C. M. RECOMMENDATIONS: 1. Approve the attached Agreement of Sale between Jaime Lee Bautista ( Seller ) and the County Board of Arlington County, Virginia ( Purchaser ) for the purchase of the real property and improvements known as 1 18 th St. N., Arlington, Virginia (RPC# 11-019-00). 2. Authorize the Real Estate Bureau Chief, Department of Environmental Services, or his designee, to execute the Agreement of Sale and all related documents necessary for the acquisition of the Property, subject to approval as to form of all documents by the County Attorney. ISSUES: There are no outstanding issues. SUMMARY: This Agenda Item concerns an acquisition of property, improved with a residential structure, for future expansion of Benjamin Banneker Park. The Agreement of Sale, attached hereto as Exhibit A, is an offer from the Seller to sell fee simple interest in the property to the County Board for a purchase price of $37,00.00. The property, adjacent to Benjamin Banneker Park, is located at 1 18th St. N. (see Vicinity Maps at Attachments 1, 2 and 3). BACKGROUND: The property, located on the south side of 18th Street North between North Underwood and North Tuckahoe Streets, abuts Benjamin Banneker Park and is more particularly described in the legal description of the attached Agreement of Sale. The property is approximately 8,20 square feet in size. DISCUSSION: In January 201, County staff sent letters of interest to the property owners of two parcels on the south side of 18 th Street North that are adjacent to the park. County staff was recently contacted by the owner of the subject property (Jaime Bautista) inquiring as to whether County Manager: ##### County Attorney: ***** 1. the County might be interested in purchasing the property, because it abuts Benjamin Banneker Park. The house, located on the property, is currently occupied by tenants of the owner. The house is a modest Colonial Revival-styled house in the Cape Cod form constructed in 1938. The County s Office of Community, Planning and Housing Development, Historic Preservation, has researched the history of the property and determined that the property was evaluated in 2009 as part of a multi-phase County-wide architectural survey. The house is neither listed individually or within an Arlington Historic District, nor is it listed in the National Register of Historic Places either individually or as part of a historic district. The property is identified in the Public Spaces Master Plan (PSMP) for acquisition to expand Benjamin Banneker Park. The other parcels along the south side of 18 th Street North from North Van Buren to North Tuckahoe Street are specifically identified in Appendix K to the 200 Public Spaces Master Plan (PSMP) as potential public acquisition sites and were previously identified in the 199 Open Space Master Plan (OSMP). Three other parcels on 18 th Street North were acquired for Benjamin Banneker Park between 1993-199, when the County was acquiring properties or easements in this area related to the Four Mile Run Flood Control Project. Two other parcels were purchased by the County in 1997 and 200. The Seller was contacted during that time period, but chose not to sell his property to the County at that time. The County recently purchased the property (two lots away from the subject property) at 08 18 th Street N. in April 201. The deconstruction of the previously purchased house is planned for late 201 to early 201. Settlement of the County s acquisition will likely not take place until late spring of 201 to accommodate a potential tax deferred exchange by the seller. Following settlement, the residential structure presently on the subject property would be deconstructed, removed and the site restored for future expansion of Benjamin Banneker Park. The property is adjacent to Four Mile Run stream and abuts the existing playground of the park. The sales price is consistent with an appraisal obtained by the County from a licensed Virginia real estate appraiser in September 201. The proposed Agreement of Sale, attached as Exhibit A, contains the Seller s offer to sell the property to the County for the amount of $37,00.00. FISCAL IMPACT: The acquisition cost of the property ($37,00.00), associated closing costs of approximately $,000.00 and future expenses for the house removal and site restoration of approximately $0,000 will be allocated from park land acquisition funds (32.80001.80001.LA.R1.PC1). The County s Park Land Acquisition Program started Fiscal Year 201 with a combined bond and pay-as-you-go balance of $.39 million. The Board recently approved the purchase of the property at 2827 N. Harrison St. property, which will be closing soon. After that purchase and associated costs are complete, there will be a program balance of approximately $3.0 million. After the completion of the recommended purchase of the subject property for expansion of Benjamin Banneker Park, removal of the house and restoration of the site, the program balance will be $2.3 million. - 2 -
