STAFF REPORT Subject: Masonic Road Dedications Date: December 20, 2016 ISSUE: Should the Chair sign dedications to provide a utility and access easement, and to quit claim vacated Right of Way to the Young Family Ranch? BACKGROUND The Weaverville Townsite Map shows the private property divisions from public lands. The 1870 s map intended result was to delineate what was public and what was private, to establish lots, and further subdivide to show ownership. Public lands for parks, schools and government buildings were dedicated as part of a lot, and the area between the lots was dedicated later as road Right of Way. At that time, most, if not all, of the roads were either trails, or dirt roads. Over time, alignments were no longer used, and returned to nature. Roads that remained were later accepted into the County Maintained Road System by the Streets and Highways Code. The roads no longer in use were left in limbo as part of the Road Right of Way system, yet not within the County Maintained Road System. Because these areas are shown on the Townsite Map (a paper map), they are thus known as paper roads. The Board took action at the November 12, 2014 meeting to vacate several of these roads. These locations included (See Exhibit A); Masonic Avenue, between but not including Oregon Street and Odd Fellows Avenue (Paper Road) Odd Fellows Avenue (Paper Road), between but not including Masonic Avenue and the current Odd Fellows Avenue China Avenue, between the current Odd Fellows Avenue and Masonic Avenue Society Avenue, between but not including Odd Fellows Avenue and Masonic Avenue DISCUSSION: The Young Family Ranch, a non-profit public benefit trust in partnership with the Trinity Trust and the Humboldt Area Foundation, constructed a restroom which straddled the property line with the Cemetery. The Trust and County agreed to work together and revise the location of the property line. This required that the property first be vacated, then a lot line adjustment be done to revise the desired configuration. Because both properties are encumbered by community requirements, and the uses are long standing, there is no value in the property other than to the public for public usage. Upon this vacation, working with the County Surveyor, Cemetery Committee, and the Surveyor for the Trust, the quit claim deed and an access and utility easement dedication has been
prepared. The final configuration ensures that all burial plots are on cemetery property; all buildings for Young Family Ranch area on the other side of the property line; and the newly constructed bathroom will have shared public use. ALTERNATIVES INCLUDING FINANCIAL IMPLICATION: 1. Authorize the Chair to execute the quit claim, and utility and access easement offering, authorize the Director of Transportation to prepare documentation as required, and authorize the recording of the quit claim deed and record of survey. 2. Do not take action. Provide direction. RECOMMENDATION: The final record of survey will memorialize the utility and access easement, and quit claim dedication and further provide a clear property description for the cemetery removing all paper roads that were vacated by the November 12, 2014.
