ADMINISTRATIVE AMENDMENT (PD) ADD201 4-00040 ADMINISTRATIVE AMENDMENT LEE COUNTY, FLORIDA WHEREAS, Griffin Bonita Springs Properties, LLC filed an application for an administrative amendment to a Commercial Planned Development (CPD) on a project known as Daniels Parkway Business Park Tract A to adopt the same uses on Tract A as currently allowed on Tracts D and E. WHEREAS the property is located at 8850 Salrose Lane, described more particularly as: LEGAL DESCRIPTION: In Section 21, Township 45 South, Range 25 East, Lee County, Florida: ATTACHED AS EXHIBIT A WHEREAS, the CPD zoning was originally adopted in Resolution Number Z-96-009, reinstated by Resolution Number Z-04-067, with subsequent amendments in case numbers ADD2006-0001 4, ADD2009-00081, ADD201 0-00028, COP201 0-001 95, ADD201 0-00029; and WHEREAS, the subject property is designated as Outlying Suburban on the Future Land Use Map of the Lee County Comprehensive Plan; and WHEREAS, the approved Schedule of Uses in Tracts D and E were found by the Board of County Commissioners in Resolution Z-96-009 as being consistent with the Outlying Suburban future land use category; and WHEREAS, the applicant desires to have the same uses on Tract A as currently approved on Tracts D and E ; and WHEREAS, the additional uses to be allowed on Tract A are automotive repair and service, camera shop, clothing store, drug store/pharmacy, health care facility (group III), hardware store, household and office furnishings, laundry & dry cleaning (group I), pet shop, rental and leasing establishment (groups II & III), repair shops (groups II & III), restaurants (group III) specialty retail (group I), and vehicle and equipment dealer (group I); and WHEREAS, the Lee County Land Development Code provides for certain administrative changes to planned development master concept plans and planned unit development final development plans; and WHEREAS, the subject application and plans have been reviewed by the Lee County Department of Community Development in accordance with applicable regulations for compliance with all terms of the administrative approval procedures; and WHEREAS, Tract A is the sole remaining Tract within the planned development to be developed; and CASE NO. WHEREAS, the adjoining commercial zoning to the west is established with the same land uses proposed in this amendment; and WHEREAS, it is found that the proposed amendment does not increase density or intensity within the development; does not decrease buffers or open space required by the LDC; does not underutilize public resources or infrastructure; does not reduce total open space, buffering, landscaping or preservation areas; and does not otherwise adversely impact on surrounding land uses. NOW, THEREFORE, IT IS HEREBY DETERMINED that the application for administrative approval for an amendment to the Commercial Planned Development to adopt similar uses on Tract A as currently allowed on Tracts D and E is APPROVED, subject to the following conditions: 1. The terms and conditions of the original Resolution Number Z-96-009, reinstated by Resolution Number Z-04-067, and as amended by case numbers ADD2006-00014, ADD2009-00081, ADD2010-00028, COP2010-00195, ADD2010-00029 remain in full force and effect, except as amended herein. There is no change to the approved Master Concept Plan and development intensity as part of the actions taken in this administrative amendment. 2. The only change approved by this amendment is to adopt the Schedule of Uses found as Exhibit B for Tract A as attached to this action 3. If it is determined that inaccurate or misleading information was provided to the County or if this decision does not comply with the LDC when rendered, then, at any time, the Director may issue a modified decision that complies with the Code or revoke the decision. If the approval is revoked, the applicant may acquire the necessary approvals by filing an application for public hearing in accordance with Chapter 34.
