Information and Rules For Guests and Lessees Excerpted from Rules and Regulations for Residential Units San Marco Condominium Sarasota, Florida 34236

Welcome to the San Marco Condominium As a renter or the unaccompanied relative of an owner, we want you to have a pleasant and stressfree stay. This guide will give you the information you need to comply with our condominium rules. San Marco is a mixed-use residential and commercial condominium. Owners of the residential and commercial units are also the owners of the San Marco condominium and all related facilities and amenities. Each owner pays a share of the operating expenses of the San Marco Condominium Association, which represents the interests of all the owners through an elected Board of Directors. Owners are permitted to lease their apartments for a minimum of three months, but not more than twice per year. The San Marco Board of Directors must approve leases, and each lease must comply with the Association governing documents and contain specific items of concern to the Association. Lessees must pay a $100 processing fee to the Association. Certain relatives of owners may also visit a San Marco apartment while the owner is not in residence, and they must also comply with condominium rules. For security and safety reasons the owner must notify the Association that unaccompanied visitors are qualified relatives, and when they will be staying at San Marco. San Marco is not a hotel or motel, so guests and lessees are expected to be self-sufficient, and comply with our rules. Children must be under adult control when they are in the stairways, elevators, common elements, walkways, patios and balconies, garage, lobby, parking lot, and pool area. Trash must be securely bagged and deposited in the trash chute located adjacent to the passenger elevator on each floor. Please see Trash Disposal later in this guide for additional details. Nothing may be placed or stored on the walkways or in the other common elements of the building, and beach towels and other items may not be draped over balcony and patio railings. Pets belonging to guests, visitors, lessees or relatives are absolutely not permitted anywhere on condominium property. If you find that you need help or advice in operating or maintaining any of the appliances or amenities in your apartment, you should seek the assistance of the owner of your unit, or if you used a rental agent, you must contact that agent. The San Marco Association is not staffed to provide assistance with apartment cleaning, lost or inoperative keys, maintenance or operation of appliances, mail, packages, deliveries, cable TV or Internet, or any personal or support services that are generally available in commercial hotels and motels. If you have questions, please contact the owner of your apartment or your rental agent. We want you to have a pleasant time while at San Marco, and sincerely hope that you will respect and comply with our lessee and guest rules. Information and Rules For Guests and Lessees Appliances The San Marco Condominium Association is not responsible for appliance repair, and guests are advised to contact the apartment owner for any maintenance. Balconies, Terraces and Walkways Sunscreens, blinds, umbrellas or awnings are not permitted on any balcony, terrace or on the exterior of any opening in the residential condominium. Planting is not permitted within any container on a terrace or balcony that in any way protrudes beyond or drapes over the exterior vertical plane of the terrace or balcony. Personal items may not be placed on the common element walkways outside apartment doors. Drying racks or drying of clothes, linens or towels on balconies are not permitted. Hanging of any garments, towels, rugs, swimsuits or any article on balconies or from balcony railings, building facades, windows, rails, walkways or walkway areas is not permitted. Wind chimes and other sound-producing decorations are not permitted. Storage containers or outside storage of any kind is not permitted on balconies or walkways. Beach chairs or interior furniture is prohibited on balconies or terraces. Barbeque grills of any type (charcoal, gas or electric) and smokers or cookers are not permitted on balconies or terraces. Cooking is not permitted on any common element, terrace, or balcony. Cable TV Cable TV services may be available in your apartment, if the owner chose to activate it. All special services such as premium or digital channels and High Speed Broadband Internet are also available, but the apartment owner must order them from Comcast. Destruction Of Property Owners will be held responsible for destruction, damage or defacement of the common elements, common facilities and equipment caused through their own acts or neglect, or those of their visitors, contractors, lessees or guests. Directory Entry System Visitors may use the entry panel to contact residents and gain entry into the building. The visitor uses the keypad to enter the 3-digit apartment number. The entry panel then automatically dials the telephone of the apartment and the resident can speak with the visitor and remotely unlock the door if that is desired. Residents can also view the visitor by tuning their TV to cable channel 57. To remotely open the front door lock the resident presses the 6 key on their Touchtone apartment phone while their visitor is on the line. The resident can deny entry by pressing the # key on their phone. The entry remote unlocking system requires that the visitor use the entry access panel to contact the resident to gain entry, and not a cell phone. Doormats and other Hallway Hazards Doormats, shoes, strollers, bicycles, beach chairs and toys, carts, packages, shelves, plants or any other personal for decorator items may not be placed or left in the common element walkways and alcoves. Elevators There is one Passenger Elevator and one Service Elevator. The Service Elevator is coded. Unaccompanied guests and lessees can obtain Service Elevator codes from the unit owner. 3

Entry of Emergency and Maintenance Personnel Into Apartments The Association has the right to enter any apartment when it is necessary to inspect, maintain, repair, or replace a portion of the common elements or for any portion of the apartment to be maintained by the Association, or to make emergency repairs to prevent further damage to common elements or another apartment. Reasonable advance notice will be given when possible. Fire Safety The smoke detectors in each apartment do not notify the fire department or sound a building alarm. If you have a fire in your unit you must activate a central alarm (located on the walkway) to sound the building alarm. When a general building alarm condition occurs, use the stairways to exit the building. Fitness Center When using any of the equipment in the Fitness Center, please follow the posted rules and keep in mind: No sandals, street shoes, bare or stocking feet are permitted. An adult must accompany and supervise children. Please dry and sanitize the equipment after you have finished using it. Garage Remote Controls Two garage remote controls have been provided to apartment owners. In addition to the remote garage controls there is also a garage door access keypad at each garage entrance. Lessees can learn the combination to the garage keypads from the unit owner. Hurricane Safety When a Hurricane Alert is announced for the Sarasota area, all apartment balconies and patios must be completely cleared of all items. Failure to clear a patio within 8 hours after a Hurricane Alert has been declared could result in entry into the apartment by agents of the Association, who will remove and store all patio and balcony material on any available tile flooring inside the apartment. An Association administrative fee of $100, plus all additional costs associated with the patio clearing will be billed to the owner. If you are a renter or guest in an apartment during hurricane season, you must also comply with the patio clearing rules, and if you cannot, you should inform the owner, who must assume all responsibility for providing emergency labor to remove the patio and balcony material within eight hours of a Hurricane Alert. Keys And Apartment Access The Association cannot provide an apartment key to anyone, and the Association does not have a master key to all apartments. If you lose your key you must call the apartment owner or a locksmith for assistance. Leasing and Renting Apartment owners may lease or rent their apartment for not less then ninety days, and no more then twice in any consecutive 12-month period. The landlord owner must provide the Association with a signed copy of the lease for approval by the Board of Directors. The lease must state the amount of monthly rent, the names and valid phone numbers of all individuals who will be residing in the apartment, and include the following caveats either in the body, or as a valid addendum to the lease: The San Marco Association Board of Directors has the right to terminate a lease upon default by the lessee in observing any of the provisions of the Declaration of Condominium, Summary of Use Restrictions, Bylaws of the Association, Rules and Regulations, this document, or other applicable provisions of any agreement, document, resolution or instrument governing or affecting the San Marco Condominium. A renter or lessee, or a guest of a renter or lessee, may not keep or bring any animal or pet onto San Marco Association property or into any San Marco condominium unit. Overnight occupancy by renters and their guests may not exceed two persons per bedroom. 4

Sub-leases, lease assignments, or revolving-door roommates not listed on the original lease are not permitted. The Board of Directors must approve all leases. Mailboxes There is one mailbox in the first floor lobby that is assigned to each apartment. An outgoing mailbox is located near the Service Elevator on the street level. Motor Vehicles Commercial vehicles, unlicensed vehicles, motorcycles, motorbikes, motor scooters, campers, trailers, mobile homes, motor homes, personal watercraft, boats, three-wheeled vehicles, disabled vehicles, recreational vehicles and similar conveyances are not permitted in any parking area or on the Condominium property. Noise Music and all other sounds, including conversations, radios, CD and music players, stereos, and televisions must be kept at a reasonable sound level so as not to disturb other residents and shall be kept to a undetectable level between the hours of 10:00 pm and 8:00 am. The Board of Directors, or their designated agent, has the authority to determine if a noise meets the definition of a disturbing or annoying noise. Loud conversations on balconies, walkways and common areas should be avoided. Occupancy Of Apartments Each apartment shall be used and occupied as a single-family residence only. Owners may have guests any time they are in residence. If the owner is absent, and the guests are not immediate family, lease rules apply. Immediate family is defined as an individual, or two or more persons related to the owner or co-owner by legal adoption, blood, or marriage: parents, grandparents, children, grandchildren, brothers, or sisters. Occupancy By Lessees The San Marco Condominium is not staffed or authorized to give special renter services that are normally provided by a rental management agency. Lock boxes are not permitted on apartment doors or the common element walkways. Leasing of an apartment is restricted to the original lessee with no secondary or more lessees to be added or substituted at a later date. Lessees may not sublet an apartment, and may not allow anyone to use the apartment in their absence. Violations of any rule or regulation can result in eviction, denial of future lease application approvals, or other action as determined by the Board of Directors. The Board of Directors must approve each lease contract. Leases without the inclusion of mandated San Marco Lease Rules additions will not be approved. See Leasing and Renting for details. Owners are responsible for the actions of their guests and lessees. Parking Each apartment is assigned the exclusive use of two parking spaces. Owners and lessees must park in the space(s) assigned to their apartment. Guests must park in the outside visitor parking lot, subject to any posted Visitor Parking rules. Commercial parking spaces are for the exclusive use of the retail and office commercial units and shall not be occupied by apartment owners or their guests. Parking policy violators may have their vehicle towed, and the owner of the vehicle must pay the towing charges. Parking areas are limited to registered private motorized passenger vehicles and most Sports Utility Vehicles not exceeding 81 inches in overall width. 5

