AGENDA: JANUARY 12, 1999 December 30, 1998 SUBJECT: SUMMARY VACATION AND QUIT CLAIM OF A STORM DRAIN EASEMENT 2800 ROSEDALE AVE - APN 030-253-47 Members of the Board: As previously directed by your Board on November 24, 1998, the Real Property Division has prepared the necessary documents to summarily vacate and quit claim a 10 foot wide storm drain easement that was offered for dedication running along the southern boundary of the above referenced property. This 1988 offer was never formally accepted by the County and is not anticipated to be needed in the forseeable future. In exchange for this summary vacation and quit claim, the owners of said property have agreed to the cost of $500.00. It is therefore recommended that the Board of Supervisors take the following action: 1. Adopt the attached resolution vacating the storm drain easement. 2. Adopt the attached resolution approving the quit claim and authorize the Chairperson of the Board of Supervisors to sign the attached deed. 3. Approve the payment to the County of Santa Cruz in the sum of $500.00 in exchange for the summary vacation and quit claim.

On the motion of Supervisor duly seconded by Supervisor the following resolution is adopted: RESOLUTION AUTHORIZING EXECUTION OF QUIT CLAIM DEED FOR SALE OF SURPLUS COUNTY STORM DRAIN EASEMENT RESOLVED by the Board of Supervisors of the County of Santa Cruz, State of California: WHEREAS, the County of Santa Cruz acquired an offer of dedication for a storm drain easement in that certain real property described as Lot A on Minor Land Division parcel map 48 PM 57 recorded March 22, 1988 and said offer of dedication was never formally accepted; and WHEREAS, said real property is not required for county purposes and has not been used as a storm drain nor has any public money been expended, and it appears in the best interest of the County to sell said interest in said property; and WHEREAS, Rodney W. Herd and Tina M. Herd, owners of the property, have offered to purchase said real property interest from the County of Santa Cruz for $500.00 cash, which amount has been determined to be reasonable and proper by the Real Property Division. NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the Board of Supervisors on behalf of the County of Santa Cruz pursuant to Streets and Highways Code Section 8356 that the real property offered for dedication as a storm drain easement in Lot A on Minor Land Division parcel map 48 PM 57 is hereby sold to Rodney W. Herd and Tina M. Herd for $500.00 and the Chairperson of the Board of Supervisors is hereby authorized and directed to execute a Quit Claim Deed for said property interest to the above designated purchasers.
