CONSENT AGENDA: C-1. 10BAR-00000-00178 Agujas Canyon Guest House, Garage and Barn Gaviota 11CDH-00000-00018 (Errin Briggs, Planner) Jurisdiction: Coastal, Ridgeline Rural Request of Dan Weber and Steve Willson, agents for the owner, Steve Cegelski, to consider Case No. 10BAR-00000-00178 for final approval on consent of a guest house with attached garage of approximately 1,895 square feet, main residence garage of approximately 1,160 square feet and barn of approximately 1,728 square feet. The following structures currently exist on the parcel: a residence of approximately 3,100 square feet, attached garage of approximately 450 square feet and shed of approximately 300 square feet. The proposed project will require approximately 750 cubic yards of cut and fill. The property is a 100.51 acre parcel zoned AG-II-320 and shown as Assessor s Parcel Number 083-680-004, located at Parcel 53, Hollister Ranch in the Gaviota area, Third Supervisorial District. (Continued from 12/10/10 & 1/13/12 & 11/09/12) ACTION: Ettinger moved, seconded by Miller-Fisher and carried by a vote of 6 to 0 (Brady abstained) to grant final approval on consent of 10BAR-00000-00178. V. CBAR MEMBERS INFORMATIONAL BRIEFINGS: GREG DONOVAN expressed his appreciation of Brett Ettinger s attendance and participation in all CBAR meetings. PUCK ERICKSON-LOHNAS noted that there have been a number of projects triggering CBAR review under Ridgeline and Hillside Development Guidelines which have not particularly required the additional scrutiny, and more importantly, noted that others which did not trigger review have resulted in considerable skyline intrusion from public roads in the Santa Ynez Valley and would have benefited from additional review. LOWELL LASH inquired about a property along SR 154 with pepper trees which are in conflict with a CBAR-approved Landscape Plan as well as SYVCP policies. VI. VII. STAFF UPDATE: JOHN KARAMITSOS reported on: 1) the Mattei s Tavern project, to be presented to the Planning Commission with a staff recommendation for approval on December 19 th, and the staff report and other documents available online at the P&D website; 2) the Coastal Development Permit application / Coastal Commission review process; 3) the department reorganization, directing inquiries beyond the brief information provided to the Director, Glenn Russell; 4) staff assignments for CBAR and NBAR with Zoraida Abresch assuming responsibility for CBAR and John Karamitsos for the NBAR; and 5) the Ridgeline and Hillside Development Guidelines Exemption provisions. STANDARD AGENDA: 1. 12BAR-00000-00104 Bell Street Development, LLC Storage Los Alamos 12LUP-00000-00200 (Joyce Gerber, Planner) Jurisdiction: Commercial Request of Urban Planning Concepts, Inc., Frances Romero, agent for the owner, Bell Street Development, LLC, to consider Case No. 12BAR-00000-00104 for preliminary/final approval of eight storage structures ( C-trains ) each measuring 40 x 8 feet (320 square feet each, total of 2,560 square feet) and one storage unit of approximately 200 square feet for a total of gross floor area of approximately 2,760 square feet. Two of the C-train containers will remain in place. Six will be relocated from their present position to a row along the property line close to Highway 101. Additional C-train containers could be added in the future, with the restriction that the total area occupied by personal storage containers remains less than 5,000 square feet. The project would also allow development for a parking lot totaling up to but not exceed 20,000 square feet for the parking of boats, Recreational Vehicles and other

Page 3 vehicles. The following structures currently exist on the parcel: a residence of approximately 3,500 square feet and storage structure of approximately 500 square feet. The proposed project will not require grading. The property is a 2.03 acre parcel zoned C-3 and shown as Assessor s Parcel Number 101-260-059, located at 825 Bell Street in the Los Alamos area, Third Supervisorial District. (Continued from 7/13/12, 8/17/12, 9/14/12 & 10/12/12) PUBLIC COMMENT: Barbara Rose (in opposition). Read letter from Vineyard Oaks HOA, dated 11/12/12. a. Applicant has adequately addressed the Bell Street landscaping concerns of the CBAR. The community should consider pursuit of a beautification project/grant to increase landscaping within County Rights-of-Way. b. The pathway has been extended to the street corner (See Sheet L.5). c. The chain link fencing must be covered with well-maintained vines. Because vines are difficult to maintain, black vinyl clad fencing is requured for all newly installed chain link. d. Replacement oaks along the US 101 frontage should be addressed through a binding condition as additional pine trees in this location die. This can be accomplished through a revision to Note 10 on Sheet CL-1 which changes immediate to immediate and future. e. Cistus should be blanche and not ladanfer. Cistus listed on plant list is correct. f. Delete Quercus tomentella. Use Agrifolia instead. g. The site plan should indicate the placement of the storage structures (C-trains). ACTION: Erickson moved, seconded by Donovan and carried by a vote of 6 to 0 (Miller- Fisher opposed) to grant preliminary and final approval of 12BAR-00000-00104. 