Licence Agreement 1. If successful in your application, the Housing Association or the Agent acting on behalf of the Association will offer you a licence to occupy a room at:... 2. A licence only gives you permission to occupy the room and to share the rest of the house with other people. 3. Unlike a Tenant you will not have any right to remain in the room or any of the accommodation if we ask you to leave. 4. You may be asked to move from one room to another room with reasonable notice. 5. We will retain a key to your room and will have the right to enter your room. 6. This is a licence agreement. By signing this agreement you will not be given any right to remain in the property once we ask you to leave. 7. You will be allowed to occupy a bedroom and to share occupation of the rest of the property with others. 8. We shall keep a set of keys and will have the right to enter your room, giving 24 hours notice unless an emergency. The purpose of this accommodation is to provide you with temporary accommodation and support to enable you to move on to more independent/permanent accommodation or return to your previous accommodation. Part of the licence charge, which you will pay each week, will be used towards the running costs of the house. COMPLAINTS PROCEDURE If you feel that BJB, either through itself or any Agent has broken this Agreement or not performed any obligation contained in it, you should first complain to BJB using their complaints procedure. This was given to you when you signed this Agreement. You can get another copy by asking your Support Worker. If BJB does not deal with your complaint, or in your view, continue not to comply with the Agreement, you can obtain advice and information about legal action (your remedies at law) from a local Citizens Advice Bureau, or Law Centre, or from a Solicitor. (date) on a weekly basis at a cost of per week. 1. By this Agreement B J Barkwell & Sons Ltd gives you and you alone permission to use and occupy the property. It does not give you a legal interest in the property. 2. B J Barkwell & Sons Ltd has no intention of granting you a tenancy at this address. Your statutory right to continue to occupy the property is therefore extremely limited and in particular it is not intended to rely on any security of tenure as afforded by the Housing Act 1988 or any other statute. 3. The property is managed B J Barkwell & Sons Ltd and is intended to provide you with temporary accommodation and support. 4. You will also sign a support and services contract which outlines your support needs and service charges 5. You are expected to contribute towards the weekly household bills/service charges eg: utilities, insurances, maintenance, food etc as set out in your support and services contract relevant to your property. 6. You will have a bedroom (and en-suite in some cases). All other communal facilities including the kitchen, bathroom/ toilets, lounge etc will be shared by you and the other occupants of the property. 7. You may be required to move from the bedroom to another bedroom in the same property. B J Barkwell & Sons Ltd will use its discretion in connection with its arrangement of the accommodation at the property. 8. The premises are part furnished as listed as per the inventory which will list the items in your room and the property. You are expected to look after any furniture, fittings or equipment supplied by B J Barkwell & Sons Ltd in any part of the property. All such items provided by BJB must be left in good condition at the premises when this agreement comes to an end. Damage to or removal of any of these items will be charged to you. 9. You are not permitted to smoke inside the property 10. You are expected to keep your bedroom and communal areas of the property clean and tidy. You should put your rubbish in the containers provided for collection, and put these out ready for collection by the local authority or its agents. 11. The garden/external areas must be kept tidy and free of rubbish. 12. You will be supplied with a key to the premises and your bedroom. A spare key will be kept to your bedroom. Lyndridge staff or its contractors will be able to go into your bedroom whenever necessary in connection with the provision of services for example, cleaning, routine health and safety or maintenance checks, or to carry out repairs, and in cases of emergency. Your privacy will be respected as far as possible. 13. B J Barkwell & Sons Ltd are responsible for repairs, maintenance and services to the house except where you or your visitors are responsible for the damage in which case you may be expected to pay the cost of repair or renewal. If you find anything which needs repair or replacement you must report the matter to the staff immediately. 14. You may decorate your room to your personal taste; however you should not decorate or alter any part of the property without first obtaining the permission of B J Barkwell & Sons Ltd. 15. You should not use any paraffin or portable gas heater, stove or electric heater in the property without prior permission from BJB. Any personal electrical appliances may be subject to a safety check. 