CHURCHILL CLUB HOMEOWNERS ASSOCIATION RULES & REGULATIONS AMENDED 2007 The following are amended Rules & Regulations adopted via Board resolution dated February 28, 2007 by the Board of Directors of the Churchill Club Homeowners Association in keeping with the Declaration of the Covenants, Conditions and Restrictions of said Association and the General Not For Profit Corporation Act of 1986 of the State of Illinois as amended from time to time and pursuant to Article V, Section 5.3 (a) of the By-Laws: I. ENFORCEMENT A. Fining In accordance with Article X, Enforcement, any violation not corrected with fourteen (14) days following the date of the first written demand to cease and desist from the alleged violation will cause a fine of Twenty-Five and No/100 dollars ($25.00) to be added to and deemed part of the next monthly assessment. If, after thirty (30) days, the violation is not cured, the fine will increase to an additional Twenty-Five and No/100 dollars ($25.00) per week until the violation is corrected. Any homeowner receiving a second or subsequent violation within the calendar year (January-December) for the same violation, will forfeit the fourteen (14) day grace period and be fined immediately. Any person charged with a violation or fine may request a hearing with the Board of Directors by sending a written request to the Community Manager. A hearing date will then be provided for the Board of Directors, Community Manager and homeowner to discuss the violation. B. Reimbursement of Costs and Expenses - Any owner found in violation of the Declaration, By-Laws or Rules and Regulations will be required to pay all necessary and reasonable costs and expenses (including reasonable attorney fees) incurred by the Association in enforcing them. II. ARCHITECTURAL APPROVAL A. Architectural Approval Process Changes to the landscape or exterior dwelling on a lot must be approved, in writing, by the Board of Directors or the Architectural Review Committee prior to work being completed. An architectural approval request form must be submitted each time approval is requested. The form must be submitted with a list of materials and/or a contractor s proposal describing in detail the improvement being added and a copy of the Plat of Survey with the changes drawn on the Plat. 1
B. Change of Color or Style of Residence No change to the exterior color or style of any residence shall be made unless the change to the exterior color or style of any residence is approved by the Board of Directors or Architectural Review Committee. The purpose of this clause is not to dictate what color a home shall be, but rather prohibit the colors or combinations of colors that the majority of homeowners would find either offensive or inappropriate. For example, fluorescent colors such as orange, pink, lavender and purple are expressly prohibited unless approved by the Architectural Review Committee or Board of Directors. C. Exterior Lighting and Security Lights Coach lights, driveway lights, security lights and any other exterior lighting may be installed by each lot owner subject to approval by the Board of Directors or the Architectural Review Committee to ensure they are not offensive to adjacent property owners. III. GENERAL RULES A. Outdoor Storage of Vehicles Restrictions prohibit the outside storage or parking of any mobile home, commercial vehicle, trailer, camper, boat or similar vehicles. Vehicles that do not fit into the garage shall not be permitted in the driveway. Commercial vehicles are not permitted in the driveway for longer than twenty-four (24) hours. Inoperable vehicles may not be stored in the driveways and must be placed in the garage out of public view. This includes vehicles with flat tires, no license plates, vehicles with expired stickers, vehicles up on blocks or other items, vehicles covered under tarps, etc. B. Basketball Hoops Portable basketball hoops may not be used on the public sidewalks or streets and must be kept along the driveways only. Basketball hoops are to remain in an upright position at all times. All temporary basketball hoops must be stored in the garage from December 1st thru March 1st. This includes the complete structure of the basketball hoop including the base. Basketball hoops must be maintained and kept in good condition at all times. D. Swimming Pools No owner/occupant shall construct a swimming pool of any type or size, whether permanent or temporary. A portable child s swimming pool, no greater than six (6) feet in diameter is allowed, but must be removed nightly. E. Holiday Trim Tasteful holiday trim may be displayed thirty (30) days prior to said holiday and must be removed thirty (30) days after said holiday. 2
E. Swing Sets/Play Equipment/Trampolines Swing sets and play equipment must be placed in the rear yard and must be maintained. Play equipment must be kept at least ten (10) feet from the lot line to protect the neighbor s property and is not to be viewed from the front of the dwelling. Trampolines must be maintained with regular upkeep and the protective screen surrounding the trampoline must remain in good shape. All screens must be taken down from December 1st thru March 1st. F. Temporary Structures Storage sheds are not permitted. Rubbermaidtype or rubberized non-permanent storage boxes measuring 30x60 are allowed as long as they are located along the back of the home and are not visible from the front of the home. Children s playhouses are permitted if their footprint is less than thirty-six (36) square feet in area and they are not permanently attached to the ground. Temporary structures must be maintained in good condition at all times. G. Upkeep and Repair Every lot and structure on the lot shall at all