2. 12BAR-00000-00182 Chisan Orchids Nursery Modular Office Los Alamos 12LUP-00000-00359 (Florence Trotter, Planner) Jurisdiction: Commercial Request of OMNICO and Joe Kim, agents and for the Chisan Orchids Nursery, to consider Case No. 12BAR-00000-00182 for further conceptual review/preliminary approval of a proposed modular office of approximately 480 square feet. The following structures currently exist on the parcel: four structures of green houses, three employee houses, a fire water tank, a water reservoir and landscape. The proposed project will not require grading. The property is a 50 acre parcel zoned AC and shown as Assessor s Parcel Number 133-130-009, located at 9676 Harvest Road in the Los Alamos area, Third Supervisorial District. (Continued from 11/09/12) a. The awning should be extended, at a minimum, to cover the entire porch, and ideally to the end of the building, incorporating the area above the window. b. The entire base/skirt of the building must be the same color, a darker brown. c. The building should be dark grey, with the air conditioner painted to match. d. Trim could be all the same color, with green around windows and doors. e. Factory available colors should be adequate, but must be depicted on plans, and included on an acceptable color/materials board to be presented at the next meeting. ACTION: Ettinger moved, seconded by Lash and carried by a vote of 7 to 0 to grant preliminary approval of 12BAR-00000-00182. Applicant may return for final approval full board. 3. 12BAR-00000-00138 Rancheros Visitadores New Residence with Grading Solvang 12LUP-00000-00274 (Tammy Luna Weber, Planner) Jurisdiction: Design Overlay Request of Brian Schwartz, agent for the owner, Rancheros Visitadores, to consider Case No. 12BAR-00000-000138 for preliminary approval of a new residence of approximately 2,373 square feet and porch of approximately 820 square feet. The following structures currently

Page 4 exist on the parcel: three agricultural structures of approximately 1,780 square feet, 1,192 square feet, and 1,780 square feet. The proposed project will require approximately 428 cubic yards of cut and approximately 457 cubic yards of fill. The property is a 10.75 acre parcel zoned AG-I-10 and shown as Assessor s Parcel Number 137-110-041, located at 1090 Alamo Pintado in the Solvang area, Third Supervisorial District. (Continued from 8/17/12 & 11/09/12) a. Planner to determine if appropriate to return for Preliminary/Final review and approval. Site Design: b. Consider replacing the hammer-head turn-around with a circular driveway extending beyond the current entry point. c. The parking area should have a less formal character to integrate with the historic nature of the structure. Architecture: d. Plaster to be integrally colored. e. Consider the location and connectivity of the trellis to the main structure; specify dimensions of the trellis posts. f. The hardscape details are missing; consider using Saltillo tiles and/or decomposed granite around the edges to define the courtyard space. g. A hardscape plan, including parking areas, will be required. h. Add a small grouping of oaks at the exposed edge of the courtyard to screen this area from the barn. i. It is unfortunate that the pepper trees along the existing driveway create such a strong linear feeling; consider a program to phase out the peppers over time and through senescence. j. Consider a privet hedge removal program which replaces this landscaping as soon as possible. k. Consider Cecil Brunner (pink) and Lady Banks (yellow) roses for vine selections. ACTION: Clough moved, seconded by Miller-Fisher and carried by a vote of 7 to 0 to continue 12BAR-00000-00138 for preliminary and final approval. 4. 12BAR-00000-00209 Metro PCS at First Baptist Church Solvang 12CUP-00000-00036 (Brian Banks, Planner) Jurisdiction: Condition of Permit Request of Jerry Ambrose, agent for the applicant, MetroPCS, to consider Case No. 12BAR-00000-00209 for conceptual review of a new wireless telecommunications facility. The antennas would be mounted within a proposed 8 foot high steeple extension and screened from view, and the equipment would be located in a 286 square foot block wall equipment enclosure adjacent to the church building. The following structure currently exists on the parcel: Church building of approximately 6,500 square feet. The proposed project will not require grading. The property is a 2.83-acre/square foot parcel zoned1-e-1and shown as Assessor s Parcel Number 139-063-010, located at 2667 Janin Way in the Solvang area, Third Supervisorial District. PUBLIC COMMENT: Arthur Chapman (in opposition). Site Design: a. Provide an elevation survey that depicts proposed walls and notes if changes to existing grades are proposed.

