MINUTES OF MEETING TO ADOPT PROPOSED REVITALIZATION PLAN DRA (419241-64) Marion, Iowa May 18, 2017 A meeting of the Council of the City of Marion, Iowa, was held at the Marion City Hall, 1225 6 th Avenue, in the City, at 5:30 o clock p.m., on May 18, 2017. The Mayor presided and the roll was called, showing members present and absent as follows: Present: Absent:. The Mayor announced that this was the time and place set for hearing upon the designation of the 2017 Workforce Housing Urban Revitalization Area and the Proposed Plan for the 2017 Workforce Housing Urban Revitalization Area. All written objections, statements, and evidence heretofore filed were reported to the City Council, and all oral objections, statements, and all other exhibits presented were considered. A Resolution Adopting the Proposed Plan for the 2017 Workforce Housing Urban Revitalization Area WHEREAS, pursuant to the provisions of Chapter 404 of the Code of Iowa (the Act ) the City of Marion, Iowa (the City ), may designate an area of the City as an urban revitalization area, if that area meets the criteria of Section 1 of said Chapter 404; and WHEREAS, the City Council of the City did find and determine that an area within the City identified by previous resolution as the 2017 Workforce Housing Urban Revitalization Area meets the criteria of Section 1 of said Chapter 404; and WHEREAS, pursuant to the provisions of the Act, before designating any area to be an urban revitalization area, the City must prepare a proposed Plan (the Plan ) for such revitalization area and hold certain public hearings thereon; and WHEREAS, after published notice thereof was given, as required by the Act, the City Council of the City did, on May 18, 2017, hold a public hearing on the designation of the 2017 Workforce Housing Urban Revitalization Area and the Plan therefor and considered all objections, comments, and evidence there presented; and WHEREAS, the City has received a valid waiver of the right to receive mailed notice of the public hearing and of the right to petition for a second public hearing regarding the establishment of the 2017 Workforce Housing Urban Revitalization Area from all private property owners of real property lying within the 2017 Workforce Housing Urban Revitalization Area; NOW, THEREFORE, It Is Resolved by the City Council of the City of Marion, Iowa, as follows: Section 1. hereby adopted. The Plan for the 2017 Workforce Housing Urban Revitalization Area is Section 2. Marion/419241-64/urban revite plan URBAN REVITALIZATION PLAN CITY OF MARION, IOWA 2017 WORKFORCE HOUSING URBAN REVITALIZATION AREA

Marion/419241-64/urban revite plan INTRODUCTION The Urban Revitalization Act, Chapter 404 of the Code of Iowa, is intended to encourage development, redevelopment and revitalization within designated areas of a city by authorizing property tax development incentives to the private sector. Qualified real estate within a designated area may be eligible to receive a total or partial exemption from property taxes on improvements for a specified number of years, with the goal of providing communities with a long-term increase or stabilization in the local tax base by encouraging new construction which might not otherwise occur. Section 404.1 of the Code of Iowa provides that a City Council may designate an area of the City as a revitalization area, if that area meets the following definitions: An area in which there is a predominance of buildings or improvements, whether residential or nonresidential, which by reason of dilapidation, deterioration, obsolescence, inadequate provision for ventilation, light, air, sanitation, or open spaces, high density of population and overcrowding, the existence of conditions which endanger life or property by fire and other causes or a combination of such factors, is conducive to ill health, transmission of disease, infant mortality, juvenile delinquency or crime and which is detrimental to the public health, safety, or welfare. An area which by reason of the presence of a substantial number of deteriorated or deteriorating structures, predominance of defective or inadequate street layout, incompatible land use relationships, faulty lot layout in relation to size, adequacy, accessibility or usefulness, unsanitary or unsafe conditions, deterioration of site or other improvements, diversity of ownership, tax or special assessment delinquency exceeding the actual value of the land, defective or unusual conditions of title, or the existence of conditions which endanger life or property by fire and other causes, or a combination of such factors, substantially impairs or arrests the sound growth of a municipality, retards the provision of housing accommodations or constitutes an economic or social liability and is a menace to the public health, safety, or welfare in its present condition and use; An area in which there is a predominance of buildings or improvements which by reason of age, history, architecture or significance should be preserved or restored to productive use. An area which is appropriate as an economic development area as defined in Section 403.17 of the Code of Iowa. An area designated as appropriate for public improvements related to housing and residential development, or construction of housing and residential development including single or multifamily housing ; and Section 404.2 of the Code of Iowa requires that a city prepare a plan to govern activities within the proposed revitalization area, and the balance of this document is intended to set out the elements of a plan that are mandated by state law. -1- DORSEY & WHITNEY LLP, ATTORNEYS, DES MOINES, IOWA

DESCRIPTION OF THE AREA AND MAP The revitalization area shall be known as the 2017 Workforce Housing Urban Revitalization Area (the Revitalization Area ), and the legal description of real property to be included within the Revitalization Area is as follows: Certain real property situated in the City of Marion, County of Linn, State of Iowa more particularly described as follows: Iowa Lot 1, 2, 3 and 4 of Sunny Ridge Villas First Addition in the City of Marion, Linn County B. DESIGNATION CRITERIA 1. The Revitalization Area is an area which is appropriate as an economic development area as defined in Section 403.17 of the Code of Iowa. 2. The Revitalization Area is an area which is appropriate for public improvements related to housing and residential development, or construction of housing and residential development, including workforce housing. 3. The economic development and promotion of housing and residential development in the Revitalization Area is necessary in the interest of the public welfare of the residents of the City and the Revitalization Area substantially meets the criteria set forth in Section 404.1 of the Act. C. OBJECTIVES This plan is prepared in conformance with Section 404.2 of the Code of Iowa for the purpose of providing incentives and outlining procedures to enhance the potential for multifamily workforce housing in the Revitalization Area. Planning goals include revitalizing the area through the promotion of new construction of multifamily workforce housing, stabilizing and increasing the tax base and providing overall aesthetic improvement. D. PRESENT ZONING AND PROPOSED LAND USE The property within the Revitalization Area is zoned Planned Development Residential (PD-R) and specifically designated for multifamily workforce housing. The construction of new multifamily workforce housing is proposed in the Revitalization Area. E. PROPOSALS FOR EXPANDING CITY SERVICES The City proposes that, as it becomes financially feasible, the provision of municipal services to the Revitalization Area will be expanded and improved to meet the demands of new multifamily workforce housing. -2- DORSEY & WHITNEY LLP, ATTORNEYS, DES MOINES, IOWA

Marion/419241-64/urban revite plan F. ELIGIBLE IMPROVEMENTS AND EXEMPTIONS Multiresidential Improvements. The construction of new multiresidential facilities if such multiresidential property consists of three or more separate living quarters with at least seventy-five percent of the space used for residential purposes. Exemption: All qualified real estate assessed as multiresidential property is eligible to receive an exemption from taxation for a period of ten years as follows: For the first year, an exemption from taxation on 80% of the actual value added. For the second year, an exemption from taxation on 80% of the actual value added. For the third year, an exemption from taxation on 80% of the actual value added. For the fourth year, an exemption from taxation on 70% of the actual value added. For the fifth year, an exemption from taxation on 70% of the actual value added. For the sixth year, an exemption from taxation on 70% of the actual value added. For the seventh year, an exemption from taxation on 60% of the actual value added. For the eighth year, an exemption from taxation on 60% of the actual value added. For the ninth year, an exemption from taxation on 50% of the actual value added. For the tenth year, an exemption from taxation on 40% of the actual value added. Actual Value Added Actual value added by improvements, as used in this plan, means the actual value added as of the first year for which the exemption was received. In order to be eligible for tax abatement, the increase in actual value of the property must be at least 10%. All improvements, in order to be considered eligible, must be completed in conformance with all applicable regulations of the City of Marion, and must be completed during the time the Revitalization Area is designated by ordinance as a revitalization area. G. TIME FRAME Eligibility for tax abatement under this plan will exist after the date of the adoption of the ordinance designating the Revitalization Area, until, in the opinion of the City Council, the desired level of revitalization has been attained or economic conditions are such that the continuation of the exemption granted would cease to be of benefit to the City, in which case the City Council may repeal the ordinance, pursuant to Section 404.7 of the Code of Iowa. In the event the ordinance is repealed, all exemptions granted prior to such repeal shall continue until their expiration. H. APPLICATION PROCEDURES An application shall be filed for each new exemption claimed. The property owner must apply to the City for an exemption by February 1 st of the assessment year for which the exemption is first claimed. Marion/419241-64/urban revite plan The nature of the improvement, its cost, and the estimated or actual date of completion of the improvement. I. APPROVAL OF APPLICATIONS The City Council shall approve all applications submitted for completed projects if: 1. The project, as determined by the City Council, is in conformance with this plan; 2. The project is located within the Revitalization Area; and, 3. The improvements were made during the time the Revitalization Area was designated by ordinance as a revitalization area. All approved applications shall be forwarded to the County Assessor for review, pursuant to Section 404.5 of the Code of Iowa. The County Assessor shall make a physical review of all properties with approved applications. The County Assessor shall determine the increase in actual value for tax purposes due to the improvements and notify the applicant of the determination, which may be appealed to the local board of review pursuant to Section 441.37 of the Code of Iowa. After the initial tax exemption is granted, the County Assessor shall continue to grant the tax exemption for the time period specified on the approved application. The tax exemptions for the succeeding years shall be granted without the owner(s) having to file an application for succeeding years. J. OTHER SOURCES OF REVITALIZATION FUNDS The City anticipates no federal or state grants or loans for improvements in the Revitalization Area at this time other than those of conventional lending institutions at normal market rates. However, it is not the intention of the City to prohibit the use of other appropriate federal or state revitalization or incentive programs within the area. K. RELOCATION PROVISIONS The City does not anticipate the displacement or relocation of any persons, families, or businesses as a result of the improvements to be made in the Revitalization Area. L. An Ordinance Designating an Area of Marion, Iowa, as the 2017 Workforce Housing Urban Revitalization Area WHEREAS, pursuant to the provisions of Chapter 404, Code of Iowa (the Act ), the governing body of a city may, by ordinance, designate an area of the city as a revitalization area upon the completion of procedures specified in the Act; and WHEREAS, pursuant to the provisions of the Act, the City Council of the City of Marion, Iowa, has by resolution determined, with respect to an area within the City, hereinafter described in Section 1 and known as the 2017 Workforce Housing Urban Revitalization Area that: (a) The 2017 Workforce Housing Urban Revitalization Area is an area which is appropriate as an economic development area as defined in Section 403.17 of the Code of Iowa; (b) The 2017 Workforce Housing Urban Revitalization Area is an area which is appropriate for public improvements related to housing and residential development, or construction of housing and residential development, including single family or multifamily housing. (c) The economic development of and the promotion of housing and residential development in the 2017 Workforce Housing Urban Revitalization Area is necessary in the interest of the public welfare of the residents of the City and the 2017 Workforce Housing Urban Revitalization Area substantially meets the criteria set forth in Section 404.1 of the Act; WHEREAS, pursuant to the provisions of the Act, the City prepared a Plan (the Plan ) for the 2017 Workforce Housing Urban Revitalization Area and held a public hearing on the Plan for the 2017 Workforce Housing Urban Revitalization Area; and WHEREAS, pursuant to the provisions of the Act, the City has adopted the Plan for the 2017 Workforce Housing Urban Revitalization Area; NOW, THEREFORE, Be It Ordained by the City Council of the City of Marion, in Linn County, Iowa, as follows: Section 1. Grantee further agrees that nothing in this Easement agreement shall in any way preclude Grantor from causing, allowing or permitting utilities to cross the Easement area, but only upon Grantee s approval, which approval shall not be unreasonably withheld, and only if said utilities cross the Easement area in a way as to limit the disturbance of the Easement area. C. Grantee hereby gives notice of Grantor's five-year right to renegotiate construction or maintenance damages not apparent at the time of the signing of this agreement as required by Sec. 6B.52 of the Code of Iowa. D. This agreement shall be recorded at the Linn County Recorder s Office at the cost of the Grantee. 6. Successors in Interest: This Easement Agreement shall be binding upon the parties hereto, their heirs and beneficiaries, representatives, successors and assigns. 8. Construction of Terms: Words and phrases herein, including the acknowledgment hereof, shall be construed as in the singular or plural number, and as masculine, feminine or neuter gender, according to context. 9. Sunset Clause: The Grantor may request the termination of the Easement by making a written request to the Mayor and City Council of the City of Marion to have the Easement vacated when the following conditions are met: A. The area is no longer being used for public dumpsters, or B. The Grantor has extenuating circumstances that can be justified. The Grantor s request to terminate this agreement by the City shall not be unreasonably withheld, but shall be evaluated to determine what is in the best interest of the public. AGREEMENT FOR LEGAL SERVICES This agreement will be effective May 18, 2017 between Kara Bullerman, of the law firm of Allen, Vernon & Hoskins, PLC, and the City of Marion, Iowa, a municipal corporation, client, for the provision of legal services to the municipality. Kara Bullerman is hereby retained as Assistant City Attorney for the City of Marion and shall perform the following services: representation of the City in civil legal suits or matters, attend City Council meetings in the absence of the City Attorney, attend other meetings at the request of Council or City Manager, render legal opinions for the City; prepare ordinances, resolutions, contracts or other legal documents and such other services as directed by the City Council, City Manager or City Attorney. The attorney shall provide his own office and secretary. The City shall furnish letterhead, resolution and ordinance paper and shall reimburse the attorney for previously approved conference and travel expenses and for long-distance phone expenses, postage and filing service fees incurred on behalf of the City. In consideration of the above, the City shall pay Kara Bullerman for all hours worked at the hourly rate of One hundred and thirty dollars ($130.00). The attorney shall exercise his professional judgment in the handling of municipal matters and shall report all conflicts of interest to the City Attorney. Where the attorney reasonably believes that the handling of a matter is outside of his areas of professional competence, the attorney shall report the same to the City Attorney. The attorney shall bill the City monthly for hours expended. This agreement shall be effective this date and shall expire on June 30, 2017 and may be terminated by either party upon the giving of ninety (90) days written notice to the other party. monthly report April 2017 CAPITAL PROJECTS (CURRENTLY UNDER CONSTRUCTION) Central Corridor- Roundabout at 7 th Street/ 7 th Ave; STP-A-4775(627)- - 86-57: Final plans were approved by Council on February 19, 2015. Plans were approved by IDOT District 6 on February 27, 2015. IDOT has released the plans for letting. Letting date was May 19, 2015. The IDOT received two bids. Ricklefs Construction $2,871,607.00 (112.3% of Engineers Estimate) and Rathje $3,045,873.10 (119.1% of Engineers Estimate) Liquidated damages of $1500 and 120 working days has been specified by the IDOT. The City requested late start date of 4.11.16 was granted. A preconstruction meeting was held on 3.4.16. An open house was held on 3.22.16. A groundbreaking was held on 3.28.16. The project started on 4.11.16 and as of 12.3.16 the contractor has completed 99% of the contract and has used 115% of the time allotted. A IDOT walkthrough was held on 12.2.16 to develop the final punchlist. A ribbon cutting was held on 11.10.16 and the project was opened to the public. 3 pages of punchlist are currently being completed and staff is preparing for the IDOT audit. Indian Creek / Dry Creek Trunk Sanitary Sewer Project: City Council concurred with the award of Contract to SM Hentges & Son s Inc. in the amount of $2,754,758.59 on January 22, 2015. Cedar Rapids is taking care of the inspection and administration for this phase. The 28E between Cedar Rapids, Hiawatha, Robins, and Linn County was approved at the 6.9.16 Council Meeting. It is being recorded at Linn County. The agreement includes segments 7 and 11 which include: From 36th Street Drive (east of) to approximately 300 feet north of Iowa Highway 100, approximately 6,393 lineal feet. From confluence Indian Creek and Dry Run Creek to approximately 700 feet north of the intersection of Alpine Road and West 14th Avenue, approximately 4,972 lineal feet. An RFQ has been written and distributed to consultants in the area and 7 responses were received. The proposals will be rated and scored between Marion, Cedar Rapids, Hiwatha and Robins to select a consultant. A contract will then be written and voted on by all parties and the design for segment 7 will then commence with design and acquisitions. A walkthrough of the corridor was performed by City staff and the consultants to determine preliminary wetland conditions as they will have a big impact on the design cost and complexity. A contract with Veenstra Kim (VK) was approved on the 1.26.17 for an amount not to exceed $315,000.00. Field survey has been completed and VK has started the design. The consultant has come up with two alternatives and are going to start by talking to the majority property owner Bjornsen to get their input on the two alternatives. One follows the old sanitary trunk sewer and one cuts thru the old railroad alignment. Both have pros and cons. ImaginArt in the Alley: A letting was held on December 22, 2015 and 3 bids were received. The low bid was from

