STEPS FOR CHANGING A TAX PARCEL Documentation is required for splitting or combining of a real estate tax parcel. If the change occurs because of a deed that was submitted for recording, the closing agent should have followed the required process and there would be no further steps required by you. If any other change is requested, there must be documentation submitted and steps that must be followed. It is our intention to help direct you through this process. When requesting combining of tax parcels: owners of parcels must be identical, parcels must be contiguous and must lie within the same section/township/range. We cannot combine platted with metes & bounds or parcels that cross jurisdictional boundary (township/city, school, water, debt, fire etc). If your request for a change is driven because you will be obtaining a mortgage and your lending institution will not mortgage all of your property, please discuss with your lender what exactly they are expecting of you. There are three possible scenarios that the county has seen: Lender allows mortgage to cover only part of a tax parcel tax parcel remains intact no split is being required. Lender requires that a tax parcel be split to cover only the property being included in the mortgage that will be recorded must follow the process outlined below. Lender requires owner to record a Quit Claim Deed from themselves to themselves, which includes only a portion of the tax parcel which the mortgage will cover. The process below should be followed and a request for a change in the tax parcel must accompany the deed when submitted for recording and all taxes and special assessments must be paid in full before parcel(s) can be changed. Steps to take: 1) Legal Description: you will need to come up with a possible legal description for what you are considering. 2) Planning & Zoning Office: You will need to take your suggested legal description (survey or metes & bounds description) and a site drawing to this office and discuss the change with them. If your township does their own planning & zoning you might be referred to your township to work with them. P&Z will review your change and try to assist you in following local, state and federal requirements to accomplish your task. Submit one of the appropriate attached applications to P&Z Office. If you are unsure which form to complete, this office will assist you. Once approved by the P&Z staff, they will complete the signoff sheet which will need to accompany the Request for Splitting/Combining Tax Parcel form. For questions call 320-732-4420. 3) Auditor/Treasurer Office: inform this office that you are in the process of splitting or combining your tax parcel(s) and want a final amount due on any taxes or special assessments affecting the tax parcel(s). Taxes will need to be paid in full before any change in the tax parcel is possible. Special Assessments, if any, will need to be discussed with this office also. They should provide you with a sign-off sheet which will need to accompany the Request for Splitting/Combining Tax Parcel form. For questions call 320-732-4469. 4) Recorder Office: submit to this office a completed Request for Splitting/Combining Tax Parcel form along with the other two required additional sign-off sheets. This request will be reviewed and you will be notified once the process has been completed. Should there be any questions this office will contact you. For questions call 320-732-4428 BE AWARE..if the correct process is not followed; it could result in non-conformity where no permits could be issued by Planning & Zoning for either piece of property!!

TODD COUNTY APPLICATION FOR ADMINISTRATIVE SPLIT Generally, per the Todd County Subdivision Ordinance, when dividing any tract of land into two or more lots or parcels it is necessary to follow the subdivision process. In certain circumstances, the requirement for the subdivision process will not apply; however, authorization would still need to be obtained through our office. This application should be completed before any transfer of property occurs. IF THE CORRECT PROCESS IS NOT FOLLOWED, IT COULD RESULT IN A NON- CONFORMING SPLIT WHERE NO BUILDING PERMITS COULD BE ISSUED FOR EITHER PIECE OF PROPERTY. PROPERTY SPLIT APPROVAL REQUIREMENTS - If you are not in Shoreland Zoning and are creating no more than two lots from a parcel 40 acres or larger, an original ¼ ¼ section or government lot, or four lots from an original ¼ ¼ section in any district it may be possible to obtain approval through the Todd County Planning & Zoning Office. To apply for this type of split, the attached form should be completed, signed and submitted with a scaled site drawing or a survey of the property to be divided. The submitted information will be reviewed to see if it meets all applicable zoning requirements. **Note** after split approval but Before Property Transfer Occurs it will be necessary for you to provide evidence that your existing septic system (if one exists on this parcel) is in compliance. Evidence may either be (1) a copy of a county inspection form that shows septic is less than five years old; or (2) a copy of Compliance Inspection Form for Existing Individual Sewage Treatment Systems that is less than three years old. If you do not have either of these, you will need to have your system inspected by a MN-licensed ISTS inspector prior to submitting your application. During winter months, a receipt from a licensed inspector stating that the system will be inspected in the spring may be submitted instead.

PROPERTY LINE ADJUSTMENT REQUIREMENTS Per the Todd County Subdivision Ordinance when adding adjoining land to your parcel, it is necessary to obtain authorization through the Planning & Zoning Office. This application should be completed before any transfer of property occurs. IF THE CORRECT PROCESS IS NOT FOLLOWED, IT COULD RESULT IN A NON- CONFORMITY WHERE NO BUILDING PERMITS COULD BE ISSUED FOR EITHER PIECE OF PROPERTY. PROPERTY LINE ADJUSTMENT REQUIREMENTS - The following common property line adjustments would require review and approval - 1. The adjustment of a common property line to a) Eliminate encroachments b) Eliminate or reduce pre-existing setback violations; or c) Eliminate boundary line disputes 2. Any transfer of a portion or portions of platted or unplatted parcels between adjoining landowners other than those listed above. The following requirements must be met. a) The transfer must not create a non-conforming parcel b) The transfer must not increase the degree of non-conformity for either parcel c) The transfer does not cause previously conforming structures to become non-conforming d) The transfer does not result in an increase in land use intensity Per Todd County Ordinance, any land transfer documents for the above property line adjustments that are presented to the Todd County Recorder for filing, must be accompanied by a scaled drawing prepared by a Licensed Land Surveyor showing the following: - Name, address, and telephone number of the legal owner(s) and/or agent of property. - All contiguous property and roads and their legal name(s). - Proposed new property lines with dimensions noted. - Proposed driveway location and location of existing driveways on the same side of the road. -Proposed legal description of the parcel. -Location, purpose and dimensions of all existing structures and distance of structures to the existing and proposed property lines. -Location of any existing tile lines, abandoned wells, drainage ways, waterways, watercourses, lakes, wetlands and the toe and top of any bluffs present. When applicable, the ordinary high water level and 100-year flood elevations shall be shown. -Location of a primary and an alternate site for individual sewage treatment systems (if applicable) To apply for any of the above property line adjustments, the attached form should be completed, signed and submitted with a survey of the property to be divided containing the items shown above. The submitted information will be reviewed for compliance by the County Planning & Zoning Office. Prior to Recording a Property Line Adjustment it will be necessary for you to provide evidence that your existing septic system (if one exists on either parcel) is in compliance. Evidence may either be (1) a copy of a county inspection form that shows septic is less than five years old; or (2) a copy of Compliance Inspection Form for Existing Individual Sewage Treatment Systems that is less than three years old.
