Jawab semua soalan. QUESTION 1 SOALAN 1 C1 (a) Define the meaning of contract. Definisikan maksud kontrak. [3 marks] [3 markah] On 1 st January 2017, Zara offered to sell her set of jewelleries to Raisya for RM10,000.00. On 4 th January 2017, in reply, Raisya made a counter-proposal to purchase at RM9,000.00. However, on 14 th January 2017, when Zara refused to accept this offer, Raisya wrote to Zara saying that she was prepared to pay the original sum demanded. Pada 1 Januari 2017, Zara telah menawarkan untuk menjual set barang kemasnya kepada Raisya dengan harga RM10,000.00. Pada 4 Januari 2017, Raisya membuat tawaran balas untuk membeli set barang kemas tersebut dengan harga RM9,000.00. Walau bagaimanapun, pada 14 Januari 2017, apabila Zara menolak untuk menerima tawaran tersebut, Raisya menyatakan kepada Zara bahawa dia bersedia untuk membayar jumlah yang diminta pada asalnya. Section 27 of the Sale of Goods Act 1957 provide the Nemo Dat Quad Non Habet rule, which means no one can give a better title than he has himself. This means that if goods are bought from a person who is not the owner, and who does not sell them under the owner s authority, the buyer does not acquire any title. However, this rule is subject to some exceptions. Briefly explain FOUR (4) exceptions to the Nemo Dat Quad Non Habet rule. Seksyen 27 Akta Jualan Barangan 1957 memperuntukan peraturan Nemo Dat Quod Non Habet, yang bermaksud tiada siapa yang boleh memberikan hak yang lebih baik daripada apa yang dia sendiri miliki. Ini bermakna, jika barang dibeli daripada orang yang bukan pemilik sebenar, dan tidak menjualnya dibawah kuasa pemilik sebenar, maka pembeli tidak memperoleh sebarang hak milik.
