Kicking off a new year for committees at RAMC was Margy Grant, the Vice President of Legal Counsel for Florida Realtors! Margy traveled from Orlando to join us on the afternoon of October 14th to help orient our new Chairs and Vice Chairs into their positions for 2015. We all walked away with some more knowledge than we began with! Our 2015 committees are now ready to delve into their assignments from the Strategic Plan! These assignments will fulfill the goals of the Association over the course of the upcoming year and assist us to continuing to offer the best products and services possible. The Federal Aviation Administration (FAA) has outlawed drone photography for commercial purposes until September 2015 before rules for legal use can be implemented. The only exceptions at the moment are for BP to monitor oil operations in Alaska. Drone operators have been charged and charges have been dropped and the FAA continues to appeal. The FAA has made it clear this includes Realtors. The FAA also has a requirement that any drone use within three miles of a controlled airfield should be cleared with the tower first. The chief controller in Stuart doesn t recall any drone operators calling the tower. There are thousands of waterfront homes within three miles of the airfield and many have been photographed for commercial purposes using drones. As this issue grows in controversy including privacy concerns should you be upfront with your clients and tell them photos of their homes are taken under questionable legality? There is a lawyer/realtor who defied the FAA in the Palm Beach Post for using drone photography for his listings. Let s see how that works for him. Some drone operators will tell you they are insured. What insurance company is going to pay a claim for damages caused by something illegal? Things do go wrong with drones. They go MIA and crash. A gust of wind combined with Chinese electronics and a little bit of operator error could cause injury to a child, a car accident or God forbid, the worst case scenario loss of life from collision with an airplane or helicopters, which fly much lower. Somebody flying a drone recently kept a medevac helicopter circling a car crash site with injuries for nine minutes. Say what you will about FAA rules, they are in place to keep our airspace safe. The recent article in Florida Realtor magazine sums it up in the last sentence, If you re going to use drone photography, you should consult your lawyer first. Once the new rules are in place and commercial drone photography is legal and insurable, I will line up to get my FAA check ride and become a certified drone pilot. Until then, my pilots and I will continue to tell the towers where we are and follow their instructions. Page 9
