This assists in achieving the goal of honesty, respect, cooperation, common sense and fiscal responsibility. Renter A person who leases a unit from the owner for specific period of time. Resident An owner or renter. Visitor - A person visiting the resident of the unit. Guest Guests who stay overnight or for an extended period of time, registered guests will be required to fill out a Guest Affidavit Form. 1 P a g e

RULES & REGULATIONS Attire Residents and guests returning from the beach or pool must be completely dry and free of sand. Shirts, towels, or other forms of cover-ups are required at all times when entering the building. Shoes are required when inside of the building. Both tops and bottoms are required in the pool area. Balconies & Terraces Do not throw any objects from balconies, especially no cigarette butts as this is a fire hazard. No hanging towels or clothing on railings. No bikes, boxes, floats, or shelves can be stored on balconies. Pets are not allowed without supervision from their owners. There is no grilling or cooking allowed on balconies. During hurricane season (June 1st to November 30th) if you are not going to be in the residence, arrangements must be made to remove everything off the balconies. Do not rely on the building staff to make preparations. Use only a damp mop to clean the balcony surface. Do not at any time throw water onto the balcony. Do not use harsh or abrasive chemicals on the surface of the balcony. Water, debris and detergents used in the process of cleaning the balconies are not allowed to run off balconies. BBQ/Grill In order to use the grill, the resident must complete the BBQ Reservation Form. In order to reserve the grill, owner should be in good standing with Bel-Aire. Good standing shall be defined as current with monies owed to the association. Reservations are on a first come, first served basis, a $50 deposit is required. 2 P a g e

After use, clean up the grilling area. If deemed unclean, the $50 will not be returned. To clean the grill: I. Turn on heat up to high for about seven minutes to burn any excess grease. II. Brush the grates. III. Properly clean up the counters and the sink. Do not use soap and water inside of the grill. BBQ grill may only be reserved for one (1) hour. BBQ grill hours are sunrise to sunset. Bicycles/Surfboards/Kayaks/Canoes All bicycles are to be registered with the management office and stored in the assigned space in the bicycle racks. All surfboards, kayaks, and canoes must be registered with management. No bicycles or other recreational equipment are allowed in the common areas including the pool deck. The association and management are not responsible for any bicycles or other items lost, stolen, or damaged in any of the common or limited common areas. Bicycles, tricycles, scooters, skateboards, and other recreational equipment, baby strollers and similar items shall not at any time be left in the hallways or other common element of the condominium or in the limited common elements (including balconies, terraces and garage). Bicycles can only enter or exit through the garage. Contractors Working hours are Monday through Friday from 8am to 5:00pm. Contractors working for any unit must leave ID at the front desk. It will be returned when the contractor is finished inside the unit. Under no circumstances should any work materials be placed in the building s trash chutes, or left in the hallways. 3 P a g e

For approval to conduct any work in the unit, owners are required to fill out the Architectural Modification Package. As per the By Laws, it is required that any work inside a unit must be done by a licensed contractor with all the insurance and credentials needed to perform the work. If the work involves structural, mechanical, electrical and or plumbing then plans and City permits must be submitted as well. Faulty electrical work can result in the unit catching fire, faulty plumbing work can result in water damage. Under no circumstances is anyone to drill either into the slab or into the ceiling as this could damage the post tension cables in the building causing structural damage. Residents must provide a refundable deposit of $500 via check made payable to Bel-Aire on the Ocean. The check will be returned the same day after a walkthrough confirms that there was no damage caused to the common areas. Management office must be notified at least 24 hours in advance of any modification in a unit. Fitness Center Limit the use of equipment to 30 minutes when others are waiting. Do no drop or mishandle weights or other equipment. In case of an emergency, call 911 or notify the front desk and they will call for you. No minors under the age of 16 may use the facility. Personal trainers and trainees must be residents of Bel-Aire on the Ocean and need to be registered with the management office. Shoes and shirts must be worn at all times. Bring a towel with you for each workout. Wipe down equipment after each use. Return all equipment back to its place. Gym is open 24 hours. No smoking and eating in gym. No pets allowed. 4 P a g e

Only tennis shoes/sneakers allowed. Residents who violate gym rules will lose privilege to use it. The association and management are not responsible for any injury incurred. Guests must be accompanied by the resident at all times. Only one guest per resident is allowed in the fitness center. Moving & Deliveries Moving trucks must park beside the fence without blocking the garage gates. They need to check in with the front desk. Residents must provide a refundable deposit of $500 via check made payable to Bel-Aire on the Ocean. The check will be returned the same day after a walkthrough confirms that there was no damage caused to the common areas. Management office needs to be notified at least 7 days prior to arrange date and time for move in and move outs. For a delivery, management office needs to be notified at least 24 hours in advance. Moving and delivery companies must provide an insurance certificate with Bel-Aire on the Ocean as the certificate holder. They will not be allowed on the property without the insurance certificate. For any moves or deliveries only the service/pet elevator can be used. Nuisances During the hours from 11pm through 8am no resident shall play any musical instrument, phonograph, television, radio in a way that unreasonably disturbs or annoys other residents. Parking & Garage Residents shall park only in the parking space assigned to their unit. Park at your own risk. All vehicles in parking area are kept on premises at the exclusive risk of 5 P a g e

residents. The association does not assume any responsibility and shall not be liable for damages, losses, or thefts. Each owner shall be allowed to park one (1) vehicle using the valet service at no cost. Do not park yourself in any of the valet spaces. During valet hours, only valet is allowed to park cars. If you come in after valet hours see the front desk attendant for any available valet parking spaces. No person shall park any vehicles so as to obstruct or otherwise impede ingress or egress to any parking spaces, including, without limitation, to a parking space assigned to any other unit. The board shall have the authority to prohibit any vehicle, including any motorcycles or motor scooter, which it determines constitutes a nuisance due to its noise level, particularly where such vehicle is operated in the early morning or late evening hours. No more than one (1) motorcycle or motor scooter may be parked in a single space, and in no event may a motorcycle or a motor scooter be parked in the same parking space as another vehicle or between any parking spaces. No vehicle is permitted on the condominium property which leaks oil or any other fluids. No resident or other person shall conduct repairs/service or restoration on any motor vehicle, or other vehicles, with the exception of replacement or fixing of a flat tire. Vehicles may not be washed in the parking garage. The prohibition on parking contained in this section shall not apply to: A. Temporary parking of commercial vehicles, such as for construction use or providing pick-up and delivery and other commercial services. B. Services vehicles operated in the connection with the association, subject to applicable laws and ordinances. Any vehicle, boat, motorcycles or trailer parked in violation of these or other restrictions in the rules and regulations may be towed by the association at the sole expense of the owner of such vehicle. The association shall not be liable to the 6 P a g e

owner of such vehicle for trespass, conversions or otherwise, nor shall it be guilty of any criminal act, by reason of such towing and once the notice is posted, neither its removal, nor failure of the owner to receive it for any other person, shall be grounds for relief of any kind. Bel-Aire on the Ocean towing policy meets the requirement of the Florida Statues. No vehicle is permitted to park at building entrance (driveway) at any time. If your vehicle cannot enter the garage, you cannot keep this vehicle on the property. No vehicle over 6 8 tall can enter the property. No items can be stored on or around the parking spaces. Trucks, trailers, mobile homes, vans, campers or similar vehicles cannot be parked on the property. Also boats, rafts, or other similar crafts are not allowed in the garage. The vehicles of all residents must register with the management office. Residents must complete the Vehicle Registration Form to acquire the proper identification for their vehicles. Every single vehicle is required to have a parking permit decal to be authorized to park in the garage. The association will have improperly parked cars towed at owner s expense. Owners with rental vehicles and owners/renters with vehicles that are not compatible with our system shall be provided with a temporary transponder upon providing the management office with a copy of the vehicle registration, paying $20 deposit for the temporary transponder, valid government issued ID, and a signature of a board member. For safety reasons, all vehicles must not exceed a speed of 5 MPH in the garage. The automobile lights must be ON at all times when a car is in motion in the parking garage. Valet only accepts credit cards or PayPal, no cash. The valet has the right to refuse service to any person or vehicle. Do not open garage gate for anybody else. Pets Dogs are not allowed to walk through the pool area. 7 P a g e

There may not be more than two (2) household pets maintained within any unit. Those pets which, in the sole discretion of the association endanger health, have the prosperity for dangerous or vicious behavior (such as Pitbull dogs or others) make objectionable noise, or constitute a nuisance or inconvenience to the residents of other units, shall be removed upon request of the board. Any violation of the provisions of this rule shall entitle the association to exercise all of its rights and remedies, including, but not limited, the right to fine owners (as provided in these Rules and Regulations) and/or to require any pet to be permanently removed from the condominium property. No animals, wildlife, livestock, reptiles, or poultry of any kind shall be raised, bred, or kept on any portion of the condominium property. Pets are to always use the service/pet elevator. You must maintain control your pet when others are sharing the elevator with you. Pets must always be leashed while on the property. Pets are not allowed to relieve themselves in any of the common area i.e. garage, balconies or the building exterior, and should be walked to the park next door. Walking animals outside the building: By law, pet waste in the City of Miami Beach shall be picked up and properly disposed of by the person attending the animal. Staining of hall carpeting or other damage to the common elements, shall be reported immediately to the management office or the front desk. The resident shall be responsible for any damage to hallways or to any of the common elements caused by their animals. Failure to report such staining or damage, or to pay for the damage, shall constitute a violation of this rule and shall be fined and assessed a fee for the cleanup and/or damages. Resident must provide proof of vaccinations. Pool Area Lounges, pool chairs, and tables will be available to residents and registered guests on a first come, first served basis. No advanced reservations will be permitted. Lounges, pool chairs or tables are not to be removed from their existing location or dragged across the pool deck. 8 P a g e

