Approve Minutes of the August 23, 2016 meeting Member Johnson moved to approve the minutes, seconded by Member Davis. Minutes were approved by voice vote. Update Past Planning and Zoning Commission items 1. A variance request of Section 152.131 (A) to waive the site plan requirement for an addition to 399 North Henderson St was approved. The owner is working on having construction documents developed to submit for review and permits. 2. A variance of Section 152.232 (6) to allow a sign with a 4 foot setback instead of the required 10 feet at 2284 Promenade Ct. was approved. A sign permit has been issued. 3. A variance of Section 152.155 to reduce the number of required parking spaces from 51 to 48, a variance of Section 152.232 (A) (2) to allow a sign area of 210 square feet instead of 100 square feet, a variance of Section 152.232 (A) (6) to reduce the setback of the sign from the south property line from 10 feet to 5 feet, a variance of Section 152.232 (A) 4 to allow a sign at 30 feet in height instead of the allowable 20 feet. To be located on the lot south of 2364 N Seminary St (Casey s gas station). The variance was approved and the owner has until November 23, 2016 to apply for a permit. 4. A drive through facility for proposed new construction of a Burger King. To be located on the lot south of 2364 N Seminary St (Casey s gas station). PZ-16-0901 Public Hearing Proposed amendment to the Development Ordinance in regards to Cluster Neighborhood Units. Member Leigh Nygard entered the meeting at 7:01 pm. The Commission members considered the following items: The amended ordinance will provide more options for residential development, thereby increasing the amount of dwelling units within the community. The proposed provisions were in the ordinance prior to the adoption of the Development Ordinance in 2010, but were not carried over at that time. The Development Review Committee reviewed the request at their September 1, 2016 meeting and recommend the approval. Member Johnson moved, seconded by Member Davis to recommend approval of the ordinance amendment. Roll Call #1 Ayes: Adams, Davis, Guenseth, Johnson, Lufkin, Nygard, Spittell, 7. Nays: None. Abstentions: None. Chairperson declared the motion approved. Item will go to City Council for the first reading on September 19, 2016. PZ-16-0902 Review Final Plat of the Lincoln Park North Subdivision. The applicant was present. The Commission members considered the following items: The Development Review Committee reviewed the request at their September 1, 2016 meeting and recommend the approval, contingent upon the following items being addressed: Modify the lot numbers to reflect a total of 26 lots. Show location of 100 year floodplain and indicate the base flood elevation as determined by FEMA Need to provide drainage easement over the floodplain area. Waiver of the sidewalks. The surveyors certificate needs to show a listing by number of all lots shown on the plat that are subject to periodic flooding or inundation based on the highest floodplain elevation record in the area. Any private restrictions or covenants and their periods of existence must be shown on the plat or the document referenced if too large to include on the plat. Remove the building setbacks and zoning districts listed on the plat. Page 2 of 3
Member Johnson moved, seconded by Member Guenseth to recommend approval of the Final Plat, contingent upon the items recommended by the Development Review Committee being resolved. PZ-16-0903 Consider An appeal of the decision of the Acting Director of Community Development for a property located at 820 E Fifth Street. This item was postponed from the August 23, 2016 meeting. The applicant was present. City Attorney Brad Nolden summarized the request before the commission and their duties as a commission. The Commission members considered the appeal: Comments were heard by those in attendance: Attorney James Skinner (representing Doug Ball) Doug Ball Chris Powers (former resident of 820 E Fifth Street) Not in favor of the facility. Mark Chaney (resident at 1180 S Pearl Street) Not in favor of the facility. Jeff A. Larson (resident of 820 E Fifth Street) In favor of the facility. Robert Wayne Reed (manager of 820 E Fifth Street Facility) In favor of the facility. Dale Hubert (resident 1278 Day Street) Questioned the zoning of the property. Attorney Nolden asked Mr. Ball if the facility was owned or associated with Carl Sandburg or Knox College and Mr. Ball stated it was not currently associated with either college. Member Adams moved, seconded by Member Johnson, to affirm