monthly report April 2017 Central States Concrete LLC. Contracts and bonds have been accepted by Council. The bid was for $343,468.15 included the alternate which was 105.6% of engineer s estimate. The contract has a completion date of 10.28.16. A preconstruction was held on 3.30.16. The contactor was originally planning on starting on 4.11.16 but was pushed back to 4.18.16 to allow the uptown painting project to be completed. A utility coordination meeting was held on 4.4.16. Work began on 5.4.16. Additional utilities that were unknown have been discovered and MidAmerican Energy has decided to place a new gas main while everything is torn up. MidAmerican Energy has finished their work and the contractor has come back onto the site. Acceptance of the project occurred on 11.17.16. Retainage has been released and a ribbon cutting is scheduled for the Marion Arts Festival. The ribbon cutting will be at 9AM on 5.20.17 Tower Terrace Road Phase V (10 th St to Winslow Rd): Punchlist items remain. Street has been opened to traffic. Winslow Road Realignment: This is a private / public partnership project. Punchlist items remain. Street has been opened to traffic. Central Corridor 26 th to 31 st Street (Stage 1 Sanitary Sewer): This is a private/public partnership project [$369,232.30]. A preconstruction meeting was held on 8.14.15. Construction started on 8.19.15 for the westerly utility portion of the project. Working days are being tracked but there were not any allocated to this project. For convenience, this has been combined with Stage 2, below. Central Corridor 26 th to 31 st Street (Stage 2 Remaining Improvements): This is a private/public partnership project [$1,949,127.74]. Plans have been approved and issues with the soil, utilities and contract are being worked thru for a spring start. A meeting was held with the IDNR and it was determined the site would not be cleaned up with mitigation so it would be better to cap the site. A preconstruction meeting was held on 5.25.16. The contractor is currently in Stage 3 and 4. Most of the paving has been completed with some hand pours remaining. Due to pending weather the project will not be completed but is anticipated to be opened by 12.7.16. There is painting, lighting, signs, etc. to be performed yet. A spring preconstruction meeting was held on 3.28.17. The contractor intends to begin work again on April 10 and be completed in June. The contractor started back up on April 17, 2017. As of 4.29.17 the contractor has completed 90% of the contract and has used 123 working days. 2016 Lowe Park Lighting Project: Trey Electric was the low bid and was awarded the contract on 6/9/16. Has a late start date of 4.30.2017. Project completed except some bolt covers on bollards. 2016 Winslow Road Reconstruction Project: Plans have been accepted and are out for bids. Letting was 5.31.16. 6 bids were received. The low bidder was Rathje Construction at $994,589.75 which was 82.75% of the Engineers Estimate. A preconstruction meeting was held on 7.11.16. At the meeting the contractor was