16. You must comply with any health, safety and fire instructions given by staff and not behave in a way which is likely to endanger the health or safety of any licensees, visitors, neighbours or staff members including agents and contractors of B J Barkwell & Sons Ltd. 17. The main property will have a current TV licence. You will be required to have your own licence for your own personal TV. You should obtain permission from B J Barkwell & Sons Ltd before installing cable/satellite appliances, which may not be granted. 18. You must not keep animals or pets of any kind without the written permission of B J Barkwell & Sons Ltd. 19. If you cause any damage to the property of B J Barkwell & Sons Ltd you are required to report it to a member of staff as soon as possible. You will be responsible for any repairs/replacements. 20. B J Barkwell & Sons Ltd will accept no responsibility for losses or damage to your personal property. You are advised to take out your own insurance for your own possessions which are not covered by either the property or contents insurance at the property. 21. You should pay your accommodation charge to B J Barkwell & Sons Ltd every week (or 4 weekly). You will be issued with a receipt. 22. B J Barkwell & Sons Ltd hopes that your stay in the property will be helpful to you. There are certain circumstances in which B J Barkwell & Sons Ltd can end your Licence by giving you a written notice requiring you to leave, usually within 28 days. These include: a) failure to pay the accommodation charge. You are expected to make your payments regularly and promptly. If you find that on any occasion you are unable to pay some or all of the accommodation charge, you must report this to B J Barkwell & Sons Ltd and agree a date for payment. b) recurring accommodation charge arrears. c) using the accommodation for a business of any kind or for antisocial or illegal purposes. d) behaviour which causes nuisance or annoyance to other licensees, visitors, neighbours, or staff members including agents and contractors of B J Barkwell & Sons Ltd. This includes allowing visitors to cause a nuisance to others within the house. e) racially or sexually harassing any other licensees, visitors, neighbours or staff members including agents and contractors of B J Barkwell & Sons Ltd. f) allowing others to share your room or other parts of the house without obtaining the prior written permission of B J Barkwell & Sons Ltd g) decorating or making structural alterations or additions to any part of the house/flat without obtaining the written permission from B J Barkwell & Sons Ltd beforehand. h) if, in the opinion of B J Barkwell & Sons Ltd the temporary nature of the accommodation has been exceeded. i) playing or allowing to be played any radio, television, record, compact disc, tape recording or musical instrument so loudly that it causes a nuisance or annoyance to neighbours or other licensees. j) the circumstances of the licensee have changed and it is no longer appropriate to house him/her in the project having regard to the purposes for which the accommodation is provided. k) breaking the terms of the Licence Agreement. l) smoking inside the premises m) taking illegal drugs/using substances or excessive alcohol abuse THE ABOVE LIST IS NOT EXHAUSTIVE. 23. In exceptional circumstances, the Landlord may end your Licence by asking you to leave immediately or with less than 28 days notice. These include: a) committing or allowing invited visitors to commit any act which results in serious disruption of another licensee s right to peacefully occupy any other premises in the house/flat or to threaten to commit or commit any act which result in physical harm to any other licensee, member of his/her household, members of staff including agents and contractors B J Barkwell & Sons Ltd, visitors or neighbours. b) committing or allowing invited visitors to threaten to commit or commit any form of harassment on the grounds of race, colour, religion, sex, sexual orientation, age or disability which may interfere with the peace and comfort of, or cause offence to, any other licensee, member of his/her household, staff including agents and contractors of B J Barkwell & Sons Ltd, visitors or neighbours. c) serious damage to the property. d) the use of illegal drugs/substances on or off the premises. e) behaviour which is strongly prejudicial to the safety and security of other licensees or staff. f) if you abandon your room without telling B J Barkwell & Sons Ltd. THE ABOVE LIST IS NOT EXHAUSTIVE. 24. In the event of B J Barkwell & Sons Ltd ending your Licence, you will be provided with a written notice. The notice will be given to you or sent to your last known address, or if we do not know your whereabouts, the notice will be left at or sent to the house. If you have not vacated your room at the end of the Notice Period you will be regarded as a trespasser and B J Barkwell & Sons Ltd will take the necessary action in the Courts to secure your removal. 25. When your Licence ends, you should arrange for your keys to be returned to staff and for the prompt collection of your personal belongings. B J Barkwell & Sons Ltd has no responsibility for any goods left behind. Page 5 of 6
26. If you wish to leave, you are required to give B J Barkwell & Sons Ltd at least 28 days written notice in advance. 27. You will be liable for the accommodation charge until the Sunday after you leave. I have read/or had read to me and understood this Licence document, and I will keep to what is written on it.