times be kept in a state of good repair by the owner or occupant thereof. The owner of each lot will keep their lot mowed or weeded or shall reimburse the Homeowners Association for having it mowed and/or weeded. Grass height shall not exceed more than six (6) inches in height. H. Garbage No lot shall be used or maintained as a dumping ground. All rubbish, trash or other garbage shall be secured or kept in roll out containers or recycling bins and concealed from public view. Garbage containers, recycle bins and lawn waste bags must not be visible from the exterior of the home and must be stored in the garage. These items shall not be placed outside prior to 6:00 p.m. the evening before collection day and garbage containers and recycle bins must be returned to the garage no later than the evening of collection day. I. Fences The following restrictions apply to all fence installations: a. Fences must be approved by the Board of Directors and/or the Architectural Review Committee and the Village of Oswego prior to installation. b. Owner shall maintain fence in good condition and repair at the Owner s sole cost and expense. c. Fence shall be constructed with wood or cedar boards only, not to exceed five (5) feet in height. d. Fence shall not encroach on any easement dedicated for the purpose of landscape improvements or community enhancements. e. Parcel 3 Fence Restrictions Only five (5) feet cedar board-onboard fences are permitted. However, only cedar, two rail, split rail fences are permitted on Lots 1 through 18, both inclusive. 3
Attaching hog type wiring on the fence for pet control is only permitted on the fence facing the home. f. Parcel 5 Fence Restrictions Developer shall erect six (6) feet cedar board-on-board fences along the rear lot line of Lots 45 through 76, both inclusive, which the Association shall maintain. Only six (6) feet cedar board-on-board fences along the rear lot line of Lots 45 through 76, both inclusive, are permitted. Only split rail fences are permitted on Lot 98, Lot 139, Lots 1 through 35, both inclusive, Lots 76 through 70, both inclusive, and Lots 81 through 85, both inclusive. g. Parcel 6 Fence Restrictions Developer shall erect six (6) feet cedar board-on-board fences along the rear lot line of Lots 255 through 268, both inclusive, which the Association shall maintain. Only six (6) feet cedar board-on-board fences along the rear lot line of Lots 255 through 268, both inclusive, are permitted. Only split rail fences shall be permitted on Lot 215. J. Village Permits Homeowners are required to obtain building permits from the Village of Oswego for all exterior improvements to the Lot. K. Firewood Homeowners may store firewood outside of their home provided that the firewood is stacked no higher than four (4) foot by eight (8) foot and is stored immediately adjacent to the back, exterior wall of the home. Firewood must not be visible from the front of the dwelling. L. Window Air Conditioners Window air conditioning units are not allowed anywhere in the Churchill Club Homeowners Association. M. Garage Sales Homeowners are allowed to have one (1) garage sale per year at a date of their choice. N. Pod Storage/Storage Containers/Outdoor Storage Storage containers are allowed on the driveways for no more than fourteen (14) days after closing on a home. After fourteen (14) days, these containers must be removed. These containers are not allowed at any other time in the community. Nothing is to be stored on the side of home or driveway. For example, play equipment must be kept in the back yard and lawn or patio furniture may not be stored on the driveway. Fire pits must also be kept in the rear yards, not on driveway or side of home. 4
O. Pets The following restrictions apply to all pets: a. No pets are allowed to run loose within the community. When taken outside, all pets must be on a leash no more than six (6) feet in length. A responsible person shall hold the leash at all times. b. The number of pets kept in a dwelling may not exceed the number allowed by the Village of Oswego. c. Dogs must be restrained from excessive barking whether inside or outside of the dwelling or on the Lot. d. No pet shall be kept which causes a nuisance or disturbance to surrounding homeowners. e. Pet owners shall keep their pets under control at all times. f. Pet owners must carry a scoop or bag and must pick up after their pet(s) immediately and disposal of waste must be discarded in the homeowner s garbage container. g. Owners are responsible for any lawn, landscaping or property damage caused by their pet(s) and must be repaired at owner s expense. If the damage is not repaired, the owner shall be notified by the Management Company to do so. Failure to do so in the required time shall cause the repair to be made by the Association and billed back to the owner. P. Noxious or Offensive Activity No noxious or offensive activity shall be carried on, in or upon the Property, nor shall anything be done thereon which may constitute or become an annoyance or nuisance to the neighboring Owners. Q. Satellite Dishes The following restrictions apply to all satellite dishes: a. Satellite dishes shall not be visible from the fronts of the dwelling and every effort shall be made to place the satellite dish in the rear of the home if a signal is obtainable there. b. Satellite dishes cannot be larger than what is specified by the FCC. c. Should a satellite dish fall into disrepair, the Board has the authority to repair or remove it at the owner s expense following written notice to the homeowner. R. Unsightliness No clothes, sheets, blankets, laundry, towels or any other items of this nature may be hung or exposed on any part of the dwelling or yard. 5
