REPORT #PD-2016-44 COMMITTEE OF THE WHOLE MEETING DECEMBER 5, 2016 APPLICATION FOR PLAN OF CONDOMINIUM 1204551 ONTARIO LTD. - BRIAR HILL WEST FILE NO: NT-CD-1603 RECOMMENDATION That Report #PD-2016-44 be received; And further that the application for plan of condominium for 36 residential units (14 single detached, and 22 semi detached dwellings), being Vistas - Phase 9, as shown on Attachment No. 3, on lands legally described as Part of Block 3, Registered Plan 51M- 703, be approved OBJECTIVE The purpose of this report is to consider an application for plan of condominium approval in accordance with the Briar Hill West Subdivision Agreement. BACKGROUND LOCATION The subject lands are located on the north and south sides of Ridge Way and Westmount Drive, in the Community of Briar Hill West. The plan of condominium is being developed within a portion of Registered Plan 51M-703. A location map illustrating the approximate location of the subject lands is provided as Attachment 1. HISTORY / PROPOSAL In 2001, the Briar Hill West draft plan of subdivision was approved by Town Council to create four blocks to accommodate 1000 residential units (510 single detached, 308 townhouse, 182 apartment) and six golf course blocks, all to be serviced by an internal private road and communal water supply and sewage disposal systems. The plan (Plan 51M-703) was registered on November 14, 2001 and a copy of same is provided as Attachment 2. Further, in 2001, Council approved a Part Lot Control Exemption By-law and Plan of Condominium approval for the residential plan of subdivision. As a result, development

Report #PD-2016-44, December 5, 2016 within Briar Hill West does not require any further formal approvals under the Planning Act from the Town. Notwithstanding, a clause was included within the subdivision agreement stating that prior to any draft plan condominium approval, the Municipality shall be satisfied that adequate provisions have been made for services and amenities. To ensure the fulfillment of this clause contained within the subdivision agreement, the landowner submits an application for the proposal and this is circulated to internal departments for comment. On November 18, 2016, a Plan of Condominium Application was received respecting Phase 9 of Briar Hill West plan of Subdivision. Phase 9 includes a total of 36 residential units (14 single detached and 22 semi detached). A copy of the proposed plan is provided as Attachment No. 3. The registration of a Plan of Condominium will allow for the creation of separate condominium ownership parcels so that title can be conveyed to individual homeowners. It should be noted that building permits have been issued for the 36 dwellings within this phase, and construction is nearing completion. COMMENTS AND CONSIDERATIONS TOWN OF NEW TECUMSETH OFFICIAL PLAN AND ZONING BY-LAW #2014-126 The subject lands are designated Low Density Residential on Schedule 1 to Official Plan Amendment #23 (Briar Hill West Secondary Plan), and are zoned Communally Serviced Residential (CSR-4) on Schedule D to the Town s Zoning By-law. The use of the property for single detached and semi detached dwellings conform to the policies of the Official Plan and comply with the provisions of the Zoning By-law. AGENCY REVIEW The Plan of Condominium Application was circulated to internal departments for comment. Comments were received from the Engineering Department, dated November 24, 2016, providing consent to the registration of the proposed plan of condominium. FINANCIAL CONSIDERATIONS No financial issues have been identified as a result of this report. Financial matters are addressed through the necessary agreements pertaining to the development of the subject lands, including the subdivision agreement. Page 2 of 6
