Building regulations Section 2 For condominium residents and tenants (To be distributed to all tenants) In Appendix A, you will find a copy of the building regulations which are governed by your condominium declaration and are subject to the laws of the civil code. These regulations are in place to ensure the proper functioning of the common areas. Familiarize yourself with its content and be aware that sanctions will be imposed on the responsible owner of your unit and therefore you, the tenant. 2. Cleanliness Included in the building regulations, Article 19 and following are the items that define the concept of cleanliness and respect of the condominium areas. Description of items A. Garbage on the balconies, patios, staircases and parking spaces; B. Unused Bicycles, any material obstructing the view and aesthetics, baby buggy, carriages, etc; C. Destruction of green spaces, trees, shrubs, flowers, etc; D. Animal feces, cigarette butts, damaged turf, etc; If you fail to apply these regulations, refer to the Penalty section.
Appendix A SYNDICATE OF THE CO-OWNERS OF 186 TO 238 FREEMAN ROAD CONSTITUTIVE ACT AND REGULATIONS OF THE PREMISES APPLICABLE TO THE TENANTS AS PER THE DECLERATION OF CO-OWNERSHIP. CONSTITUTIVE ACT ARTICLE 18.1 The unit can be occupied residentially only and may not be used for trade or business purposes, all under reservation as per Article 18.2 below; ARTICLE 18.2 Use and enjoyment of the premises all residing units are subject to the following: 1- Installation of all exterior radio antennas, individual exterior television antenna is now permitted on the roof. The antenna must be placed on a patio stone which will be mounted on mould resistant Styrofoam. The wires have to be discreetly placed along the side of the building. 2- If you are away for more than 6 days, we recommend that you leave a key of your unit to one of the administrators of the Board of Directors. This will allow the administrators access to your unit in case of emergency such as fire, plumbing, windows and/or electrical deficiencies or water damage, etc. ARTICLE 18.3 All co-owners have the right to enjoy their common areas and parking spaces with the following restrictions: 1- The parking spaces will be used for the parking of personal and private vehicles. Consequently, all commercial, leisure and/or other vehicles are forbidden. 2- No construction is allowed in the common areas parking spaces. This includes any type of repairs, including mechanical work on vehicles. 3- No items can be left or stored on the premises or parking spaces, only your personal vehicle. 4- Co-owners, family members, tenants, employees and others using the common areas and parking spaces have to follow the parking rules adopted by the Board of Directors. ARTICL 19 COMMON AREAS. 1- Co-owners have to make sure that their garbage is well wrapped and disposed of in the areas designated by the Board of Directors.
2- Co-owners and/or tenants will not obstruct entries, balconies, stairways, yards, sidewalks, parking or other areas, nor will they leave any objects in the common areas of the premises. The balconies cannot be used as a storage area for bicycles, motorcycles, tires, strollers, children toys, etc. 3- Nobody will destroy, cut, break, change and/or mess up any areas of the property in regards to the landscaping including grass, trees, flowers, bushes nor will they place chairs, tables and/or any other items that could damage or stop the growth of grass or be in the way of maintenance work. 4- No hazardous material or insoluble substances will be tolerated on the premises. 5- In general, all co-owners, their guests and other people who are on the property will have to respect all dispositions of the declaration of co-ownership as well as the amendments and regulations that could eventually be adopted by the Syndicate. ARTICLE 20 COMMON AREAS 1- Unpleasant objects causing a prejudice to the harmony of the complex will not be tolerated, no partitions or awnings will be installed outside or on top of windows and balconies nor will clothesline be installed in any part of the complex. No flower pots or other articles can be suspended to the windows or installed on the windows edge and/or on the railings of balconies; all outside storing is forbidden. REGULATIONS OF THE PREMISES SECTION 3 CONDITIONS FOR THE ENJOYMENT OF COMMON AREAS 1- No domestic pets will be tolerated on the premises unless they are accompanied by their guardian and on a leash. Co-owners and /or guardians must comply with chapter 4 of the City of Gatineau s regulations. 2- All pet guardians must immediately remove or clean by any means all fecal matter produced by the animal. If you fail to apply these regulations, refer to the Penalty section. 3- Damages caused to the common areas, i.e.: grass and shrubs burned by animal urine, will be repaired at the owner s expenses. 4- Wild, exotic and/or farm animals are strictly forbidden in condos or on the premises.
5- No domestic animal that constantly barks when owner and/or tenant is away will be tolerated in virtue of article 18.2 that mentions that no co-owner/tenant shall disturb the enjoyment and tranquility of the buildings at any time. Any owner/tenant who keeps a pet considered harmful or a nuisance can be asked to remove the animal from the property at the sole discretion of the board of directors. Any owner/tenant who keeps the animal within his/her unit within two weeks of receiving written notice from the board shall permanently remove the animal from the premises otherwise damages of a HUNDRED DOLLARS ($100.00) per day of violation will be collected. 6- A review of regulations has concluded that vehicle maintenance (oil changes, mechanic work of all kinds, etc) is completely forbidden. 7- Also note that when installing air conditioning units in the windows, please do it as cleanly as possible by using clear Plexiglas and not plywood as stipulated by the regulations. Garbage VARIOUS Out of respect for your neighbours, garbage of any kind cannot be left outside your unit such as on balconies or at the door. In other words, once you are ready to take out your garbage, bring it directly to the container. The waste pickup will not be done if the garbage is placed outside of the container. Heavy waste such as mattresses, electrical appliances, furniture, etc. will only be picked up upon request and only from Freeman road. You are therefore required to contact 311 for this type of request. Visitor s parking and registry Fifteen (15) parking spaces are available for visitors, eleven (11) on the upper levels and behind units 206 to 212 and four (4) near the railway and Freeman road, before the trees. If you need a second parking space, several are available near the railway at a cost of $240.00 annually or $120.00 bi-annually. To rent a second parking you must contact Quanta Property Management by phone at (819) 778-2441 or by email at info@gestionquanta.ca If you already have a second parking, make sure that your pass is valid and visible at all times in the windshield of your vehicle otherwise, your vehicle will be towed at your expense. Be advised that visitors parking spaces are strictly reserved for visitors. Any Co-owners and/or tenants using these spaces as a second parking will have their vehicle towed at their expense. A first notice will always be sent but if a co-owner/tenant persists in using visitors parking as a second parking, they will be charged an additional $50.00 on their condo fee payments.
Important: If you have a visitor staying overnight, you must call Henri Towing at (819) 771-4242 before 21:00 and provide them with the vehicle make, colour, plate number and where it is parked to avoid it being towed away (at the owner s expense). Noise We ask that each Co-owner and/or tenant maintain noise at a tolerable level in the common areas and in their respective condo in order to respect the tranquility of the premises. Inside your condo, please keep the noise of any equipment at a reasonable level. Music equipment and surrounding sound must be kept at a level that will not affect, at any time of the day, the tranquility and peace of your neighbours, especially during the summer period when all the windows are open. Cigarettes In order to keep the premises clean, Co-owners and/or tenants are required not to stub out, throw on the ground and/or from their balcony any cigarettes. Barbecues Propane barbecues are NOT allowed on balconies or terraces. In 2013 we all received a letter from the fire department warning us not to use barbecues in such places. The fire department will be contacted directly. Penalties Penalties will be applied if owners and/or tenants produce excessive noise, if dogs are not kept on a leash, bark constantly or if excrement is not picked up. This also applies to the disrespect of the cleanliness of the premises. A first friendly notification will be sent to the owner concerned and if he/she does not comply within 5 business days of receiving the notice, a second notice will be sent with a first penalty cost of $50.00 plus shipping cost. If within 5 days of receiving the penalty nothing has been done by the owner, a second penalty fee of $50.00 (plus cost) will be charged. All notices will be sent by registered mail and will be charged to the delinquent owner.
