Hartwig, Director of Public Works/City Engineer RESOLUTION TO SELL SURPLUS REMAINDER RIGHT-OF-WAY FROM A CITY OWNED PARCEL (APN 0135-080-020) BORDERING THE EAST SIDE OF LEISURE TOWN ROAD, SOUTH OF ELMIRA ROAD; AND DISCUSSION: RESOLUTION TO DEDICATE SURPLUS RIGHT-OF-WAY TO THE COUNTY FROM A CITY OWNED PARCEL (APN 0125-060-010) CONTAINING THE PLEASANTS VALLEY DETENTION BASIN AND BORDERING PLEASANTS VALLEY ROAD; AND RESOLUTION TO SELL EASEMENTS AT NINE SEPARATE LOCATIONS TO CALTRANS FOR THE PURPOSE OF HAVING, OPERATING AND MAINTAINING FREEWAY RAMP METERING EQUIPMENT ALONG INTERSTATE 80 THROUGH VACAVILLE There are three separate locations wherein the City desires to vacate its interest in publicly owned right-of-way or land. The three areas are described below: I. In 2000, the City of Vacaville purchased the entire Majors property (APN 0135-080-020) along the east side of Leisure Town Road, south of Elmira Road, in anticipation of the Jepson Parkway project. The entire parcel is not needed for the widening and realignment of Leisure Town Road. The Solano Transportation Authority is negotiating with the adjacent property owner (Burnett property) to secure additional right-of-ways for the Jepson Parkway project. The City-owned parcel protrudes into the Burnett property (see Attachment 1), and it is desired to incorporate the remainder of the City-owned parcel into the sale agreement, such that it becomes part of the Burnett parcel. It is anticipated that approximately 5,700 square feet of the City-owned parcel will not be needed for the Jepson Parkway improvements. APN 0135-080-020 was purchased at fair market value in 2000, and the remainder would be valued at today s fair market value for the purpose of this right-of-way purchase agreement. II. The City currently owns APN 0125-060-010, which is bordered on the west by Pleasants Valley Road and the south by Foothill Road. This is the site of the Pleasants Valley/ Encinosa Detention Basin. The County is designing a safety project that will widen the improved shoulders along this particular segment of Pleasants Valley Road, and additional right-of-way is required. The County is also finalizing construction documents to reconstruct a segment of Vaca Valley Road in order to straighten the roadway alignment west of North Orchard Avenue. Approximately 300 feet of this projects scope falls within the City of Vacaville. The value of the City s portion of the Vaca Valley Road improvements is approximately $60,000. In exchange for the County designing and constructing the City portion of the Vaca Valley Road project, the County is proposing to accept approximately

0.6 acres of right-of-way along Pleasants Valley Road (see Attachment 2). Transferring this right-of-way to the County will in no way impact the operation or maintenance of the Pleasants Valley/Encinosa Detention Basin. III. Caltrans has constructed and is preparing to implement freeway ramp metering along Interstate 80 through Vacaville. At nine locations, it was necessary for Caltrans to locate their metering equipment within existing City of Vacaville right-of-ways (see Attachment 3, Pages 1-8 for locations). Caltrans is requesting that the City grant an easement in order for the State to have, operate and maintain traffic signal equipment related to ramp metering within the established areas. The City was involved in the review and inspection of the installations, and the easement will in no way impact the City of Vacaville right-of-way, or the City s ability to operate and maintain the roadway system. A fair market appraisal is being prepared by the State for the purchase of the easements. The purchase price is nominal and anticipated to be between $5,000 and $10,000. FISCAL IMPACT: There is no fiscal impact to the General Fund as a result of this action. RECOMMENDATION: By simple motion, adopt the subject resolutions and authorize the Director of Public Works to execute any necessary documents to sell the public right-of-ways and/or easements. RESOLUTION NO. 2015- RESOLUTION TO SELL SURPLUS REMAINDER RIGHT-OF-WAY FROM A CITY OWNED PARCEL (APN 0135-080-020) BORDERING THE EAST SIDE OF LEISURE TOWN ROAD, SOUTH OF ELMIRA ROAD WHEREAS, in year 2000, the City of Vacaville purchased APN 0135-080-020 from the Majors in anticipation of the widening and relocation of Jepson Parkway (Leisure Town Road); and WHEREAS, the entire depth of the parcel is not needed to accommodate the Jepson Parkway project; and WHEREAS, the Solano Transportation Authority (STA) is negotiating with the adjacent property owner (Burnett) to secure additional right-of-way for the Jepson Parkway project; and WHEREAS, the City owned parcel protrudes into the Burnett parcel, and Burnett desires to incorporate the remainder piece into their existing parcel in lieu of cash payment; and WHEREAS, the City would be credited against its share of the Jepson Parkway project cost by STA as a result of the sale of the remainder property based on the current fair market appraised value of the property; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Vacaville that the remainder of APN 0135-080-020 is deemed surplus right-of-way and may be incorporated into the right-of-way transaction between STA and Burnett for the Jepson Parkway right-of-way; and that the Director of Public Works be authorized to execute any necessary documents to sell the public right-of-way. RESOLUTION NO. 2015- RESOLUTION TO DEDICATE SURPLUS RIGHT-OF-WAY TO THE COUNTY FROM A CITY OWNED PARCEL (APN 0125-060-010) CONTAINING THE PLEASANTS VALLEY DETENTION BASIN AND BORDERING PLEASANTS VALLEY ROAD WHEREAS, the City of Vacaville currently owns APN 0125-060-010 which is bordered on the west by Pleasants Valley Road and the south by Foothill Road, and is the site of the Pleasants Valley/Encinosa Detention Basin; and WHEREAS, the County of Solano is designing a safety project that will widen the improved shoulders along this particular segment of Pleasants Valley Road, and additional right-of-way is required; and WHEREAS, the City and County are partnering on another safety project on Vaca Valley Road, west of North Orchard Avenue wherein approximately 75% of the project is within the County, and 25% within the City; and WHEREAS, the County is preparing the design and will administer the construction of the Vaca Valley Road project, with the City s share of the project valued at approximately $60,000; and WHEREAS, the County is proposing to accept approximately 0.6 acre of land dedication for the necessary right-of-way along Pleasants Valley Road in exchange for the City s share of the Vaca Valley Road improvements; and WHEREAS, the dedication of this right-of-way to the County will in no way impact the operation or maintenance of the Pleasants Valley/Encinosa Detention Basin. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Vacaville that the approximately 0.6 acre of APN 0125-060-010 is deemed surplus right-of-way and may be dedicated to the County of Solano in lieu of the City share of design and construction costs for the Vaca Valley Road Improvement project; and that the Director of Public Works be authorized to execute any agreements with the County and/or any necessary documents to transfer the public right-of-way.
