SCOPE OF WORK BHARAT PETROLEUM CORPORATION LIMITED SUPPLY, INSTALLATION AND COMMISSIONING OF 03 NOS PASSENGER ELEVATORS AT BPCL HOUSING COMPLEX BHOPAL E-TENDER ID: 36957 (CRFQ NO: 1000302368 DATED 09.03.2018) Due Date/Time: 23.03.2018/1500 hrs Note: Bidders must read these conditions carefully and comply strictly while submitting their bids. Rates once quoted shall be firm and final, no revision of rates shall be permitted. 1. Please quote your lowest rates for the job in E-Tender format only as given in the online e- tender portal. The tender will be evaluated based on net cash out flow inclusive of all taxes and duties as applicable. 2. The company reserves the right to reject any one of the offers without assigning any reason. 3. SCOPE OF WORK: 3.1. The scope of work shall include transportation of all the required material for successful commissioning of the passenger elevator system at the site of installation at the following address: BPCL Housing Complex VIdya Nagar, Hoshangabad Road Bhopal- Madhya Pradesh 3.2. The new lift shall be installed by replacing the existing lift system. Hence, the new lift shall be installed in the existing lift shaft system available at BPCL Housing Complex Bhopal. The scope of work shall include dismantling of existing lift system and all associated electrical, civil, mechanical works required for dismantling of the existing lift system. 3.3. The scope of work shall also include all associated electrical works, civil works, scaffolding, cutting, welding etc. required for satisfactory commissioning of the elevators at our BPCL Housing Complex Bhopal. 3.4. The scope of work shall also include disposal of any waste civil materials out of the BPCL Housing Complex premises. SIGNATURE OF VENDOR: PAGE 1

The contractor shall be required to obtain all License, approvals and statutory certificates necessary for erection, commissioning, testing and operation of the lift from applicable competent authorities. 4. SAFETY AND SECURITY REGULATIONS: The contractor shall abide by the safety and security requirements. The contractor shall provide to his workmen all the safety gadgets required for the work. Contractor shall ensure to complete all formalities to obtain entry pass/permissions etc. for workmen/supervisor deployed for the work. 5. GUARANTEE PERIOD: The contractor shall guarantee the workmanship and materials supplied by him for a period of one year from the date of commissioning and handing over. 6. EARNEST MONEY DEPOSIT: The tender participants shall be required to submit along with this quotation, a Bank Draft/ Bank Guarantee in favour of Bharat Petroleum Corporation Ltd. for a sum equivalent to 5% of the total tendered value of works as earnest money deposit, subject to a minimum of 5,000/- and a maximum of 1,00,000/-. The earnest money deposit shall be returned to the unsuccessful tenderer(s) after due date for opening of the tender upon request submitted by vendor. The earnest money deposit of the successful tenderer will be retained till the commencement of the work. Thereafter the tenderer may opt to adjust the earnest money deposit against security deposit as a money deposit or request return of the earnest money deposit. No interest will be payable on earnest money deposit. 7. SECURITY DEPOSIT: The successful tenderer, before commencement of the work, shall have to provide to the company, by way of security, Bank Guarantee for an amount equivalent to 5% of the total tendered value of the works, subject to a minimum of 5000/- and a maximum of 100000/-. The tenderer shall have the option to adjust the earnest money towards security deposit if he so desires. The security deposit will be retained till the successful completion of the work. The Bank Guarantee shall be kept valid by the tenderer at his cost till the completion of the work under contract and shall be extended from time to time. 8. PAYMENT TERMS: BHARAT PETROLEUM CORPORATION LIMITED Full payment will made after the successful erection, commissioning and testing of the Lift. The successful contractor shall be required to submit a Performance Bank Guarantee carrying a value of 10% of the contract value against retention money. The retention money will be retained for a period of one year from the date of handing over of the lifts. The Bank Guarantee shall be kept valid by the tenderer at his cost till such period and shall be extended from time to time. No interest will be payable on retention amount. 9. OTHER REQUIREMENTS: Vendor shall submit Manufacture's test certificate for all lift as well as motor and invertor. Vendor should submit the detailed lay out drawing of the lift to be supplied for approval of representative of BPCL 11. Delivery Time: All the items must be supplied within 4 months from the date of issue of Letter of Intent. 12. Additional terms and conditions under GST 12.1. The quoted prices shall be deemed to be inclusive of all taxes and duties except Goods and services Tax (here in after called GST) (i.e. IGST or CGST and SGST/ UTGST applicable in case of interstate supply or intra state supply respectively). Contractor / vendor shall be required to issue tax invoice in accordance with GST Rules so that input credit can be availed by owner / BPCL in the event that the contractor / vendor fails to provide the invoice in the form and manner prescribed under the GST act read with GST invoicing rules there under owner / BPCL shall not be liable to make any payment against such invoice. 12.3. GST shall be paid against receipt of tax invoice and payment of GST to government of India. In case of non- receipt of tax invoice or non- payment of GST by the contractor/ vendor, BPCL shall withhold the payment of GST. 12.4. GST payable under reverse charge, if any shall not be paid to the contractor/ vendor but will be directly deposited by BPCL to the Govt. of India. 12.5. The contractor / vendor shall take steps viz uploading invoice in GSTR 1, payment of the tax liability on the said invoices and filling of returns etc. and comply with all the requirements of applicable laws including GST laws for the time being in force to enable the owner to avail tax credit/s including input tax credit. In case of any loss or non-availability of input tax credit by the owner due to non-compliance of applicable GST laws in force, on the part of contractor / vendor, an amount equipment to any tax liability accruing to the owner and / or to the extent of any loss accrued to the owner due to the non-availability of input tax credit or any liability accrued to the owner shall either stand cancelled or deducted from the payment due to the contractor / vendor or shall be reimbursed by the contractor / vendor as the case may be till such default is either rectified or made good by the vendor and the owner is satisfied that it is in a position to claim valid input tax credit within the time-lines as per applicable laws. 12.6. Any cost, liability dues penalty, fees, interest as the case may be which accurse to the owner at any point of time on account of non- compliance of applicable tax laws or rules or regulations there of or otherwise due to default on the part of contractor/ vendor shall be borne by the vendor. An amount equivalent to such cost, liability, dues, penalty, fees, and interest as the case may be shall be reimbursed by the contractor/ vendor within 30 days. Any GST as may be applicable on such recovery of amount shall also be borne by vendor. 12.7. Not with standing anything contained anywhere in the agreement in the event that the input tax credit of the GST charged by the contractor / vendor is dented by the tax authorities to BPCL due to reasons attributable to contractor / vendor by way of adjustment from the nest invoice or from bank guarantee available. In addition to the amount of GST, BPCL shall also be entitled to recover interest by the tax authorities on BPCL. 12.8. TDS under GST, if applicable shall be made from contractor s / vendors bill at applicable rate and a certificate as per rules for tax so deducted shall be provided to the contractor/vendor. BHARAT PETROLEUM CORPORATION LIMITED 12.9. No variation on account of taxes and duties, statutory or otherwise, shall be payable by BPCL to contractor/vendor except for GST. However, any statutory variation for GST shall be payable up to contractual date of completion/ delivery against documentary evidence. Any reduction in taxes and duties included in the price shall be passed on to BPCL. 12.10. Any new taxes, duties cess, levies notified or imposed after the submission of last/ final price bid but before contractual date of completion/ delivery of work / item shall be to BPCL s account.