the decision of Acting Director. Roll Call #3 Ayes: Adams, Davis, Guenseth, Johnson, Lufkin, Nygard, Spittell, 7. Nays: None. The applicant is requesting a variance of Section 152.231 (B) (1) to allow two wall signs instead of one The property is located within the Institutional (I) zoning district, which only allows one onpremise wall, projecting and roof sign per business. Knox College has proposed the installation of a wall sign on the west side (facing South Prairie Street) and second wall sign on the north side (facing East South Street) of the new building. Due to the fact that one wall sign is allowed per code, a permit was issued for the installation of one sign on the west side of the building. The variance before you is to consider allowing a second wall sign on the north side of the building. The property to the north is zoned Institutional (Corpus Christi Church), property to the south is zoned Institutional (Knox College), to the east is zoned Light Industrial (Aluminum Castings) and to the west properties are zoned Institutional (Knox College) and Central Business (YMCA). The Development Review Committee members reviewed the variance request at their October 5, 2016 meeting. The Committee members unanimously recommended approval of the variance. The applicant is requesting a variance of Section 152.232 (B) (1) to allow a wall sign that will exceed ten percent of the wall area. The south and west sides of the canopy currently have wall signs that display prices for unleaded and diesel gas. Hy-Vee would like to add to these signs to display the price of E85 gas. Adding to the west side wall sign can be done in compliance with the sign ordinance, so a sign permit has already been issued for the west side. The variance before you is to consider allowing the wall sign on the south side to exceed ten percent of the wall area. The total wall area of the south side of the canopy is 98 square feet and ten percent of this area would allow a wall sign of up to 9.8 square feet. The addition of the E85 sign on the south side would put the wall sign area at 36 square feet, which would be 26.2 square feet over the allowed size. The property in question is zoned General Business District (B2). The property to the north is zoned B2 (Heritage Credit Union), property to the south is zoned B2 (multi-tenant building including banking and office space), to the east is zoned B2 (Hy-Vee) and to the west is zoned B2 (Taco Johns & Applebee s). The Development Review Committee members reviewed the variance request at their October 5, 2016 meeting. The Committee members unanimously recommended approval of the variance. CITY OF GALESBURG Community Development Memo Operating Under Council Manager Government Since 1957 TO: Planning and Zoning Commission Members FROM: Steve Gugliotta, AICP DATE: October 10, 2016 SUBJECT: Variance application 505 Burgland Ave Attached for the Commission s review is a variance application received from Larry Whitaker regarding the construction of accessory structures that will exceed a cumulative total of 2,000 square feet, located at 505 Burgland Ave. The applicant is requesting a variance of Section 152.111 (B) (8) to allow the construction of another accessory building, which will put his cumulative total of all accessory buildings on his lot at 2,184 square feet, which is 184 square feet larger than allowed. Mr. Whitaker currently resides at 505 Burgland Ave. and has an existing detached garage and storage shed that are a combined 1,480 square feet. In April 2016, he purchased the dilapidated residence to the south (497 Burgland Ave), demolished the structure and combined the lots into a single lot. The property is 132 feet x 128.87 feet, for a total of 17,010.84 square feet. The owner is proposing to construct a new detached garage that will be 704 square feet. As mentioned above, the combined total of all accessory buildings will exceed the allowable limit by 184 square feet (existing 1,480 sq. ft. + proposed new 704 sq. ft. = 2,184 sq. ft.). The owner would like to use the new garage for the storage of vehicles. Also attached is a sketch of a site plan showing the approximate location of the proposed new garage. This sketch was created by staff based upon a discussion with the owner. The property in question is zoned Single Family (R1B). The properties on all four sides of his lot are all zoned R1B and used for residential purposes. The Development Review Committee members reviewed the variance request at their October 5, 2016 meeting. The Committee members unanimously recommended approval of the variance.