monthly report April 2017 going to start with Stage A. On the Wednesday prior to the late start date the contractor requested to change to Stage D due to manpower issues. A change order for staff time was signed to re-notify residents of the change in sequence. Stage D and C have been completed for the winter and the project has been opened. Stage A and B are yet to be completed in the 2017. A preconstruction meeting is scheduled for 4.11.17. The contractor resumed construction in Stage A on 4.24.17. As of 4.29.17 the contractor has completed 34% of the contract and has used 48% of the allotted working days. 2017 Sidewalk Assessment Program: A committee meeting was held on 1.19.17 and the following locations were recommended: 29th Street (East Side) from 10th Avenue north as far as possible. Our preliminary estimate is we can get to the south side of 12th Avenue with the funds available. Total preliminary estimate is $57,466.00 with a budget of $59,055.00 A public hearing was held on 3.23.17 and was approved by Council. City Council approved the final plans on 4.20.17 and the project has a letting date of 5.30.17. 2017 Sidewalk Ramp Repair Project The City received 4 bids on 2.14.17. The low bid was from Hunt Construction Company, Inc. for $79,452.00 which was 84.3% of the engineers estimate. City Council approved the contract on 3.23.17. A preconstruction meeting was held on 3.24.17. The contractor started work on 4.23.17. As of 4.29.17 the contractor has completed 30% of the contract and used 18% of the allotted working days. Bridge Inspections: A contract with Calhoun-Burns and Associates was approved at the 5.19.16 Council Meeting [$3,450.00]. This inspection is required every other year as required by the IDOT. Inspections are complete and the report is being written. The IDOT system SIIMS is down so the information cannot be entered. An embargo did need to be placed on the southerly Winslow Bridge due to scour and a pier pile. A permanent embargo established by ordinance will come to the council in May as well as to receive and file the final bridge reports. 2017 HMA Project The City received one bid on 4.25.17 from LL Pelling at a price of $702,137.00 which was 93.5% of the engineers estimate. Consideration of award will go to City Council the first week in May. 2017 Sanitary Sewer Manhole Project The City received 4 bids on 4.25.17. The low bid was from Rathje Construction Company was $55,825.00 which was 105.4% of the engineers estimate. Consideration of award will go to City Council the first week in May. 2017 Sanitary Sewer Slipling Project The City received 4 bids on 4.25.17. The low bid was from Municipal Pipe Tool Co. Inc. for $174,720.15 which was 71.7% of the engineers estimate. Consideration of award will go to City Council the first week in May.

monthly report April 2017 2017 Sidewalk Repair Program: Several of these locations were added to the 2017 Ramp Repair Project by Change Order approved by City Council on 4.20.17. Armar Drive Extension: A condemnation attorney has been hired and survey and plans have been started by Anderson Bogert. A set of plans was reviewed and sent back to the consultant on 9.9.15. A meeting was held on 7.15.16 and the City agreed to pay for the Rausch appraisal. The appraisal has been received and the City s attorney is reviewing for a response. The recommendation is to proceed with Eminent Domain and Council approved a resolution to start the process on 10.6.16. A compensation hearing was held on 3.15.17. An approval of the compensation as determined by the Linn County compensation board was approve by City Council on 4.20.17. The final plans will go before the City Council for approval in the first meeting in May to allow the project to be bid. CAPITAL PROJECTS (UNDERGOING DESIGN PHASE) 2017 Storm Sewer / Draintile: Locations are being evaluated in conjunction with the Public Service Department. Tower Terrace (C Avenue to Alburnett): Several meetings have been held. Anderson Bogert is the design engineer for the project. This is a joint project with Marion, Cedar Rapids and Linn County. The Environmental study is underway which could take 18 months. Additional funding has been applied for with the CMPO. The IDOT has requested a complete EA process which will add another year to the design process. Due to the extra expense a modification to the 28E will be required. Waldo Rock Park: The Parks Department has received a REAP Grant for this project. Much of the park has been developed by the Parks and Public Service Departments. Park lighting plan is out for Quotes due May 2 nd. Construction of this project will be summer 2017. Grant Wood Trail Extension: Anderson Bogert has submitted preliminary plans. Billings and Barkalow have started negotiations for easements and acquisitions. All acquisitions have been completed. The City is currently finishing up paperwork with the Iowa DNR. Central Corridor Phase at 13 th Street to 26 st Street Acquisitions: Universal has been hired by the Planning Department to start the acquisition and easement process. Hall and Hall is the design engineering firm for this project. A public meeting was held on 11.12.15 and ~20 individuals showed up the meeting to give them an update on the proposed project and the future acquisitions. Plans for 13 th Street to 19 th Street are almost complete however acquisitions may hold this project up during the 2017 construction season. The plans for 19 th to 26 th are also under design.

