INTRODUCTION This information guide on How to Become an Approved Education Provider contains important information that will assist you with understanding the Continuing Education program for real estate registrants in the Province of Ontario. It will assist you in completing your application to be reviewed for approval as an Approved Education Provider. The information below outlines the purpose of key documents contained in this Guide. The Continuing Education Policy, as amended March 29, 2010, outlines the continuing education requirements that brokers and salespersons must comply with in order to apply for renewal or reinstatement of registration under REBBA 2002. It also outlines some key requirements for courses that can be claimed for Continuing Education (CE) credits. The Information for Continuing Education Providers form is a document that should be initially reviewed to understand the purpose of the continuing education program and RECO s expectations of Approved Education Providers. The document is a useful resource that will walk you through the documentation to be included in your application and will provide you with an outline of the approval process. The Approved Subject Areas lists course/seminar topics that are approved by the Registrar, REBBA 2002, to qualify for Continuing Education credit. Please ensure that the course/seminar you are submitting in your application falls within one of these categories. Also note that a course falling within an approved subject area does not guarantee approval of a course. There are many other review criteria that must be met, including but not limited to achievement of defined learning objectives, breadth and depth of content, compliance with REBBA 2002 and other relevant legislation, etc. Once you have reviewed the Information for Continuing Education Providers and Approved Subject Areas, you may begin to prepare an application to be considered for approval. The Education Provider Application Form must be completed in its entirety and must be attached to each application submitted for consideration. We have provided in this guide a sample Approved Education Provider Designation, which outlines the terms of the relationship, duties and obligations between the Approved Education Provider and the Registrar, REBBA 2002. Upon approval of any course/seminar for CE credit, the Education Provider will be required to sign a Designation prior to advertising or delivering the course/seminar for CE credit. The Approved Education Provider Communication Guidelines is designed to outline the language and terminology requirements for publications, forms, websites, etc. that advertise an approved education provider s course/seminar for CE credit. This document will also assist you in preparing your application by outlining the proper real estate related terminology that should be included in your application materials. Within ten days of conducting a course/seminar for CE credit, the Approved Education Provider is required to provide a Certificate of Completion to all students who successfully completed the course/seminar. We have included a sample Certificate of Completion in this guide. You do not have to use this form, but any Certificate of Completion must clearly indicate the Approved Education Provider name, title of the approved course/seminar, registrant name, date the course/seminar was conducted and the number of CE credits awarded. Please note that Approved Education Providers must maintain proof of registrant attendance for all course(s)/seminar(s) conducted for a period of four years. Once a course has been approved for CE credit, the approval is granted for a one-year period. The renewal will be based on the anniversary date of the initial course/seminar approval. Should an Approved Education Provider determine that they would like to continue to offer the course/seminar for CE credit; the Approved Education Provider must submit an Approved Education Provider Renewal Application Form. RECO will send Approved Education Providers a renewal package in advance of the course approval expiry that will fully outline the process for renewal of approvals for an additional one year period. Once the Approved Education Provider has submitted an Approved Education Provider Renewal Application Form (the renewal will be reviewed and should the approval be extended, a communication will be sent to the Approved Education Provider outlining the renewed approval date). CONTINUING EDUCATION POLICY Effective date: March 29, 2010 Approved by: Registrar, REBBA 2002 PURPOSE: To establish the continuing education requirements brokers and salespersons must comply with in order to apply for renewal or reinstatement of registration under REBBA 2002. All other requirements for renewal or reinstatement of registration must still be met. SCOPE: Ontario Regulation 579/05 POLICY: 1) Terms that are defined in the Real Estate and Business Brokers Act, 2002 (REBBA 2002) and its regulations have the same meaning when they are used in this Policy. 2) A registrant shall accumulate at least twenty-four credits in continuing education courses/seminars (CE credits) during each two-year registration cycle. 3) All continuing education courses/seminars completed to maintain registration under REBBA 2002 must be courses/seminars that: i. are presented or delivered by providers that have been pre-approved by the Registrar (pre-approved education providers); or, ii. are approved by the Registrar (approved education providers); and iii. deliver content that falls within one of the subject areas approved by the Registrar. 4) To receive CE credit for a continuing education course/seminar, a registrant must successfully complete all requirements for that course/seminar, including class attendance, class participation and passing grades on assignments and/or examinations, as applicable. 5) A minimum of one classroom hour of approved instruction time (or its equivalent in a correspondence or on-line course/seminar) is required to achieve one CE credit. The number of CE credits allocated to courses delivered by approved education providers is determined by the Registrar. 6) A registrant who completes more than twenty-four CE credits in continuing education courses/seminars in any two-year registration cycle may apply a maximum of eight excess CE credits towards the continuing education requirements for the subsequent two-year registration cycle (carry-forward credits). 7) Pre-registration courses (Real Estate as a Professional Career; Land, Structures and Real Estate Trading; The General Real Estate Transaction; The Commercial Real Estate Transaction or The Residential Real Estate Transaction), including any instruction time for these courses, do not qualify for CE credits under any circumstances. Furthermore, any courses completed to fulfill the educational requirement for registration do not qualify for CE credits or for carry-forward credits. These include the three education courses taken in the initial two-year registration cycle (Real Property Law, The Commercial Real Estate Transaction or The Residential Real Estate Transaction course not completed during pre- 2

registration, and one elective) as well as the Real Estate Broker Course and additional elective required to qualify for broker registration. 8) A registrant must complete one of the RECO Real Estate Update courses (Residential or Commercial) during each two-year registration cycle. Credits for either course cannot be carriedforward under any circumstances. 9) A registrant shall not receive credit for the same continuing education course/seminar more than once in any two-year registration cycle. Where a registrant completes both RECO Real Estate Update courses (Residential and Commercial) within the same registration cycle, the second RECO Real Estate Update course can be claimed for six CE credits towards the remaining continuing education requirement within the same registration cycle. 10) The instructor of any continuing education course/seminar may use that course/seminar to satisfy part of the instructor s own continuing education requirements. However, the instructor shall receive credit for a particular course/seminar only once in any two-year registration cycle, regardless of the number of times the course/seminar was instructed. 11) A former registrant who is eligible to reinstate registration must complete one of the RECO Real Estate Update courses (Residential or Commercial) prior to submitting an application to reinstate. In addition, a former registrant who is eligible to reinstate registration, and was registered in excess of six months during the last registration cycle, must complete one CE credit for each additional month or partial month s/he was registered prior to submitting an application to reinstate. The last registration cycle runs continuously from the commencement of the last registration renewal/reinstatement to the termination of registration inclusive. 12) A registrant who changes registration category during any registration cycle from: i. Broker to Sole Proprietor; ii. Sole Proprietor to Broker; iii. Sales Representative to Broker; iv. Broker to Sales Representative; v. Sales Representative to Sole Proprietor; or vi. Sole Proprietor to Sales Representative, is entitled to carry-forward into the first registration cycle in the new registration category, a maximum of eighteen previously unclaimed CE credits that were completed during the immediately preceding registration cycle for the previous registration category. One of the RECO Real Estate Update courses (Residential or Commercial) referred to in Paragraph #8 herein must be completed during the first registration cycle in the new registration category, regardless of whether the course was completed during the last registration cycle in the previous registration category. 13) When applying for renewal or reinstatement of registration a registrant must submit proof, in a form satisfactory to the Registrar, declaring that s/he has successfully completed the continuing education requirement as outlined in Paragraph #2 herein. 14) A registrant must retain proof for a period of four years that s/he has successfully completed a specific course/seminar. Acceptable forms of proof would be a course/seminar Completion Certificate or Transcript issued by the education provider directly, indicating the course/seminar name and course/seminar completion date. 3

15) Failure to fulfill the continuing education requirements is a breach of Regulation 579/05 and a registrant s application for renewal will not be processed, resulting in loss of registration under the Real Estate and Business Brokers Act, 2002, and loss of the right to trade in real estate until continuing education requirements have been met and registration has been reinstated. 4

