Captain's Walk Homeowners Association Quick Reference Handbook We are pleased to provide the homeowners of Captain's Walk with a handbook for quick reference to important community information including the following: The Management Company Useful information and Contacts Architectural Control House Rules and Use of Property Restrictions Clubhouse I Pool Rules Sanitation All homeowners are strongly encouraged to review this handbook. We all want this community to function in an atmosphere of mutual respect and friendliness. Therefore, careful attention should be given to the House Rules. Covenants and Restrictions. It is important that all of us have dear and accurate knowledge of our community responsibilities. We hope you will find this handbook useful and informative. The Homeowners Association The Homeowners Association was formed to own, operate and maintain the Common Properties and to provide for certain exterior maintenance of the Homes for the benefit of the members of the Association. The Association is governed by a Board of Directors, consisting of between three and seven members. Who are elected at the Annual Meeting held each September. The officers of the Association are chosen by the Board of Directors. The Board of Directors is responsible for enforcing all the Covenants, Restrictions, By-laws, Rules and Regulations of the Homeowners Association. The current Board members are listed on the website. Meetings of the Homeowners Association open to all members of the community are held on the second Thursday of January, March, May, July, September and November at 7:00 PM in the clubhouse. The Board meets in closed session after all these meetings and during the alternate months. The Management Company Captain's Walk Homeowners Association contracts Long Island Management Services (LIMS) as our management company. The contact information for LIMS is as follows:

After regular hours, including weekends and holidays, an answering service will contact the staff in the case of emergency. Any requests to the Board of Directors and non-emergency items that require attention must be emailed or faxed in writing to UMS. LIMS will notify the Board of Directors of the request. Homeowners should provide up-to-date contact information to UMS to ensure they receive all communications. No building, fence, wall or other structure, or change or alteration to the exterior of the home or landscaping shall be commenced, erected or maintained upon the property, nor shall any exterior addition to or change or alteration of any kind thereto be made until the plans and specifications showing the nature, kind, shape, height, materials, color and locations of the same have been submitted to the Board of Directors via LIMS. The Board of Directors will have sixty {60) days to evaluate design and locations after plans and specifications have been submitted, including review with adjacent property owners should request include adding or modifying existing exterior structures. HOMEOWNERS SHOULD SUBMIT APPROVAL REQUESTS BEFORE THE MONTHLY BOARD MEETING. REQUESTS SUBMITIED SHORTLY AFTER A MEETING MAY NOT BE DECIDED UNTIL THE NEXT MONTHLY MEETING. Homeowners are required to secure any permits that may be required from governmental agencies under jurisdiction. All contractors working in Captain's Walk must be licensed and insured. Rentals are not permitted at Captain s Walk.

a) Homes and areas restricted to the homeowners use shall be maintained in good repair and overall appearance. Necessary repairs/maintenance work to the exterior of homes should be performed promptly and in accordance with Architectural Control requirements. Any repair not done within 90 days of notification may be performed by a contractor selected by the Homeowners Association/LIMS Management and the cost will be added to the homeowner's common charge account. b) Any homeowner who mortgages, re-mortgages or sells their Home, or changes ownership or title of their home, shall Notify the Board of Directors by providing written documentation providing the names and address of their mortgagee or new owner to UMS. c) The Board of Directors shall, at the request of the mortgagee of the Home, report any delinquent assessments due from the homeowner. d) No nuisances shall be allowed upon the property nor shall any use or practice be allowed which is a source of annoyance to residents or which interferes with the peaceful possession and proper use of the property by its residents, e} No improper, offensive or unlawful use shall be made of the property nor any part thereof and all valid laws, inducing zoning ordinances and regulations of a!l governmental bodies having jurisdiction thereof, shall be observed. All homes shall be used for residential purposes only. f) Regulations promulgated by the Board of Directors concerning the use of the property shall be observed by the homeowners, provided, however, that copies of such regulations are furnished to each homeowner prior to the time that said regulation becomes effective. g) Maintenance assessments shall be paid when due and are considered late if received after the of the month, Ali late payments will be assessed a $65.00 late fee. h) Homeowners must maintain proper homeowners insurance, appropriate for a Homeowners Association community {not condo or coop) and submit proof of insurance to LIMS. i) Ali dogs must be leashed and shall not be permitted to run loose. Homeowners are responsible for cleaning up after their pets. j) No resident shall post any advertisement or posters of any kind.in or on the property except as authorized by the Board of Directors. k) No fence or gate shall be erected on the property without prior written consent of the Board of Directors.