Page 5 b. The berm should remain unchanged to complement the beautiful structure and setting, and the proposed vault should be integrated into the grade. The need for adequate space to accommodate a pedestrian door is recognized. Architecture: c. Provide a detailed cross-section of the project through the upper portion of the steeple to depict the integration of proposed additions to the existing structure. d. Provide additional photos, with close up views depicting masonry materials and other details. e. Consider the SR 246 public viewshed in the proposed landscape plan; the Chumash Casino frontage provides a positive example. Project received conceptual review only, no action was taken. Applicant was asked to return for further conceptual review. Bartoo New Residence, 5. 12BAR-00000-00217 Garage, Covered Patios and Pool Building Santa Ynez 12LUP-00000-00217 (Tammy Weber, Planner) Jurisdiction: Ridgeline- Rural Request of David Goldstien, architect for the owners, Roy and Theresa Bartoo, to consider Case No. 12BAR-00000-00217 for conceptual review of a new residence of approximately 5,653 square feet, attached garage of approximately 1,865 square feet, covered patios of approximately 1,452 square feet and pool building of approximately 136 square feet. The following structures currently exist on the parcel: a residence of approximately 2,481 square feet, barn with an apartment of approximately 3,145 square feet and storage shed of approximately 2,040 square feet. The proposed project will require approximately 6,100 cubic yards of cut and fill. The property is a 36.22 acre parcel zoned AG-I-20 and shown as Assessor s Parcel Number 135-040-043 located at 2396 N. Refugio in the Santa Ynez area, Third Supervisorial District. a. CBAR input at today s meeting is limited based on the need to receive P&D input on the careful consideration of appropriate increases in grading in order to reduce visibility and/or skylining of the proposed structure. b. The proposed structure is likely to result in skyline intrusion, which is precluded by Ordinance. Additional data, consisting of cross-sections and a photo-assay, regarding visibility from SR 154 and Refugio Road is necessary prior to a CBAR determination regarding the need for story poles and/or a site visit. Site Design: c. Carefully review the Ridgeline and Hillside Development Guidelines for direction on addressing site design issues. Think holistically regarding development on the knoll. d. Consider providing an assessment of other potential locations for development on the project site. Architecture: e. The architectural renderings are beautiful, but appear to be designed for a flat lot. Consider articulation and stepping of the structure and rooflines in response to existing topography. f. Darker colors will be needed to create the perception of the structure receding into the landscape. g. The fencing should be carefully considered; earthtone colors are preferred over white, which should be avoided. h. A hardscape plan, including parking areas, will be required. i. Carefully consider landscaping on the knoll. Improperly selected species and the improper location of landscaping can negatively affect site visibility. Also consider the effects of wind in developing the landscape plan.