INFORMATION FOR CONTINUING EDUCATION PROVIDERS 1. In deciding whether to approve a continuing education provider, the Registrar, REBBA 2002 ( Registrar ) may take into account the following purposes: a) Protecting the general public and registrants in real estate transactions; b) Enabling registrants to better serve the objectives of consumers in real estate transactions; c) Developing and enhancing the competence and professionalism of registrants in a changing marketplace; d) Any other purposes that the Registrar considers useful for registrants and applicable to the real estate industry. 2. Only the following bodies or persons may be approved education providers: a) Publicly recognized continuing education institutions; b) Industry recognized real estate related institutes and associations; c) Individuals who have been approved by the Registrar as having the requisite expertise and training to offer a continuing education course for registrants; 3. Education provider approval, other than for pre-approved education providers, is for specific courses/seminars set out in the approval letter and does not carry over to other courses/seminars. 4. Courses/seminars provided by approved education providers must be open and available to all RECO registrants. For purposes of this Paragraph, open and available means: - Information about courses/seminars will be provided to any RECO registrant who requests it; - Courses/seminars that qualify for CE credits shall be offered to all RECO registrants on a firstcome, first-serve basis; and - Different fee levels for attending a course/seminar shall not be arbitrarily set so as to discourage attendance by all RECO registrants. The Registrar may approve the use of distance learning methods for teaching of courses/seminars. 5. An education provider shall include in any material that is distributed in connection with a course/seminar the following statement: [Name of provider] is solely responsible for the content of the material used in this course/seminar. If there are no written materials, the education provider shall include in the notice of the course/seminar or in the registration form the following statement: [Name of provider] is solely responsible for the content of this course/seminar. 6. In order to obtain approval of any course/seminar for the delivery of CE credits, education providers must submit to the Office of the Registrar a completed application package containing the following: Application a. A non-refundable application fee of $250.00, must accompany each course/seminar application b. 5 copies of the application form including course/seminar objectives, outline, instructor and student material, evaluation form, and a lesson plan consisting of a set of topics and the amount of time to be allotted to each topic c. 5 copies of references for the Organization/Institute/Company/Individual Objectives for Course/Seminar All courses/seminars shall be based on clearly worded objectives indicating the overall purpose of the course/seminar and the learning outcomes each participant will achieve as a result of completing the course/seminar (e.g. Upon completion of this course/seminar, the participant will be able to ). 5

Course/Seminar Outline This provides an overview of the content by addressing the topics and concepts that will be covered. This may be in the form of an agenda or a table of contents. Course/Seminar Materials Material used for the course/seminar must be submitted with the application, including a detailed Leader s Guide/Instructor Notes, a workbook, a text book, handouts, exercises, quizzes/tests and/or assignments, as will be used in the course/seminar. The materials will need to be submitted in sequential order, inclusive of page numbering. Applications received that are not submitted in a sequential order will be returned to the Education Provider. Lesson Plan A Lesson Plan demonstrates that the course/seminar will be delivered in such a way as to create the best possible learning experience for participants. It will indicate the delivery style and the type of activities participants will engage in. The Registrar s objective for quality delivery includes participation by the learner. Adult education experiences require a variety of learning activities in order to accommodate a variety of learning styles. Course/Seminar Evaluation Form It is essential that any education provider monitor the success of the course/seminar they are offering. This will include addressing how the course/seminar is evaluated and how ongoing evaluation is conducted. 7. The approval of an education provider, other than a pre-approved education provider, will be in effect for the one year based on the anniversary date the course/seminar was initially approved for CE credit, as indicated on the Education Provider Designation. 8. An education provider, other than a pre-approved provider, shall apply for extension of approval as an education provider in a form provided by the Office of the Registrar. If any extension of approval is granted, it will be valid for one year, expiring on the anniversary date the course/seminar was initially approved for CE credit, as indicated on the Education Provider Designation. 