Town of Newmarket - Tom Taylor Trail Extension (Staff Report 37-15-BOD) Request from Town of Newmarket for approval of the Tom Taylor Trail Extension project within Mabel Davis CA, including; - Trail extension under the Keith Street Bridge - Partial removal of a portion of the Canal Wall Request from Rogers Cable and York Telecom for utility easements for fibre optic cabling 2

Project Details Construction of approximately 200 metres of new and improved paved trail, new benches and waste/recycling receptacles and realign memorial tree retaining wall Partial removal of approximately 30-40 metres of existing canal retaining wall and stream bank naturalization Three new underground fibre optic lines and associated easements for Rogers Cable and York Telecom within two utility easements 5

Project Issues 1) LSRCA Approval for Town of Newmarket Canal Wall Removal and Stream Bank Naturalization; 2) LSRCA Approval for Town of Newmarket Trail Extension and Improvements; 3) LSRCA Approval for utility corridors, installation of cabling and registration of formal easements for Rogers Cable and York Telecom (two one-metre easements); 10

Financial Implications All costs associated with the removal of portions of the canal wall is the responsibility of the Town of Newmarket. LSRCA staff to work with the Town staff to submit funding applications associated with the naturalization of the stream bank. All costs associated with the Tom Taylor Trail Improvements is the responsibility of the Town of Newmarket. All costs associated with the establishment, registration and construction of the utility easements is the responsibility of the utilities. 11

Project Summary All costs covered by the Town of Newmarket and Utility Companies Nominal positive impact on Authority Finances given utility easements (Values to be determined) Significant improvements to the Tom Taylor Trail and reduced liability associated with potential failure of the canal wall. MNR Disposition Approval Not Required as No MNR Funding for original acquisition 12

Next Steps Town of Newmarket to submit final permit application for the trail works for LSRCA approval. Town of Newmarket to enter into a Use of Property Hold Harmless Agreement with the LSRCA for the works on LSRCA property. LSRCA staff to finalize the utility corridor easements with Rogers Cable and York Telecom including; easement value, registration of formal easements and LSRCA permits/authorizations. 13

Board Recommendations THAT Staff Report No. 39-15-BOD regarding the Proposed Tom Taylor Trail Link and Partial Canal Wall Removal Mabel Davis Conservation Area be approved; and FURTHER THAT the Town of Newmarket s proposals to remove portions of the existing canal wall and to construct and improve the trail system through the southern portion of the Mabel Davis Conservation Area be approved; and FURTHER THAT the utility proposal to install three fibre optic lines within two one-metre wide easements, one for Rogers Cable and one for York Telecom, be approved with all costs associated with the establishment and transfer of the permanent easements the responsibility of the utilities companies; and 14

Board Recommendations (continued) FURTHER THAT Staff be directed to continue to work with Rogers Cable and York Telecom and their consultants to establish the two utility easements through the Mabel Davis CA, including completion of the transfer of title of the two easements to the respective utilities and issuance of the requisite authorizations and permits for these works; and FURTHER THAT Staff be directed to continue to work with Town of Newmarket and their consultants to (a) finalize plans and issue the requisite authorizations and permits for the Tom Taylor Trail Link and (b) to submit a stewardship funding application regarding the streambank naturalization. 15
