ORDINANCE NO. 2006-06 AN ORDINANCE OF THE TOWN OF SOUTHWEST RANCHES, FLORIDA, AMENDING THE CODE OF ORDINANCES OF THE TOWN OF SOUTHWEST RANCHES, CHAPTER 39, UNIFIED LAND DEVELOPMENT CODE, SECTION 010-030, TERMS DEFINED TO EXCLUDE PRIMARY ELECTRICAL POWER TRANSMISSION EASEMENTS AND CERTAIN WATER BODIES FROM THE DEFINITION OF NET PLOT AREA; AMENDING SECTION 045-070, MINIMUM PLOT SIZE AND DIMENSIONS TO PROVIDE FOR PLOTS RENDERED NONCONFORMING BY THIS ORDINANCE; PROVIDING FOR INCLUSION IN THE TOWN OF SOUTHWEST RANCHES CODE OF ORDINANCES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the intent of the Rural and Agricultural zoning districts is to provide large plots for residential estates, ranches and agricultural uses in order to maintain the Town s rural lifestyle and community character; and WHEREAS, this intent has been specifically provided in both the Town s Charter and in the Town s Comprehensive Land Use Plan; and WHEREAS, the practice of including primary electrical power transmission easements and water bodies other than small ponds towards the minimum required plot area, is contrary to the intent of the Rural and Agricultural zoning districts; and WHEREAS, this practice reduces the land area that can be devoted to equestrian and agricultural uses and detracts from the community s rural character; and WHEREAS, this practice effectively allows suburban builder s acre -type plots, whereby land required for infrastructure most notably drainage infrastructure--is deducted from the required plot area; and WHEREAS, the Town Council of the Town of Southwest Ranches wishes to preserve the intent of the Rural and Agricultural zoning districts. NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of Southwest Ranches, Florida:
