the surrounding area. It is generally consistent with the applicable provisions of the development plan by-law and of the zoning by-law. The use may be able to be regulated through the conditions of approval of which may include items such as, but not necessarily limited to requirement to obtain an annual business license and/or through the requirement of a development agreement. This application was circulated to Manitoba Infrastructure ( MI ) and comment was received stating no objection and notifying of statutory requirements. MI s long range plans for PTH 11, being a Limited Access Highway classified as an expressway, would eliminate all at-grade road and access connections. These connections would be replaced by grade separated interchanges at selected locations. This long range plan impacts the connection onto PTH 11 from Kapelus near the entrance to the Sunova Centre. There are future plans to close the existing accesses onto PTH 11 to the east of this proposal. A complete copy of comments received is attached. Page 1 of 3
Options: Under section 16(1) of the Planning Act, on completion of the public hearing, Council may: (a) reject the application; or (b) approve the application if the conditional use proposed in the application (i) will be compatible with the general nature of the surrounding area, (ii) will not be detrimental to the health or general welfare of people living or working in the surrounding area, or negatively affect other properties or potential development in the surrounding area, and (iii) is generally consistent with the applicable provisions of the development plan bylaw, the zoning by-law and any secondary plan by-law. Recommendation: Our office recommends approval of the application as it is generally consistent with Section 16(1) of the Planning Act. Should Council approve a Conditional Use Order the following conditions of approval are recommended: 1. That Conditional Use approval be limited to allow a Landscape Contractor s Establishment as proposed within this application. Any changes in use will require a new conditional use approval; 2. If required, applicant / owner enters into a Development Agreement to address items such as parking, signage, lighting, fencing, vegetation standards, and the like; 3. No external storage permitted; and, 4. By-law compliance letter must be obtained from the R.M. of West St. Paul. Page 2 of 3
