Hilton, Cardiff - Programme 1.30-1.55pm Registration and refreshments 1.55-2.00pm Welcome from Chair John Sharples, Head of Property, 2.00-2.45pm Proprietary estoppel Oliver Wooding, Barrister, Oliver will review the Court of Appeal s most recent attempts to grapple with the doctrine of proprietary estoppel, and consider how best to run and defend claims involving estoppel. 2.45-3.30pm The jurisdiction to modify or discharge restrictive covenants David Fletcher, Barrister, David will discuss the jurisdiction of the Upper Tribunal (Lands Chamber) over restrictive covenants, and its inter-relationship with planning. 3.30-3.45pm Cream teas 3.45-4.30pm Fools, pens and a guaranteed mess Joss Knight, Barrister, Joss will consider the recent developments relating to the law of guarantees with a particular emphasis on the High Court s ruling on the viability of assignments in EMI Group Ltd v O & H Q1 Ltd [2016] EWHC 529 (Ch). 4.30-5.15pm Under construction: drafting and interpretation of land options Charlie Newington-Bridges, Barrister, Charlie s talk will consider drafting and interpretation of land option agreements in the context of a case that he recently took to the Court of Appeal. Developers and practitioners using land options need to ensure that they are tightly drafted. Your presenters David Fletcher, Barrister (Call 1971) David has been heavily engaged in recent years in a range of complex, longrunning and high value commercial and chancery disputes in the Mercantile and Chancery Courts. David s practice includes all kinds of property disputes, including rights of way, boundaries, restrictive covenants (including applications to the Lands Tribunal), property subsidence claims, and cases of proprietary estoppel / constructive trust. Oliver Wooding, Barrister (Call 2009) Oliver has a commercial and chancery practice, with particular interests in contentious and noncontentious probate, property, and professional negligence. Oliver is experienced in both residential and commercial landlord and tenant disputes, mortgages, boundary disputes, mobile homes, and coownership and trusts of land. He advises and appears on behalf of claimants and his recent case load includes successfully representing a claimant to obtain a beneficial interest in property by way of proprietary estoppel in a two-day trial. Charlie Newington-Bridges, Barrister (Call 2011) Charlie has a general chancery and commercial practice. His particular specialisms include: commercial / contractual disputes; banking and financial services; wills and probate; real property and trusts; partnership law; and insolvency. Joss Knight, Barrister (Call 2014) Joss is a specialist commercial and chancery barrister with a particular interest in property disputes. He is regularly instructed in residential and commercial possession proceedings and has recently drafted pleadings and advised on matters concerning trespassers, agricultural partnerships, proprietary estoppel, boundary disputes and bona vacantia.