I) No television or radio antenna or any type of receiving or transmitting antenna or structure shall be erected on the exterior of the home or on any unit without prior consent of the Board of Directors. m) No solar panels may be installed at Captain's Walk. n) No homeowner shall move, remove, add or otherwise change the landscaping on the property except that each homeowner may landscape or garden in their own restricted area in the rear of the house, provided that no unsightly use or vegetation may be grown in such areas. Ali landscaping changes in the front of the house need approval from the Board of Directors o) No homeowner shall install or permit to be installed any window-mounted or throughthe-wall mounted air conditioning in their home. p) No privacy area shall be enclosed, decorated or covered by any awning or otherwise without the consent in writing of the Board of Directors. q) The restricted patio area (decks) shall not be used for storage of furniture or otherwise for storage purposes. These areas shall not contain excessive furniture nor should the homeowner erect or construct any locker or storage containers thereon. r) No person (homeowner, guest, contractor etc.) shall park a vehicle or otherwise obstruct any resident's use of ingress or egress to any parking space or garage. s) To minimize congestion on Captain's Walk roadways, parking should only be in driveways and the following designated areas: the two designated parking spaces between units #2 and #3; the two designated parking spaces between units #24 and #25; and the designated spaces across from the clubhouse. Overnight parking on Captain's Walk roadways is prohibited. If there is no available parking within Captain's Walk, homeowners and their guests should park on W. Shore Road. t) Homeowners should not occupy visitor spaces whenever parking space is available in their own driveway or garage. u) No repair of motor vehicles shall be made in any of the roadways, driveways or parking areas nor shall such areas be used for storage parking of any boat, trailer, camper, bus, truck or commercial vehicle. v) No unregistered vehicles shall be stored anywhere in Captain's Walk except inside garages. w) Visitor spaces should not be used for long-term storage of vehicles.

x) For security purposes, homeowners are requested to leave on the lights outside their garages from dusk to dawn. y) All trash must be put out to the curb in a trash container with a secured lid. Trash containers may only be placed at the curb the evening before pick-up, and should be promptly removed the next morning. Garbage cans must be stored in each home or the garage of each home. z) No homeowner shall make or permit any disturbing noises in any building or do or permit anything to be done therein, which will interfere with the rights, comforts or conveniences of other homeowners. aa) No person shall be permitted to use the recreational facilities of the community except in accordance with the rules and regulations established by the Board of Directors. bb) Docking of watercraft at the T-dock or bulkhead is not permitted except for short-term pick up or discharging of passengers. cc) Any homeowner who enters into a lease of their home without first submitting a copy of the lease along with a certified check for 25% of the rent to be collected for an annual rental to be held as deposit in an interest bearing account by the Board of Directors, or falsifies any information contained in the lease, will be assessed a penalty of $100.00 per day, commencing from the time at which said tenant first illegally occupies the home. dd)gas meters must be screened by evergreen shrubs or a fence similar to other Captain's Walk fences so that they are not visible from the road or adjacent properties. ee) Violation of Captain's Walk By-Laws or community rules may be subject to a fine determined by the Board of Directors and added to the homeowners monthly bill. Clubhouse I Pool Rules The community enjoys the benefit of a clubhouse and swimming pool, which is operated for the benefit and enjoyment of homeowners and their guests. Only homeowners in good standing and their guests are permitted use of the clubhouse and pool.

Use of the pool is at the sole risk and expense of the homeowner and their tenant or guest. An audit must accompany all children twelve (12) years or younger. As a courtesy to residents, homeowners are requested to limit the number of their guests occupying poolside chairs and tables when other residents are using the pool area. The pool area and clubhouse are NO SMOKING areas. Homeowners are requested to notify their guests of this policy. Any homeowner Interested in utilizing the clubhouse and/or pool for an event/party must place a request in writing to LIMS, who will secure approval from the HOA Board. These facilities may not be used for any commercial purposes. The homeowner is responsible for cleaning up after the party or hiring a commercial cleaning service. If the clubhouse is not properly cleaned after an event/party, LlMS will hire a cleaning service and bill the homeowner. Hours of Operation Normal operating hours are from noon to 6PM, weekends only from Memorial Day through July 3rd. The pool is open from Noon to 6PM, seven days a week, from July 4 th up to and including Labor Day weekend. Pool attendants are present during normal hours of operation. If utilizing the pool after normal hours, homeowners must comply with the following: Ensure solar cover is on the pool Close any umbrellas in use Put back ail chairs and lounges Lock clubhouse Lock gates Sanitary Regulations The pool is subject to spot inspections from the Suffolk County Department of Health. All sanitary regulations must be observed to avoid dosing of the pool by a Health Inspector as well as out of consideration for fellow homeowners. The following New York State Sanitary Codes must be adhered to: 630 Pollution of a swimming pool is prohibited. Urinating, expectorating or blowing one's nose in any swimming pool is prohibited 6.31 Communicable diseases. No person having skin lesions, sores or inflamed Eyes, mouth, nose or ear discharges,. or who is known to be a carrier of microorganisms of any communicable disease, shall use any swimming pool or bathing beach.

The following are not permitted within the pool/ pool area, unless otherwise designated: Glass or glass containers Eating. Eating is permitted on tables or in other designated areas.. Provided they are at least 4 feet from the swimming pool. Littering Infants wearing diapers Spitting Running on the pool deck Excessive splashing of water Diving Inappropriate bathing attire Pets Toys, other than pool type toy Sanitation Schedule Captains Walk utilizes a private carting company. Trash is collected from the curb in front of your driveway early Tuesday and Friday mornings. It is recommended that you put trash out the previous evening in a covered animal-proof container. In the event of a holiday, trash will be collected the next day, Separation of recyclables is handled by the carting company. Shredding of private and secure information is recommended before discarding.