monthly report April 2017 Alburnett Road Extension: An RFP was released on 3.16.16 to the consultants which are due 4.13.16. Staff evaluated the RFP s to make a selection. Snyder and Associates was selected. Council approved a contract on 6.23.16 and a study of the alignment options has started. A meeting with staff to discuss items was held on 2.17.17. A meeting with the Parks Board will occurred on 4.12.17. A meeting with the water board is set for 5.9.17. A Public meeting has been set for 5.23.17 from 4:30 to 6:30 for the general public. Central Corridor Wetland Basin 31 st St to 35 th St: This site will now be used to establish additional wetlands for disturbance to other sites along the old RR ROW. This project was not funded in the 2017 work program. The Army Corps is reviewing the proposed wetland basin plan. 29th Avenue and HWY 13 Intersection Improvements Survey has been completed. Design has started. The IDOT did work in this area and survey will need to be redone. MISCELLANEOUS For new subdivisions, we GPS all the infrastructure and incorporate it into the GIS mapping. Last year s Capital projects and Subdivision infrastructure are being added to City maps. City owned street lights and respective electrical conduits are being added to the GIS. Sanitary sewer service inspections from the last year have been added to the GIS. The following permits were pulled during the month of May, 24 Sanitary Sewer Permits, 8 Driveway/Sidewalk Permits, 0 Major Erosion Control Permits, 26 Minor Erosion Control Permits and 2 Excavation in the ROW Permit. All sewer and street occupancy permits are inspected by an Engineering Tech and the erosion control permits are reviewed & approved by the Stormwater Coordinator. The driveway/sidewalk permit and excavation in the row permit totals do not include the inspections done on new residential construction where a separate permit is not issued for sidewalks, driveway approaches, or sump line connections, but inspections are still performed. 2014 Sidewalk Inspection Program: 3 of the 536 violations remain to be repaired for the south ½ of the City. A list was submitted to Assistant City Attorney for legal action. 2016 Sidewalk Inspection Program: Inspections have been completed. Notices went out to 186 properties for the north ½ of the City. Property owners have until August 16, 2016 to fix the identified violations. A second letter was mailed out 8.16.16 with a new deadline of 9.20.16 that have not addressed the violation. A third letter was sent as certified mail (10.3.16) to the remaining property owners that have not fixed their sidewalk violation; the new deadline is November 7, 2016. This is the last letter they will receive from the Engineering Department. The next notice will be from the City Attorney s Office, which will start the legal process. As of 4.11.17, out of the 186 violations marked, 4 remain to be repaired; approximately 97% have been completed; all remaining violations have been given an extension until May 2017.

monthly report April 2017 Adult Services: Spring cleaning in Adult Services project: we began a collection-wide weeding project. This helps us ensure our collection is relevant to our community s needs and our shelves are browsable for our patrons. Thank you to Janet Bailey for her diligence in this project! The Metro Library Network began circulating wi-fi hotspots on April 17 th. Patron feedback has been phenomenal everyone is excited to try one out! We are grateful to the Friends of the Marion Public Library for their financial support in this service. After renewing our Freegal subscription, patrons are able to download up to five songs per week, up from three. We are already receiving positive feedback for this increase! Madeline Jarvis, Jo Pearson, and Elsworth Carman also simplified the process of assigning guest passes for our public computer stations. The new process allows us to provide quicker customer service and share our resources with as many users as possible. Madeline attended a Main Street Iowa orientation on April 13 th and enjoyed the opportunity to learn from other communities. She is looking forward to implementing some of the best practices discussed in the Marion community. Jamie Anderson attended a day-long Mental Health First Aid training session, which was a more in-depth look at the topics discussed at the 2016 Staff Training. She is sharing what she learned with the rest of the library staff, which will help us be more effective and compassionate in our service to all members of our community. Children s Services: April flew by with some notable fun programs like some well-attended Family Times particularly, Hand Print Art and Lego Night. We hosted an Earth Day craft where kids could make seed bombs with flowers that will attract pollinators that they can let loose on our community. The inventory process (see below) started in the Children s Area and we ve caught cartloads of corrections and updates we need to make to our collection. Young Adult Services: This month we started a Teen Advisory Board (name TBD) a chance for tweens and teens to have more of a stake in the library and in teen services. The teens who came had some great ideas for future programs and were really excited to take more ownership of their space in the library. They also helped put together May s book display in the young adult area ( Older Teen Reads ).

monthly report April 2017 We hosted a gardening program over two days. 15 teens painted pots and planted over 20 flower seeds! Our Fandemonium theme this month was the TV show Supernatural. We had a lot of hardcore fans join us to watch the very first episode. Game Days remain popular. We have expanded our collection to include two more donated Wii remotes, which was a big hit with our avid Mario Kart players. We are also starting to expand our board game collection with more teen games, like Pandemic and the Oregon Trail Card Game. We are looking forward to Summer Reading and anticipate more active tween and teen attendance at summer programs! We continue to be challenged by disruptive after school behavior by some of the tweens and teens from Vernon Middle School. At the moment, our teen librarian Rachel Pollari is staffing the library lobby for ½ hour after school each day in an attempt to engage the kids and keep them from causing trouble and impeding access for other patrons. Other problems are dealt with by staff at the Information Desk. Outreach Services: Our Friends of the Marion Library Homebound Books program continues to grow. Dawn met with the Retired Federal Workers in the Cedar Rapids- Marion area to discuss what the library has to offer and the exciting programs we have for the retired community members. Circulation Services: The library has begun an extensive inventory of circulating materials. This process should take about 3 weeks to complete. This inventory should help with card catalog clean up as well as our patrons finding exactly what they are looking for. Our part-time staff has been offered extra hours to work on inventory for a few weeks until that project is finished. We are experimenting with keeping patron DVD holds on the front staff counter to see if we can control theft better. We have also invested in a new type of DVD case lock that we implemented this month: the only way to remove the DVD itself from these cases is to break it. Dawn had a meeting with the pages this month to talk about expectations and job requirements.

monthly report April 2017 Library Programming: April was a crafty month for adult programming. We opened the month with an Expressive Journaling workshop, led by facilitator Carol Hedberg of Sparking Clarity. This got rave reviews from attendees, and we look forward to welcoming Carol back for future programming. To celebrate National Poetry month, we hosted a drop-in Black Out Poetry program where participants created their own custom poems using book pages as a canvas. We invited patrons to share Love Letters to Your Library as a drop-in passive program for National Library Week. The cards were shared on the library s Facebook and are on display at the Information Desk until the end of May. Maria Peth, Angel Reader, captivated a standing room only crowd. Special thanks to Dawn Cline for organizing such a well-received event! Our regular monthly programs continue to bring consistent attendance. The library serves as a gathering place for friends new and old alike, thanks in no small part to our programming lineup. Building/Facilities Update: Elsworth and Jo continue with weekly building project update meetings that are open to the public; the groups that have gathered for these Q&A sessions have been very interested an engaged. We got a proposal this month from Mark Morgan with Foster s Heating and A/C for fixing/replacing the HVAC system in the two remote meeting rooms; no action has been taken and we ve asked Mark to be patient until we see what the response is for the RFP regarding future use of the existing library building. TMI, who has the maintenance contract on our HVAC system, has come and prepped our A/C for the season. Staff continues to manage heating and A/C via manual controls in the basement. We ve been having an increase in our ant population thanks to the warmer weather and the sweet treat messes left behind in the lobby by our after school teens. Technology Update: We have had largely good reviews from patrons about our improved internet service, with the exception of wifi in the meeting rooms. We did have some additional cabling installed to