Applicant was asked to return for further conceptual review. 6. 12BAR-00000-00208 Bower Winery Addition Santa Ynez 12LUP-00000-00403 (Tammy Weber, Planner) Jurisdiction: Ridgeline - Rural Request of Jones and Jones LLP, F. Evans Jones architect for the owner, Mr. Roger Bower, to consider Case No. 12BAR-00000-00208 for conceptual review of a winery addition: barrel storage of approximately 1,665 square feet, case storage of approximately 726 square feet, and conversion of existing garage to winery storage of approximately 1,868 square feet. The following structures currently exist on the parcel: a main residence of approximately 8,138 square feet, garage of approximately 2,094 square feet, a residential agricultural unit of approximately 2,094 square feet, farm employee dwellings (2) of approximately 3,578 square feet, agricultural structures (2) of approximately 4,156 square feet and winery buildings (2) of approximately 4,406 square feet The proposed project will not require grading. The property is a 103.77 acre parcel zoned AG-II-100 and shown as Assessor s Parcel Number 141-080-056, located at 1733 Fletcher Way in the Santa Ynez area, Third Supervisorial District. CBAR COMMENT: a. Preliminary/Final review and approval at the next meeting is appropriate, with a color board. The proposed is nice addition to a nice building. Project received conceptual review only, no action was taken. Applicant may return for preliminary/final approval. Rancho Guacamole 7. 12BAR-00000-00002 Single Family Dwelling Demo-Rebuild and New Accessory Structures 12LUP-00000-00287 (J. Ritterbeck, Planner) Gaviota Jurisdiction: Coastal Request of Britton Jewett, architect for the owner Stephen Bershad, to consider Case No.12BAR-00000-00002 for final approval of the demolition of an existing 1,535 square foot residence with a 171 square foot screened in porch and 400 square foot terrace and 2 attached guesthouses totaling approximately 887 square feet; construction of a new residence of approximately 3,327 square feet with covered terrace of approximately 1,580 square feet and a 588 square foot 2-car garage; new guest house of approximately 717 square feet with covered terrace of approximately 165 square feet and a 468 square foot 1- car garage; and a new, approximately 862 square foot workshop, a new 1,410 square foot hay storage barn, new approximately 1,208 square foot stables and a new approximately 8,611 covered arena/dressage area. The following structures currently exist on the parcel: a residence of approximately 1,535 square feet with screened porch of approximately 171 square feet and covered terrace of approximately 400 square feet, attached guesthouses totaling approximately 887 square feet, as well as several accessory structures related to the agricultural operations on the property. The proposed project will require approximately 2,280 cubic yards of cut and approximately 2,260 cubic yards of fill. The property is 448.84 acres, zoned Ag-II- 100 and shown as Assessor s Parcel Number 081-200-017, located at 575 Refugio Road in the Gaviota area, Third Supervisorial District. (Continued from 2/10/12 & 11/09/12) a. Consistent with Ridgeline and Hillside Development Guidelines (LUDC Section 35.62.040.B.2.b.), the CBAR finds that the location and height of the proposed agricultural structure are appropriate and will better serve the interest of good design without negatively affecting neighborhood compatibility or the surrounding viewshed. This determination includes recognition that the 16 foot drop in elevation from the

Page 7 proposed structure is the result of a cut slope created during the development of an existing road adjacent to the project site. b. Final review and approval at the next meeting is appropriate, with the provision of all plans, details, and a Color Board. c. The fencing needs to be darker in order to represent a natural color. ACTION: Erickson moved, seconded by Ettinger and carried by a vote of 7 to 0 to grant preliminary approval of 12BAR-00000-00002. Applicant may return for final approval on consent. 8. 12BAR-00000-00222 Chouinard Workshop/Storage Addition Gaviota 12CDH-00000-00040 (No Assigned Planner) Jurisdiction: Coastal Request of Jennifer Siemens, Dudek and Associates, agent, Neumann Mendro Andrulaitis, architects for the owner, Yvon Chouinard, to consider Case No. 12BAR-00000-00222 for conceptual review of a workshop/storage addition of approximately 545 square feet to the detached garage. The following structures currently exist on the parcel: a residence of approximately 1,802 square feet and detached garage of approximately 651 square feet. The proposed project will require approximately 38 cubic yards of cut and approximately 8 cubic yards of fill. The property is a 100.99 acre parcel zoned AG-II-320 and shown as Assessor s Parcel Number 083-670-008, located at Lot 33 Hollister Ranch in the Gaviota area, Third Supervisorial District. CBAR COMMENT: a. Preliminary/Final review and approval, with the full Board, at the next meeting is appropriate. A nice project, it is well-integrated with existing development.