Owners, renters, visitors, guests or invitees are not permitted to park, maintain or keep commercial trucks or vans, motorcycles, motor bikes, mopeds, scooters, three-wheeled vehicles, motorbikes, campers, trailers, mobile homes, motor homes, personal watercraft, boats, any towed conveyance, disabled vehicles, bicycles, tricycles, recreational vehicles or any vehicle with an overall width exceeding 81 in any parking area. Any large vehicle (typically, some oversize SUV s) exceeding 81 in overall width must park in two adjacent spaces owned or controlled by the unit owner, but may not park in any single parking space located on San Marco property. The speed limit on San Marco property is 15 mph. Maximum garage speed limit is 5 mph. Bicycles may not be parked in the garage or in a vehicle parking space. Pets Tenants, lessees, guests, visitors or invitees of an apartment owner are not permitted to bring pets or animals of any kind onto San Marco property or in any condominium unit. Pool And Pool Patio Use of the pool is at the sole risk of the user. There is no lifeguard at the pool - Swim at your own risk! Please dry off completely before leaving the pool area to avoid tracking water onto the floors in the hallways, walkways and elevators. A cover-up and shoes or foot coverings are required when going to and from the pool. Children must be accompanied and supervised by an adult at all times. Diving or jumping in the pool is not permitted. Running on the pool deck is not allowed. Children under the age of 3 are not allowed in the pool at any time, for any reason. All children must be toilet trained, and no diapers or swim-diapers are permitted in the pool. Please shower off any tanning oils and lotions before entering the pool. No floats, toys or balls are allowed in the pool. Angel wings or a small tube desired for child safety may be used. One noodle per person is allowed, but may not be thrown or used to splash others. Chairs, chaises and tables may not be reserved. Any chair or lounge left vacant for more than thirty minutes may be used by anyone. Please use a towel to cover pool chairs and chaises to prevent damage from tanning oils. Food and snacks may be opened and consumed only at the tables on the pool patio Beverages are allowed on the pool deck, but must not be taken into the water or within four (4) feet of the pool. Glass containers of any type are absolutely prohibited on the pool deck or patio area, pool, sauna, public restrooms, and fitness facility. Smoking is not permitted in the common elements, including the pool, pool deck, patio, sauna, restrooms, walkways, lobby, elevators, and fitness facility. Recycling Recycling is required in Sarasota County. Recycling containers are located on each floor in the trash chute room. Please rinse out any containers so they do not produce odors in the trash chute rooms. Please place all rinsed flattened large plastic milk jugs, plastic bottles, cleaned aluminum cans, and glass containers in the appropriate bin. Newspapers are recycled in the same location. Large cardboard boxes should be broken down. Styrofoam is not recycled and should be disposed of in normal trash. 6

Sauna The sauna rules are posted on the Exercise Facility bulletin board and must be complied with. Sauna users must sit on a towel. Aromatics, lotions and oils are not permitted in the sauna. Children are not allowed in the Sauna. Do not spill water on the floor, decking or benches. A small amount of water on the heater tiles goes a long way. Please leave the sauna door open after you leave the sauna so it can be properly ventilated. Service Carts Service carts are provided for the convenience of residents to assist in moving groceries and other small items from the parking area to their apartments. They are stored in the garage and should be returned there immediately after use. Large and bulky loads should be carefully moved on the Service Elevator. Carts should never be stored in an apartment or abandoned in the elevator or on walkways. Smoke Detectors While the smoke detectors in each apartment are electrically powered, they also have backup batteries that are automatically used in the event that the power in the building fails. After a year or so the batteries may fail. When the batteries fail the detector will emit a sharp chirp every minute or so, signaling that the apartment owner must replace the battery without delay. Smoking The San Marco Condominium is a non-smoking facility. Smoking is not permitted in any common element area of the property, including, but not limited to, stairwells, walkways, elevators, pool and pool patio area, fitness facility and restrooms, sauna, and the parking garage. Staff Employees Association custodial, housekeeping, and maintenance personnel take direction from the Association Manager only. Please do not attempt to direct housekeeping or maintenance personnel or interfere with their assigned duties. If you have suggestions or comments, direct them to the unit owner or your rental agent. Trash Disposal All table scraps should be disposed of in the kitchen garbage disposal. All other trash must be placed in sealed, substantial plastic bags and placed in the trash chute located on each floor. Do not leave any trash, boxes or any other items on the floor of the trash chute room. Items that do not fit in the chute should be brought to the recycle or trash area in the garage on the first floor. Do not jam large items into the trash chute as they can cause a total blockage of the trash system, requiring costly and time-consuming repairs. Sarasota does not recycle Styrofoam, which should be treated as normal trash. As a courtesy to other residents, and to avoid odor and pest problems from items in the recycling baskets in each trash chute room, please rinse out all cans, bottles, and plastics that contained food products, beverages, or aromatics. 7