As mentioned in the Adult Services report above, the MLN started checking out wifi hotspots to patrons this month and the new service has been very popular! Personnel: We have a number of jobs posted currently, including two summer pages (must be at least age 16), one part-time teen specialist, and two full-time professional leadership team positions. We are excited to get new staff on board before our busy summer! Metro Library Network Update: Dawn and Sandy have completed their committee work on the MLN-wide holds committee and we have integrated some positive changes to increase efficiency in getting materials to patrons more quickly. This includes some staff shift adjustments and perhaps a readjustment of the delivery between all of the metro libraries. Out Loud! Update: Out Loud! plans are made and we are all looking forward to this summer s renowned authors: Anne Perry, Kwame Alexander, and Debbie Macomber; all will visit and present programs in June. The Master Gardeners will coordinate funding. The board approved the raised beds, pergola, and compost bin and will revisit the storage building request as more information is provided. Prairie Revival Lowe Park Art Project: Bids for site prep/grading, seeding, pathway installation, art piece footings, and electrical conduit for the Prairie Revival trail art piece came in over the engineers estimates and over budget. The Board rejected the bids. The low bidder Central States Concrete was asked to take out some components which can be completed in-house and provided a bid of $33,806. The board approved the revised bid with $25,000 to be funded from the Unidentified Capital Improvement Plan Projects. Waldo s Rock Park Lighting Project: The board approved the low bid of $22,513 from Trey Electric for Waldo s Rock Park roadway lighting, parking lot lighting, pavilion lighting, and pavilion electrical. Skate Park: Possible locations for a future skate park were discussed. The preferred locations were Butterfield Park or near the new Function and Fitness center. Receive and File: A memorial bench request from Mike Norman for a memorial bench at Lowe Park in honor of his brother David Norman was received and filed. A letter from John Hanson was received and filed regarding fishing regulations in Waldo s Rock Park, and managing grass and prairie areas against woody growth. Department Report Waldo s Rock Park: Staff poured a concrete pad off the south side of the pavilion where grills and benches will be installed. Lowe Park Development: Seeding and erosion control measures have been started. Prairie grass seeding preparations have also started. Summer Preparations: Speed bumps were installed in Thomas and Willowood Parks to help slow traffic in high pedestrian areas. Irrigation systems and the cemetery water lines have been charged for use. 1 P a g e

The gardens at Lowe Park were tilled in preparation for the planting season. The right-of-way flower beds were tilled around the plants and a pre-emergent was applied to help stop weed growth. Turf areas damaged by snow removal equipment have been repaired. The sun shades were installed on the youth playground at Thomas Park. Arbor Day Celebration: To celebrate Arbor Day on April 28, 200 hardwood saplings were planted in Lowe Park near the maintenance building and new parking lot. Ten volunteers and two Trees Forever staff assisted with the planting despite the rainy day. Trail Repairs: With heavy rains this spring, several areas required immediate repairs. The trail area west of Menards and south of Grand Avenue required recycled concrete to be placed along Indian Creek as bank stabilization. Park staff will be working with the Public Service Department to develop a larger scoped project to stabilize eroding banks along Indian Creek. Oak Shade Cemetery: There were two burials and three spaces sold last month. All graves sites with a burial in the last two years were checked. Spaces were weeded and top dressed with dirt and reseeded as needed. Citizen Requests Tall Grass/Weeds: Two citizen calls were received about tall grass in April. Both properties required a certified notice and the department to mow after noncompliance. Citizen Requests Tree Issues: There were nine citizen requests in April regarding right-of-way trees, and two calls about private trees. One of the trees on private property has been deemed a hazard; the property owner is being notified of the requirement to remove the hazard. Ascension Park: The parking lot at Ascension Park is shared the Ascension Lutheran Church. They approached the department with a request to update their handicap parking. Staff painted new parking stalls and installed new signs to meet today s standards. Mowing Operations: Mowing and trimming started April 17. Swimming Pool: Operations staff have begun preseason startup activities, including: plumbing installed, lines charged and tested for leaks, minor repairs performed, all floors, pool decks, and locker rooms washed down, and diving boards and pool filters installed. Summer pool staff are hired and paperwork completed; trainings will begin May 18. This includes 3 managers, 30 lifeguards, 7 cashiers, and 5 lesson staff. Young Tree Maintenance: Forestry staff inspected trees planted over the past two years. They checked general health and removed stakes and wiring as needed. 2 P a g e

