Qualified Person s Statements and Certifications As the qualified person, I certify that: A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. As of 2015/06/17, no phase two environmental site assessment is required by the regulation for the RSC property and based on the phase one environmental site assessment for the RSC property, in my opinion, it is not necessary for any other reason to conduct a phase two environmental site assessment for the RSC property. As of 2015/06/17, in my opinion, based on the phase one environmental site assessment, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that, if the RSC property were put to any of the types of property uses listed in subsection 1 (2) of the regulation, are likely to interfere with any of those types of property uses. I am a qualified person and have the qualifications required by section 5 of the regulation. I have in place an insurance policy that satisfies the requirements of section 7 of the regulation. Phase One Conceptual Site Model Conveyance Lands, Consumers Road and Yorkland Boulevard Pinchin File 89410 This section presents a Conceptual Site Model (CSM) providing a narrative, graphical and tabulated description integrating information related to the Site geologic and hydrogeologic conditions and areas of potential environmental concern/potential contaminating activities. The presentation of the Phase One CSM makes reference to the following drawings attached: Figure 1: Key Map Figure 2: Phase One Property Figure 3: Phase One Study Area Figure 4: Phase One Property and Underground Utilities Figure 5: Potentially Contaminating Activities SITE DESCRIPTION The Phase One Environmental Site Assessment (ESA) consists of seven parcels of land located adjacent to Consumers Road and Yorkland Boulevard in Toronto, Ontario (see Figure 1). The seven parcels of land (Parcels A through Parcels G), consisting of asphalt-paved parking areas, a roadway and landscaped areas, constitute the Phase One Property. The Record of Site Condition (RSC) Property (hereinafter referred to as the Site) consists of Parcel C of the Phase One ESA Property as shown on Figure 2. The total area of the RSC Property is 0.0042 hectares (0.01 acres). A plan showing the Phase One Property and the RSC Property is provided as Figure 2, and the Phase One Study Area for which this Phase One ESA applies to is outlined on Figure 3. The adjacent property uses within the Phase One Study Area and the RSC Property are illustrated on Figure 3. In summary, the Phase One Property and the RSC Property is situated in an area that predominantly consists of commercial land uses. Asphalt-paved parking lots and driveways surround the Phase One Property, with the exception of Yorkland Boulevard and Consumers Road that bound the Phase One Property to the north and east. The RSC Property was vacant in 1960 and remained vacant until 1970. In 1970 the RSC Property was developed with a roadway. Currently, the RSC property consists of a roadway. Phase One Conceptual Site Model June 23, 2015 Conveyance Lands, Consumers Road and Yorkland Boulevard Pinchin File: 89410 2200195 Ontario Limited GEOLOGICAL AND HYDROGEOLOGICAL SETTINGS The Phase One Property, Phase One Study Area and RSC Property appear to be relatively flat with a gradual slope southwards. Based on Pinchin s review of a soil investigation report completed by Soil Engineers Limited (Soil Engineers) conducted for a property in the vicinity of the Phase One Property and RSC Property, the subsurface soils generally consist of granular and earth fill material between 0.8 metres below ground surface (mbgs) and 1.2 mbgs, followed by silty clay till between approximately 6.4 mbgs and 12.6 mbgs. Based on the information provided on the physiographic, geologic and topographic maps, the Phase One Property and RSC Property are located in an area with surface soils predominantly composed of clayey silt tills overlying bedrock. According to the Ontario Geological Survey dated 2011 (Ontario Geological Survey 2011, 1:250 000 scale Bedrock Geology of Ontario; Ontario Geological Survey, Miscellaneous Release-Data 126 Revision 1), bedrock in the area of the Phase One Property and RSC Property consists of shale, limestone, dolostone and siltstone. Fill material was not observed on the Phase One Property or the RSC Property during the Site reconnaissance and none was reported by the Site Representative. According to the Ontario Ministry of Environment and Climate Change (MOECC) Well Record Data database, the depth to groundwater within the Phase One Study area is approximately 6.0 mbgs. Shallow groundwater in the Phase One Study Area is expected to flow towards Deerlick Creek, located approximately 740 metres (m) southwest of the RSC Property. Regional groundwater flow is also expected to be southwest towards Deerlick Creek. The Water Well Information database provided by Ecolog ERIS indicated that no wells were located on the Phase One Property or the RSC Property. The Water Well Information System database indicated that six observation wells were located within the Phase One ESA study area. An RSC was filed for the property located at 251 Consumers Road, which did not include the Phase One ESA Property or the RSC Property. No water bodies exist on the Phase One Property. No areas of natural significance were identified within the Phase One Study Area. UNDERGROUND UTILITES Underground utilities (i.e., sanitary, sewer, potable water) that are located on the Phase One Property and the RSC Property are depicted on Figure 4. An existing metro tunnel, generally oriented east-west and extending along the south Parcel C, was noted on a 1975 site plan reviewed by Pinchin. No additional information was provided on the metro tunnel. The depths of utilities located range between 2 and 3 m below ground surface. The depth to groundwater at the Phase One property is estimated to be approximately 6 mbgs, and the utility corridors are expected to be well above the water table and would not act as preferential pathways for contaminant distribution and transport in the event that shallow subsurface contaminants exist at the Phase One Property or the RSC Property. 