DISCUSSION: A Zoning Matters sign was posted on the property June 25, 2014. The petitioner presented his plan at the July 2, 2014, Planning and Zoning Commission meeting; discussion was held and a
Planning and Zoning 3 July 16, 2014 subcommittee was appointed. The Subcommittee met on site July 8, 2014 with J.R. Mayer, Jr., of Prestige Custom Homes, City Planner Ryan Spencer and City Engineer Todd Rehg. Notice of the meetings had been properly posted. Discussion centered on the necessity for a sidewalk extension along Craig Drive and the alternative of a sidewalk waiver fee. The petitioner stated that neighbors were concerned about the loss of trees along the frontage that would be due to the re-location of utility lines and the construction of a new sidewalk. The Subcommittee supports a waiver from Article VIII, Section 5(a) of the Subdivision Code that requires sidewalks along street frontages and believes that the factors listed in Article VIII, Section 5(f) of the Subdivision Code are satisfied. RECOMMENDATION: The Subcommittee recommends this petition for the approval of the preliminary plat for a fourlot subdivision be approved with the following conditions: 1. The final plat and development plans shall be consistent with the preliminary subdivision plat stamped Received June 2, 2014, City of Kirkwood Public Works, except as noted herein. 2. If the Preliminary Subdivision Plat is approved by City Council, a filing fee of $400 (4 lots at $100 each) shall be submitted with the final plat. 3. A performance guarantee in an amount approved by the Public Services Director shall be submitted prior to submittal of the final development plan guaranteeing the completion of public improvements, to replace public improvements damaged by construction activities and to guarantee significant trees designated to be saved. In addition an administrative fee of 1.25% of the performance guarantee amount shall be submitted with the Final Development Plat. 4. The final plat shall grant a ten-foot wide utility easement along the north perimeter of Lots 1-4 adjacent to the right-of-way of Craig Drive, a seven-foot wide easement along the east line of Lots 2-4 and along the west line of Lot 1, and a ten-foot wide easement along the south property lines of lots 1 & 2. 5. The requirement for sidewalks along Craig Road frontage shall be waived {Code Reference: Appendix B, Article VIII, Section 5(a)}. The applicant shall pay a filing fee of $8,711.10 ($30 per linear foot x 290.37 feet of frontage) for the sidewalk waiver in accordance with Appendix B, Article VIII, Section 5(f) upon submittal of the final plat. 6. Any existing curbs or sidewalks that are damaged shall be reconstructed to City standards. 7. Prior to proceeding to City Council a revised tree study shall be submitted to the Public Services Department.

The business will generally be open Monday thru Saturday from 9:00 A.M. to 8:00 P.M. 64 classes will be offered per week, with the earliest class beginning at 6:00 A.M. The facility would employ approximately 15 individuals with anywhere from 5 to 20 clients in an individual yoga class. COMPREHENSIVE PLAN: This site is designated for General Commercial use by the Vision 2015 Comprehensive Plan. The proposed use is consistent with the policies presented by the Plan. LAND USE AND ZONING: The subject property is currently zoned B-2 General Business District and the existing tenant space is unoccupied. Surrounding land uses and zoning include the following: To the north: Directly abutting the space in the same building are office and retail uses. Across Madison Avenue is a mixed-use building including restaurants, office and residential uses and is zoned B-2, General Business District. To the south: Across Monroe Avenue is a retail/service use, Kirkwood Glass, which is zoned B- 2, General Business District. To the east: To the west: Abutting the building is a multi-family apartment complex and structured parking zoned B-2, General Business District. RECOMMENDATION: The Subcommittee recommends that this petition be approved with the following conditions: 1. This Special Use Permit for a physical fitness facility is limited to the 2,544 square foot lease space known as 200 South Kirkwood Road, Suite 140 (see Exhibit B). 2. Any noise, including music, generated within the business space shall comply with the sound transmission regulations (section 1207) of the adopted 2009 International Building Code. Design plans and supporting documentation for the Spray Rooms showing compliance with these regulations shall be submitted to the Building Commissioner s Office prior to the issuance of any permits. 3. Noise-generating equipment located within the Spray Rooms shall be enclosed in a sound attenuating cabinet or equivalent to mitigate noise. 4. The Architectural Review Board shall approve all signs prior to the issuance of a Sign Permit. 5. The petitioner shall comply with all standard conditions as listed in Exhibit A. PZ-10-15 SITE PLAN REVIEW CVS, 1085 NORTH KIRKWOOD ROAD Submitted: 6-16-14 Automatic Recommendation: 10-14-14 Petitioner s Agent, Matt Fogarty (Subcommittee Mr. Frick (chair), Ms. Drewel, and Mr. Klippel) John King, attorney representing CVS; Craig Forgey with TM Crowley & Associates; Richard Smart, Construction Project Manager with CVS; Matt Fogarty with Premier Civil Engineering; and Dustin Riechmann with Lochmueller Group; were present. The proposal includes the demolition of two buildings and construction of a one-story, 13,592 square foot building on the 1.7 acre site at the southwest corner of Kirkwood Road and Manchester Road. One drive-thru window for pickup of prescriptions will be located on the south side of the building. Two curb cuts are proposed, one on Manchester Road and one on Maple Avenue. Variances are required from the Board of Adjustment, i.e., front setbacks from Manchester Road and Kirkwood Road, landscape buffer width, and number of trees. An application for a site plan review of the western 139 feet of the parcel will be submitted at a later date. Chairman Kleinknecht had appointed Mr. Frick (chair), Ms. Drewel, and Mr. Klippel to the subcommittee. The subcommittee scheduled a meeting for Tuesday, July 22, at 8 a.m. at the site.