Spring Tree Planting Projects: Plans for upcoming tree planting projects are being finalized. The spring street tree replacement project will include four London Plane trees being planted. There are four memorial trees of various species to be planted at Lowe Park. One Day in May Marion High School students will assist in planting 50 trees at Waldo s Rock Park in mid-may. Upcoming Forestry Events: Iowa s Living Landscapes Workshop (May 2), United Way Day of Caring Garlic Mustard Removal (May 11), Marion High School One Day in May Tree Planting (May 15), Blue Zones Fruit Tree planting with Master Gardeners and Trees Forever (May 16) and Linn-Mar Senior Service Day Prairie Pollinator Clean-up (May 24). Staff Development: Karlene Hummel and Tony Ireland completed their required annual CEU for their Certified Pool Operating license on May 1. B-I-N-G-O Night: The 4 th and final BINGO Night of the season was held April 21. An estimated crowd of 100 people came out to enjoy the last event of the season. The next BINGO Night will be held on July 28 for a special summer edition. Moonlit Movie: The first Moonlit Movie at the Lowe Park Amphitheater will take place on, May 12. Disney s Moana will be the feature presentation with the movie beginning at dusk, approximately 8:30 p.m. There will be free face painting and a balloon artist for the kids. Limited concessions will be available for purchase, but guests are welcome to bring outside food and drink. Youth Recreation Programs: MLB s Pitch, Hit, & Run event was postponed on April 29 due to weather. The new date is scheduled for Wednesday, May 10 from 5:30-7:30 p.m. at Lowe Park. Kick Star Soccer had one rainout and will hold its final night of program on May 8. This program for 3 year olds introduces kids to the basic skills of soccer through interactive games and drills. Focus is placed on dribbling, kicking, stopping, passing, throw-ins, and agility. (photo left) Tiny Goal Kickers Soccer is winding down for the 4 and 5/6 year old divisions. We have had one rainout to be made up on May 18 for the 5/6 year olds. The first two nights were designated as team practices with the following four weeks played as games against other teams. (photo right) Little Sports Camp for 3 and 4 year olds will begin May 22. There is one morning class and two evening classes being held, with a total of 65 kids participating across the 3 classes. Youth Rugby Camp with the Cedar Rapids Rugby Club will be held May 27 at Lowe Park. There are currently 20 kids registered for the day camp that runs 9 a.m. to 3 p.m. Participants will each receive a camp t-shirt and official rugby ball as part of their registration. PeeWee Baseball/Softball/Blastball registration deadline was April 13. We are still having a few late registrations coming in. Live Healthy Iowa Track Championships that was scheduled for May 13 with Hiawatha Parks and Recreation has been postponed and moved due to low registrations. Staff reached out to Cedar Rapids to have anyone registered for the Marion/Hiawatha event to able to participate in the Cedar Rapids event on May 20 at Coe College Adult Wiffleball and Youth/Adult 3vs3 Basketball tournaments have been cancelled due to low enrollment. Staff will explore options and possible changes for next year Baseball Tournaments: The first baseball tournament of the year at Lowe Park kicked off Saturday, April 14, and league games began on Tuesday, April 18. Due to the cold and rain, games were canceled April 27, 28, and May 2 and the April 29 to 30 tournament was also cancelled. The season will run thru July 13. Mass Swim Lesson Day: Mass registration took place Saturday, April 29. There were 565 spots filled, which was the same as last year. Also, five family and two individual passes were sold, as well as six swimmers signed up for swim team. Arts Council: The final Coffeehouse event of the season was held April 7 with an Acoustic Open Jam Session led by Lori Blattner. There were 22 people joining the jam session and 35 people enjoying the creative juices. The Gallery exhibit for through May 5 features Karen Morehead, a ceramic artist, and Kathleen Heubener. Ron Ginther and Jane Strnad Nelson will be the next exhibit. Activity Report from Master Gardeners Lowe Park greenhouse report by Phil Pfister: The monthly series of Family Gardening for Food and Fun at Lowe Park kicked off on Tuesday, April 18, at 6:30 p.m. This event is scheduled for the third Tuesday of the month, running from April through September. Doug Smith and Steve Bartlett led the discussion on pruning. They covered shrubs, roses, grasses and fruit trees. Ten people took advantage of the session, which ended with rhubarb dream bars and ice tea. The next session will be May 4 P a g e

16, at 6:30 p.m.; the subject will be planting trees and shrubs, and will include planting the new trees for the orchard at Lowe Park. The greenhouse is filling with plants for the demonstration gardens, donations to HACAP food pantries, the City of Marion Parks, and the Linn County Master Gardener Plant Sale. The plant sale is one of three major fundraisers that finance the Master Gardener activities and events and will be held Saturday, May 20, 8:00 a.m. to noon, at the Extension Office parking lot. To grow all the plants for these events, work sessions are held every Tuesday and Thursday from 9:00 a.m. to noon, and other times as needed. They are open to everyone interested in working in the greenhouse, learning about seeding and transplanting and socializing with people with like interests. Alburnett Road Alignment Project Presentation Snyder & Associates (Troy Culver, Tim West, Lara Guldenpfenning) and the Marion Engineering Department (Director Dan Whitlow, Mike Barkalow) presented the Alburnett Road Alignment Project information. Discussion for this project began in the late 1990s. The project will cross over Indian Creek and include trail connections and bike lanes. The board looked at the plans which would take the new alignment through the middle of Willow Park, separating the ball diamond and the playground. The replacement of the pavilion is scheduled for 2018, at which time it would be moved further away from the road for safety. Several board members requested additional parking be included near the ball diamond and a better entrance option rather than off of 8 th Avenue. 8 P a g e

