Fences Within Drainage Easements The cnstructin f fences in recrded drainage easements is permitted nly under the fllwing terms and cnditins: 1. Fencing can nt adversely impede r bstruct the flw f water thrugh the drainage easement. 2. Fence styles must have adequate penings t allw surface water t pass thrugh i.e. split rail, spaced picket, shadw bx. 3. Fences that have n space between pickets r bards d nt allw unimpeded and unbstructed flw f surface water and are nt permitted. 4. Cnstructin f the fence must nt change the surface grade in a way that adversely impedes r bstructs the flw f water thrugh the drainage easement. 5. Utilities such as electrical lines and strm water lines are ften buried in the drainage easement and access t these utilities can nt be bstructed. If a utility r the Village needs t get access t an undergrund utility, they will remve any bstructing fence and will nt cmpensate the landwner fr any damage t the fence and will nt reinstall the bstructing fence nce wrk is cmpleted. 6. It is recmmended that fences crssing the drainage easement have a gate r a remvable sectin t allw a utility r Village truck t get in and access the undergrund utility. 7. The granting f a permit by the Village des nt relieve a landwner f respnsibility t ther landwners if the fence causes drainage prblems n ther prperties. 8. ZONING CODE 17.21 17.21 FENCES, SCREENS AND BUSHES. (Cr. 6/7/89) (1) PERMIT. N fence shall be cnstructed in the Village withut first btaining a permit frm the Building Inspectr. The applicatin fr such permit shall be n a frm prescribed by the Village and shall be accmpanied by a plt plan shwing the lt and the prpsed lcatin f the fence. (2) CONSTRUCTION AND PLACEMENT OF FENCES. (a) In any residential district, fences shall nt exceed the fllwing heights. Fr purpses f this sectin the frnt yard shall extend frm the frnt setback line t the frnt lt line: 1. 6' in height in side and rear yards. 2. 3' in frnt yards. (b) In any business r industrial district fences shall nt exceed 12' in height. (c) In any mbile hme park district, fences shall cmply with the restrictins impsed in residential districts, except as therwise prvided in the apprved plan f the mbile hme park. (d) Fences shall be s cnstructed s as nt t be incmpatible with the character f surrunding r neighbring structures and s as nt t cause a depreciatin f prperty values. In the event there shall be any dispute with respect t the same, it shall be addressed as prvided in Sectin 17.40. (e) Fences shall be s cnstructed and placed s that the side facing adjacent prperty (uter side) shall be at least as attractive as the side facing tward the fenced prperty (inner side). (b) Fences, screens and bushes lcated adjacent t a public right-f-way shall be maintained in such fashin s as nt t extend int the public right-f-way s as t hinder, bstruct r endanger any persn r prperty within the right-fway. (4) VISION CLEARANCE FOR CORNER LOTS. Ntwithstanding the freging prvisins, t prvide adequate visin clearance fr persns using the public highways, n fence, screening, structure, bush, tree, branches r mund shall be erected, grwn, placed r maintained n a cmer lt in the Village which shall bstruct the visin between 3' and 6' abve the curb level r, if nne, the street grade at the lcatin, within a triangle frmed by the intersecting street lines and a line cnnecting such street lines frm pints 15' frm the intersectin f the street lines.