9. Within 10 days of a course/seminar, an education provider must issue a Completion Certificate to each registrant completing a course/seminar. The education provider must retain proof for a period of 4 years that a registrant has completed a course/seminar. 10. At any time the Registrar may require that an approved education provider submit to the Office of the Registrar a course evaluation form from any and/or all registrant(s) who attended a course/seminar. 11. A continuing education course/seminar shall have: a) Content suitable for practicing real estate registrants; b) At least one hour of instruction; c) A course outline, course objectives and a lesson plan consisting of a set of topics and the amount of time to be allotted to each topic; and d) Where appropriate, course material shall contain references to applicable federal and provincial laws, including but not limited to the Real Estate and Business Brokers Act, 2002 (REBBA 2002) and its regulations. 6

12. Subject areas for continuing education courses/seminars for real estate registrants are listed on the attachment entitled Course Subject Areas. Areas that are not appropriate for continuing education purposes include: a) Motivational training; b) Manipulative selling skills; c) Philosophical or psychological self improvement; d) Training or education not related to real estate; e) In-house sales training programs. Please be advised that by submitting an Education Provider Application to RECO and the payment of the non-refundable Application Fee, the applicant acknowledges that the applicant has read and understood the following: The submission of an application by an education provider and/or payment of the appropriate application fee(s) by the applicant, do not commit the Registrar to, nor is the Registrar bound to: Approve the application, either in whole or in part; and/or Approve the applicant as an education provider; and/or Approve any course/seminar, either in whole or in part; and/or Approve the number of credits proposed by the applicant for any course/seminar. Approval is within the sole discretion of the Registrar and the Registrar has the sole right to reject or approve, in whole or in part: Any application; Any education provider; Any course/seminar; The number of credits proposed by the applicant. In addition, the Registrar has the sole right to require changes to: Any course/seminar; The number of credits before approval is granted. Under no circumstances will the Registrar be liable for or pay any damages, loss, costs or expenses, howsoever incurred, in the preparation and submission of an application and/or the approval process, including without limitation, research and development costs, delay, lost or mislaid applications, required changes or lost profits. THIS DOCUMENT MAY BE AMENDED BY THE REGISTRAR, REBBA 2002, FROM TIME TO TIME, AT THE SOLE DISCRETION OF THE REGISTRAR. A COPY OF THIS DOCUMENT WILL BE MAINTAINED ON THE RECO WEBSITE (WWW.RECO.ON.CA). 7

In the event of the expiration, revocation or termination of this Designation, EP ID # shall immediately cease offering Course # for educational credit(s) and under no circumstances will all or any part of the annual fee, if applicable, be refunded to EP ID #. 4) EP ID # shall provide Course # and perform its obligations under this Designation with honesty, integrity, promptness and diligence and in a manner consistent with standards achieved by well-managed continuing education providers performing similar services or such other standards as the Registrar may set out in writing from time to time, including without limitation, in the Registrar s Information Guide on How to Become an Approved Education Provider, as same may be amended from time to time (the Guide ). Such Guide forms part of this Designation and the Guide s terms and conditions are hereby incorporated into this Designation. EP ID # shall, at its sole cost and expense, comply with the Guide and immediately implement changes to comply with the Guide, as same may be amended from time to time. At all times EP ID # shall provide a positive educational environment and ensure the comfort and safety of students and instructors. 5) EP ID # shall not amend, alter, or modify all or any part of Course without the prior written approval of the Registrar. The Registrar may, at any time and from time to time, advise EP ID # of changes, alterations or modifications to be implemented to Course # in which event EP ID # shall immediately make such changes, alterations or modifications at its sole cost and expense. 6) EP ID# shall ensure at all times during this Designation, that the instructors EP ID # employs, appoints and/or retains to provide Course # are properly educated, trained, fully qualified, experienced and competent to deliver Course #. Proof of qualifications and/or credentials of instructors shall be provided to the Registrar from time to time upon request. 11