Iowa BIG Project Presentation Kaleb Cook, Riley Rinkenberger, and Brady Pinter have been working with Martin Gardener Architecture during the school year on a project through Iowa BIG. The students researched Marion and community goals and selected the abandoned railroad bridge over 7 th Avenue as their project. They wanted to create a gateway feature to the community which would be visible from 7 th Avenue, or the future trail utilizing the abandoned railroad property. The students presented a lighted model of their vision. They will be presenting their project to the City Council in the future. Wise thanked them for their time. The students are from LinnMar, Kennedy, and Prairie high schools. Fireworks in City Parks The State is reviewing Iowa Code regarding allowing fireworks to be set off in the state. There currently are no park rules which prohibit this activity due to the state ban. Martin stated this should be considered similar to smoking in the parks. McIntosh commented fireworks create a big mess. Wise is concerned about the safety of park users and recommends a person be required to have a permit to shoot off fireworks. McIntosh asked about park rules in other states which do allow fireworks to be set off. Carolan said he would do some checking. Waldo s Rock Park Pavilion Masonry Bids Bids were solicited from four companies to complete masonry work adding a stone feature to the pavilion pillars at Waldo s Rock Park. Bids were received from: Cedar Valley Masonry, LLC (Anamosa) $6,929.80, and Marv Pesek Masonry Inc. (Cedar Rapids) $7,345. Moved by Martin and seconded by McIntosh to approve the bid from Cedar Valley Masonry, LLC in the amount of $6,929.80 for masonry work at Waldo s Rock Park. McIntosh asked if this was included in the budget for the project; Carolan said it was. All in favor, motion carried. Flower Bed Landscaping Maintenance Service Agreement The service agreement for flower bed and landscaping maintenance with Creekside Gardens is up for annual renewal. The hourly rates increased by $1.00 and maintenance of the Art in the Alley flowerbeds was added to the list. Moved by Wise and seconded by Speral to approve the annual service agreement with Creekside Gardens for flower bed and landscaping maintenance. All in favor, motion carried. Memorandum of Understandings (MOU) A MOU with the Milky Way Masters (MWM) allows the adult group to use the municipal swimming pool on Mondays, Wednesdays, and Fridays from 3:45 to 6:45 a.m. from May 22 to September 4 when not in conflict with department use. Moved by McIntosh and seconded by Martin to approve the MOU with Milky Way Masters to use the Marion swimming pool during 2017 for a fee of $500. Hummel stated the group has been using the pool in this manner for about 20 years. All in favor, motion carried. A MOU with the Eastern Iowa Swim Federation CRAA allows the group of coaches and youths to use the municipal swimming pool on Tuesdays and Thursdays 5:00 to 6:45 a.m., Mondays and Wednesdays 7:00 to 8:30 p.m., and Saturdays upon request from May 22 to September 4 when not in conflict with department use. Staff Report An update on the Lowe Park Parking Lot project was given. The ground will be prepped in mid- May for prairie grass seeding. The parking lot may be opened when the lighting is completed. The next step will be to send out an RFP for design services for a pavilion, restrooms, play area and landscaping. Carolan will be requesting the Foundation to fundraise monies to supplement this phase of the project. Carolan attended a meeting with Marion Independent School District regarding the joint tennis courts project. The old courts will be removed when the school s tennis program is finishes towards the end of May. The project is scheduled to be completed by August 18. Wise asked if the courts would be placed in the same location as the old ones. Carolan replied the old location was the best use of the grounds, and the additional courts will just enlarge the court area. Items to be completed at Waldo s Rock Park include trail work; prairie grass seeding; placing tables, benches, grills; tree plantings; lighting; and electrical at the pavilion. The lighting and electrical work is out to bid. The goal is to have a majority of these items completed by July 1. Grading bids for the Lowe Park Trail Art piece Prairie Revival have been sent out. Operations staff have been performing spring preparations in the parks by setting out tables, opening and turning on waterlines and other cleanup. Seasonal employees start work on April 17. Forestry staff are planning to complete a prairie burn at Lowe Park and shooting for April 17 with weather and assistance being the determining factor. Spring break recreation programs were a hit and very well attended. The soccer program finished up with 49 participants in Kick Start Soccer (age 3), and 73 participants in Tiny Goal Kickers (ages 4 to 6). The Marion Farmers Market starts May 6 with 17 vendors signed up. Master Gardner s will attend twice a month to share information and answer questions. Carolan complimented Jay Moore as the Market Master. McIntosh asked if another pavilion could be added for the vendors. Carolan said not at Taube Park, but would like to see one in a couple years at a different location. Board Discussion Time Speral heard in the news people were getting electrocuted in swimming pools from the underwater lights and was very concerned. Carolan stated that has not happened in Marion and the lights at the pool are very low voltage. Tree Maintenance Contract Renewal The contract for tree maintenance is due for renewal. Carolan explained the last contract was approved in 2014 and automatically renews annually with contractors when there are no changes. A meeting was held with Breeden Tree Service to review pricing and minor wording changes. Some of the wording changes include using Arborist language, marking and tagging trees, changing the distance from 7 ft. to 10 ft. above sidewalks, and addressing ash trees. Carolan noted there are no changes to pricing and Breeden has been maintaining trees for about 15 years. They have been the low bidder, reliable and are very responsive to any concerns we may have. It was noted there is an inventory of ash trees attached to the contract which now shows 957 trees and including ash trees in city parks. It was noted the percentage of ash trees changed from 25% to 16% of the city trees. Tormey requested that EAB be spelled out the first time it appears in the contract when addressing the Emerald Ash Borer as it relates to ash trees. Moved by Hanson and seconded by Sanderson to recommend to City Council to approve the contract with Breeden Tree Service. All in favor, motion carried. Action/Discussion Item Carolan reported the Mayor and City Council had approved the removal of Pam Munro from the Tree Board, and she was advised of the action. If members know of anyone interested in joining the board to fill the vacancy, they need to contact City Hall. Carolan stated the Arbor Day proclamation will be made at the April 20 City Council meeting. Cimprich will be attending and encouraged Tree Board members to attend. This item will be one of the first items on the agenda. Staff Report Cimprich distributed a list of spring forestry events and provided additional event details. It was noted the April 28 Arbor Day celebration at the Lowe Park south entrance will include planting the Trees for Kids saplings. the location. The May 15 Marion High School One Day in May event will be the Alliant Branching Out planting of 45 to 50 trees at Waldo s Rock Park. May 16 Master Gardeners/Blue Zones Fruit Tree planting will be 14 trees which were ordered last fall; the time needs to be confirmed. Stump removal of the former Peace Tree at City Park has been completed. A Con Color Fir was ordered from Evergreen and will be planted in the general area where the tree was removed. The bucket truck with a 60 ft. reach and chipper box has been ordered. The Linn County Health Department approved the burning permit for two locations; Lowe Park and Faulkes Heritage Woods. Dates for the burns have not been finalized due to the early spring greening of the locations and the necessity of a south wind. The Marion Fire Department will assist with the burn. There are also volunteers from various agencies who will assist with the burn event. The department hosted a chain saw training at the end of March with the assistance if the Iowa Department of Natural Resources. Positive feedback was received. The day included a morning seminar and an afternoon of hands on use of chain saws. Marion Independent Schools has contacted the department about planting trees at the new Longfellow School. This may be a possibility for a fall planting with a Trees for Kids grant. Emerald Ash Borer tree injections will begin next month. In addition, trees that have been planted over the past 5 years will be inspected to check their overall health. Four memorial trees will also be planted in the next few weeks. The proposed 13 th Street tree replacement site was inspected and it was agreed with the property owners (Stewart Baxter Funeral Home) that planting of trees will be delayed for 1 to 2 years. A property owner adjacent to Starry School contacted Cimprich to request trees be planted where some have been removed. It was recommended the trees that were going to be planted on 13 th Street be instead planted at the South 14 th Street location adjacent to Starry School. Letters have been sent to homeowners for the spring planting of replacement trees. Locates will be done and trees will be planted in early to mid-may. Tormey, Cimprich and Arborist Technician Ryan Hays attended the Tree City USA luncheon last week and shared it was a very worthwhile event and the guest speaker did an excellent job of sharing information with attendees about trees.