2015 Pinchin Ltd. Phase One Conceptual Site Model June 23, 2015 Conveyance Lands, Consumers Road and Yorkland Boulevard Pinchin File: 89410 2200195 Ontario Limited POTENTIALLY CONTAMINATING ACTIVIES Based on the results of the Phase One ESA completed by Pinchin, the following potentially contaminating activities (PCAs) were identified within the Phase One Study Area: 1. Item 28 Gasoline and Associated Products Storage in Fixed Tanks: A former buried fuel oil underground storage tank (UST) was located at 251 Consumers Road (approximately 115 m southeast of Parcel C). According to previous reports reviewed, the UST was removed in 2000. Based on the distance from the Site, the inferred direction of groundwater flow, the fact that the UST was removed in 2000, as well as the low permeability of the subsurface soils, it is Pinchin s opinion that it is unlikely that this PCA has the potential to impact the Site. Therefore, it is not considered to represent an Area of Potential Environmental Concern (APEC) at the Site; 2. Item 28 Gasoline and Associated Products Storage in Fixed Tanks: One 25,000-L diesel aboveground storage tank (AST) is located at 243 Consumers Road. The AST, reportedly associated with an emergency generator, is located approximately 75 m south of the RSC Property (i.e., Parcel C), and is inferred to be hydraulically transgradient relative to the Site. Based on the distance from the Site, as well as the inferred direction of groundwater flow, it is Pinchin s opinion that it is unlikely that this PCA has the potential to impact the Site. Therefore, it is not considered to represent an APEC at the Site; 3. Item 28 Gasoline and Associated Products Storage in Fixed Tanks: One 10,000-L diesel AST is located in a concrete enclosure associated with the buildings located at 243, 245, 251 and 255 Consumers Road. The AST is associated with an emergency generator, is located approximately 80 m south of the RSC Property (i.e. Parcel C), and is inferred to be hydraulically transgradient/downgradient relative to the Site. Based on the distance from the Site, as well as the inferred direction of groundwater flow, it is Pinchin s opinion that it is unlikely that this PCA has the potential to impact the Site. Therefore, it is not considered to represent an APEC at the Site; 4. Item 28 Gasoline and Associated Products Storage in Fixed Tanks: One 30,000-L diesel AST is located within a gated area associated with 243, 245, 251 and 255 Consumers Road. The AST associated with an emergency generator, is located approximately 80 m south of the RSC Property (i.e., Parcel C), and is inferred to be hydraulically transgradient/downgradient relative to the Site. Based on the distance from the Site, as well as the inferred direction of groundwater flow, it is Pinchin s opinion that it is unlikely that this PCA has the potential to impact the Site. Item 28 Gasoline and Associated Products Storage in Fixed Tanks: A gasoline/diesel fuel tank was listed in the TSSA expired facilities database (date not provided) at the property located at 255 Consumers Road. This property is located 160 m southeast of the RSC Property (i.e. Parcel C), and is inferred to be hydraulically transgradient relative to the Site. Based on the distance from the Site, as well as the inferred direction of groundwater flow, it is Pinchin s opinion that it is unlikely that this PCA has the potential to impact the Site. Therefore, it is not considered to represent an APEC at the Site; 6. Item 28 Gasoline and Associated Products Storage in Fixed Tanks: A 600 gallon oil UST was present at the south corner of the building located at 243 Consumers Road. The UST was located approximately 80 m south of the RSC Property (Parcel C) and is inferred to be hydraulically transgradient relative to the Site. Based on the distance from the Site, as well as the inferred direction of groundwater flow, it is Pinchin s opinion that it is unlikely that this PCA has the potential to impact the Site. Therefore, it is not considered to represent an APEC at the Site; and 7. Other Extensive asphalt paved parking areas and use of de-icing salt: The Phase One Property consists of seven parcels on land. The RSC Property (Parcel C) consists of the roadway (Yorkland Boulevard). It should be noted that the parcels of land are located adjacent to the multiple-lane municipal roadways, Yorkland Boulevard and Consumers Road, which are considered to be a highway as defined in Ontario Regulation 339, where salt has been applied by a government or municipal authority for the purposes of keeping the highway safe for traffic under conditions of snow or ice or both. As such, given that the Site is located directly on a roadway, salt-related impacts would not be considered to be an APEC for the Site. Also, the City of Toronto will be occupying the Site for similar use (parking lot and roadway), and salt will be continued to be applied in the future. Based on Pinchin s observations of the Phase One Study Area and the RSC Property, none of the PCAs identified in the Phase One Study Area are likely to result in potential subsurface impacts at the Site. As such, no APECs were identified. The PCAs are shown on Figure 5. The Phase One ESA included a thorough review of background information including aerial photographs, previous reports, regulatory searches, interviews, Site reconnaissance, etc. There is no indication of uncertainty with any of the sources that would invalidate the Phase One CSM. Based on the information obtained through the records review and Site visit, no APECs were identified within the Phase One ESA property and the RSC Property.