7) EP ID # shall, for a minimum period of four (4) years, maintain at its head office located at a complete and accurate written record of all and every data and material relevant to the provision of course #, including but not limited to the followng; (i) a current list of all present and past instructors including their addresses, telephone numbers, qualifications, experience, and other credentials: (ii) the names, addresses and telephone numbers of all past and present students enrolled in Course #; (iii) copies of all pass/fail results, attendance records, examinations and/or transcripts of all past and present students; (iv) the location, schedule and date for all deliveries of Course #; and (v) copies of all current and past advertisements and promotional materials for Course #. EP ID # shall provide any and all such records to the Registrar (and any other records required to be maintained under the Guide) within 72 hours of the Registrar s request or such other time frame as the Registrar may in writing indicate. This obligation shall survive the expiry, revocation or termination of this Designation. 8) The Registrar and/or other persons authorized by the Registrar, shall have the right, with or without notice or announcement, to monitor, observe, audit or inspect Course # and/or EP ID # for the purpose of ensuring compliance with the Act and its Regulations, handling a complaint to the Registrar, ensuing compliance with this Designation and/or its restrictions, limitations and conditions and/or ensuring quality assurance or quality control with respect to the provision of Course #. EP ID #, its agents and those in law for whom it is responsible shall produce any information, documents or records and provide whatever assistance is reasonably necessary (including any data storage, processing or retrieval device or storage) to produce relevant information in any form and shall not obstruct any such monitoring, observation, audit or inspection or withhold, conceal, alter or destroy any relevant information, documents or records. The information, documents or records must be provided to the Registrar within 72 hours of the Registrar s request or such other time frame as the Registrar may indicate in writing. 9) This Designation is not transferable and cannot be assigned by EP ID # without the prior written consent of the Registrar, which may be unreasonably withheld, specifically; EP ID# must notify the Registrar in the event that EP ID # sells their business, ownership and/or corporation to another individual and/or corporation. 12) A delay or omission by the Registrar to exercise any right or power shall not be construed as a waiver and a waiver by the Registrar of a breach shall not be construed to be a waiver of any succeeding breach. In the event EP ID # breaches this Designation or its restrictions, limitations or conditions, the Registrar shall have the right, in the Registrar s sole and unfettered discretion, at any time and from time to time, to amend and/or revoke not only this Designation for Course #, but any other designation whereby EP ID # is authorized to provide educational course(s) for continuing education credit(s) under the Act. 13) This Designation supersedes all prior designations, approvals, authorizations, etc. for EP ID # to provide Course # for continuing educational credit(s) under the Act. 14) EP ID # has the sole obligation, accountability and responsibility, at its sole cost and expense, to comply with all relevant laws, with respect to the provision of Course # and the fulfillment of its obligations under this Designation, including without limitation, Ontario Human Rights Code, Personal Information Protection and Electronic Documents Act (particularly student personal information), Private Career Colleges Act, Accessibility for Ontarians with Disabilities Act, WHMIS, etc. 15) Throughout the term of the Designation, the Education Provider shall have and maintain adequate insurance coverage, including commercial general liability coverage for bodily injury and property damage; and (ii) professional liability coverage for errors and omission (including educator s errors and omissions coverage extending to any claims arising from, or allegations of sexual abuse, failure to educate and breach of professional duty). 16) This Designation shall terminate immediately in the event of (i) EP ID # s bankruptcy, assignment for the benefit of creditors, not meeting its financial obligations as they become due, having a receiving order made or having a receiver or receiver-manager appointed; or (ii) changes or repeal of the Act relating to the powers of the Registrar with respect to the designation of organizations authorized to provide educational courses or the changes to or repeal of RECO s administrative authority status; or (iii) EP ID # selling its or their business, ownership and/or corporation to another individual and/or corporation and the Registrar cancels or terminates this Designation upon such sale or transfer in accordance with clause 9 above. 17) EP ID # shall indemnify and hold harmless the Registrar and RECO and Her Majesty the Queen in Right of Ontario as represented by the Minister Consumer Services and those in law for whom they are responsible from any and all damages, losses, costs, expenses, injuries, liabilities, claims, fines, settlements, penalties and all related costs and expenses, whatsoever, arising from or in connection with any act, default, neglect or misconduct, actual or alleged, in the execution or intended execution of EP ID # s obligations under this Designation or a breach of this Designation or its restrictions, limitations or conditions and will co-operate fully with the Registrar and RECO or their insurers. These indemnity obligations will survive the expiration, revocation or termination of this Designation. COMMUNICATION GUIDELINES FOR EDUCATION PROVIDERS Approval as a Continuing