Lounges, chairs and pool tables left unattended over one (1) hour will be available for another qualified Bel-Aire resident. Bel-Aire on the Ocean, its board members, management company are not responsible for any items left unattended on the chairs, tables or pool deck area. Each unit is allowed a maximum of four (4) guests in the pool area at one time. Residents who want more than four (4) guests in the pool area must fill out the Event Authorization Form. The form must be submitted to the board 24 hours prior. The board may approve or disapprove the request at its sole discretion. A resident is fully responsible of the conduct of their guests at all times while on Bel-Aire on the Ocean property. All residents must be in possession of a key fob, Federal/State issued picture ID while in the pool area for the purposes of identification. All children under sixteen (16) years of age must be accompanied by an adult when entering or using the pool area. No animals on pool deck or adjacent area. Food and drinks will only be permitted in designated area which is under cover. No glass or other breakable objects will be permitted in the pool or hot tub. Beverages are only permitted in non breakable plastic containers or cans. The pool deck and adjacent patio is a smoke free area. Cigarette, cigar or vapor smoking is NOT allowed. All persons must shower before entering the pool or hot tub. There is no life guard on duty in the pool area. Anyone using the pool and hot tub does so at their own risk. No diving, no jumping, no horseplay is permitted. The pool and pool area are not to be used for games that involve running, playing ball, using roller skates, skateboards and any other boisterous activity. Excessive noise, music, shouting, etc. is prohibited in pool area at all times. Music, radios and other sound devices shall be used with personal headphones to be inaudible to others. Children ages five (5) or under shall not be allowed to use the hot tub. Persons with contagious sores or rashes are not allowed in the pool or hot tub. 9 P a g e

A resident or guest who is directed by the management or the association staff to leave the pool/pool area for violation of the rules shall do so promptly. No professional instruction will be permitted in the pool and pool area. Nude swimming or nude sunbathing is not allowed in the pool or adjacent area. All incontinent or non-toilet trained persons must wear water proof pants or water proof garments when utilizing the pool. Diapers (cloth or disposable) are prohibited. Soiled diapers should be discarded away from the pool area and changing of diapers should be done in the pool bathrooms. No more than nine (9) persons in the hot tub and no more than thirty-one (31) persons in the pool. Brush off sand and dry off completely before entering the building. Use service/pet elevator. Wet floors can become very slippery and a safety hazard. Pool hours are sunrise to sunset. Rentals No lease shall be for a term of less than one (1) month and a unit owner may not lease its unit more than (12) twelve times in any calendar year period, regardless of the lease term. The City of Miami Beach considers a short term rental everything less than 6 month. These short term rentals are permitted by the City in our building as long as the owners have the proper business tax receipts and pay the Miami Beach resort tax. In addition this type of use also requires a State of Florida Hotel Use License. Each owner is responsible for having proper documents and for paying the taxes. Renting or advertising a property for illegal short-term rental is subject to a $20,000 fine for the first offense by the City of Miami Beach. Fines double and triple for subsequent violations. Trash Chutes NO GLASS or CARDBOARD in the trash chutes. Place trash INTO the trash chutes, not in front of them on the ground. 10 P a g e

No cardboard or boxes through the trash chutes. There are dedicated recycling containers for glass and cardboard on the first level behind the lobby. Visitors & Guests Occupancy in units, except for temporary occupancy by visiting guests, shall not exceed two (2) persons per bedroom. Residents must notify the management office if you plan to have guests reside in your home. Owners will be held liable for any damages, actions, noise, etc. that may be incurred. If they have a car, it must be registered at the front desk. Guest will be required to fill out a Guest Affidavit Form. Upon arrival all visitors and guests must register at the front desk. Residents will be contacted by the front desk via telephone upon the arrival of guests. Residents must be home to authorize visitors and guests in order to allow them access in to the building. Should residents wish to receive their guests elsewhere in the building other than their units, they must advise the front desk and inform them of the guest name(s) and estimated time of arrival. A maximum number of two (2) guest vehicles per unit will only be allowed to valet park on Bel-Aire on the Ocean property during federal holidays and other dates determined by Bel-Aire management during the peak season considered November to April. Be aware if you are leasing or renting your unit for less than 6 month you are subject to obtain a Florida Hotel License and required to collect and pay hotel tax per city ordinance (see under Rentals). The signed receipt signifies that you have read, or agree to read, the contents herein and are aware of the contents. Any violation will be brought up to the Grievance Committee for a possible fine. You also acknowledge that the City of Miami Beach considers a short term rental everything less than 6 month. These short term rentals are permitted by the City in our building as long as the owners have the proper business tax receipts and pay the Miami Beach resort tax. In addition this type of use also requires a State of Florida Hotel Use License. Each owner is responsible for having proper documents and for paying the taxes.