Education Provider in the Province of Ontario is granted based on the material submitted in an application to the Real Estate Council of Ontario, Education Department, and is subject to you continuing to meet the requirements of the Information for Education Providers guidelines as amended from time to time by the Registrar. In order for a course/seminar to be approved for continuing education (CE) credits all course materials, including text, workbooks, etc. are to contain current REBBA 2002 terminology. In addition, all advertising, marketing and promotional materials must be compliant with our communication guidelines. The language and terminology contained in publications, forms, websites, etc. (where applicable) must always be in compliance with current terminology and the communication guidelines. Specific regard must be given to replacing terms such as realtor and agent. REBBA 2002 does not use these terms and makes specific reference to the more general terms, salesperson or registrant. The Real Estate Council of Ontario (RECO) logo may not be used in marketing materials, websites or any other publications. RECO s name is not to be used for any purpose other than to verify your status as an approved Education Provider or to confirm that a course has been approved by RECO to qualify for a specified number of CE credits. Examples of unacceptable use of RECO s name include: RECO Course RECO Education Provider RECO Credits RECO Training Examples of acceptable use of RECO s name include: Course Name is Approved by the Registrar, REBBA 2002 Education Provider Name is Recognized as an Approved Education Provider by the Registrar, REBBA 2002 Education Provider Name is an Approved Education Provider by the Registrar, REBBA 2002 Course Name Qualifies for CE Credits, as Approved by the Registrar, REBBA 2002 Course Name is Approved as a Training Program Approved by the Registrar, REBBA 2002 Continuing education (CE) credit(s) cannot be referred to as CEU, MCE, or RECO credit(s). RECO s name is not to be used for any purpose other than to verify your status as an Approved Education Provider for specific approved course(s)/seminar(s), or to confirm that a course/seminar has been approved by the Registrar to qualify for a certain number of Continuing Education (CE) credit(s). An acceptable example would be course/seminar materials, marketing or advertisements stating: This course/seminar was approved by the Registrar, REBBA 2002 to qualify for (#) CE (or Continuing Education ) credits. The course/seminar being conducted to Ontario registrants for continuing education (CE) credits must mirror the materials and information that was previously accepted and approved by the Registrar for continuing education purposes. This includes, but is not limited to, the course/seminar materials, text, title, instructor(s), fee, etc. 14

Approved Education Providers must review all current course/seminar materials to ensure they are consistent with the materials originally approved by RECO, and revise materials as required to ensure all aspects of the Information for Education Provider guidelines, including those outlined herein. Any proposed changes to the previously accepted materials must be submitted to RECO s Education Department without delay, and are not to be implemented until RECO approval of said changes is received. The term realtor specifically denotes a member of the Canadian Real Estate Association (CREA) or an affiliated organization. While in some instances this terminology is fitting, not all currently registered brokerages, brokers and salespersons in Ontario are members of CREA. The Registrar s policies necessitate continuing education (CE) courses/seminars being open and available to all Ontario registrants, and not being conducted or marketed so as to discourage attendance by registrants who are not members of CREA. As such, use of the term realtor by Continuing Education Providers is not appropriate. The term agent, which is derived from common law, does not appear in the REBBA 2002 or the Regulations. Registration categories under REBBA 2002 include brokerage, broker and salesperson. As background, an agency relationship is established when an agent accepts responsibility to act for another (a principal ) in negotiations with third parties. In terms of a real estate transaction, the term agent would refer to the brokerage, not the salesperson. Education Providers should refrain from referring to brokers and salespeople as agent(s) in all marketing and promotional material. The term broker refers to an individual who has the prescribed qualifications to be registered as a broker under REBBA 2202 and who is employed by a brokerage to trade in real estate. The term broker of record refers to a brokerage designating a broker to ensure the brokerage is in compliance with REBBA 2002 and must actively participate in brokerage management, provide adequate supervision of brokers and salespersons and deal with lack of compliance by employed brokers, salespersons or others within the brokerage. A brokerage, for the purposes of REBBA 2002, refers to a corporation, partnership or sole proprietorship that trade in real estate on behalf of others for compensation, reward, or expectation thereof. Please note that failure to comply with these guidelines may result in the loss of status as an Approved Education Provider. 15
