Waterford Owners Association Construction Guidelines 1. A $5,000.00 construction deposit on any new home will be required before clearing or construction can commence. These funds will be refunded, without interest, to the property owner, after a final acceptable inspection of the completed home by the Waterford Board or an appointed compliance committee (hereafter referred to as the Waterford Compliance Committee). 2. The attached Construction Application and Approval Procedure Overview will identify the process, application, forms and paperwork necessary to obtain the appropriate approvals for building a new home. 3. Copies of the plans and specifications along with an original survey with topographical view (containing a foundation survey showing all setbacks and setback measurements) and drainage plan must be submitted to the Waterford Compliance Committee for approval. No foundation, building, retaining wall or porch will extend beyond any side, rear or front setback. The above items must be submitted for approval before construction can begin. 4. All homes must be landscaped (grass, driveway, plantings) in front of the house within three (3) months of the issuance of a Certificate of Occupancy. 5. In accordance with Waterford covenants, Section 8.5, and as detailed on the Waterford Subdivision plat, all property setback lines are as follows: a.) 10 foot side setback from property line b.) 50 foot front setback from public right of way c.) 25 foot front setback from curb on all private roads d.) 35 foot rear setback from property line (interior lots) e.) 50 foot waterside setback measured from the 800 MSL contour f.) 35 foot side street setback from property line 6. In accordance with Waterford covenants, Section 8.11, each new home under construction must have an approved sign identifying lot #, builder and builder's phone number. Only two signs, each of which may not exceed five (5) square feet in size, may be placed on the lot by the builder to advertise the property during the construction and/or sales period. Signs to identify any or all of the sub contractors are deemed unsightly and will be removed. 7. Approved hours for construction are from 7:00 AM to 7:00 PM, Monday through Saturday. 8. Construction of a new home must start within 3 months of the project approval and construction must show continuous progress after the footings are poured. Any exceptions require the pre-approval of the Waterford Compliance Committee. 9. In accordance with Waterford covenants, Section 8.17, any damage to streets, curbs, drainage inlets, water meters or boxes, street lights, fire hydrants, street markers, mailboxes, walls, fences, etc. must be repaired immediately with the cost being absorbed by the responsible party or property owner. Necessary repairs which are not completed as stated above will be repaired by third parties at the direction of the Waterford Compliance Committee. The property owner will receive a special assessment for these costs. 10. The above Guidelines will be enforced along with the existing covenants listed in Section 8 of the Waterford Covenants. Construction Application and Approval Process Overview 1. Property Owner: For New Construction: Complete Schedule A-1 -- Waterford Construction Escrow Application Sheet and A-2 Waterford Construction Application and Design Approval Sheet. Be sure to provide the correct drawings/plans (blueprints, topo s and drainage plans). Write a check made out to Waterford Owner s Association in the amount of $5000.00 and mail with above documents to: Waterford Owner s Association 309 Oakleaf Court Seneca, SC 29672 2. Waterford Compliance Committee: Verify receipt of the above documents and payments. Notify property owner of any missing documents. Schedule a property owner review meeting. 3. Property Owner: Attend meeting if possible and/or arrange for builder to attend meeting. 4. Property Owner, Waterford Compliance Committee: Review and discuss the submitted plans. Note any changes to the plans that must be completed before approval can be granted. Grant final approval of the plan after all Waterford Compliance Committee requirements are met. 5. Property Owner or Builder: Stake out the house on the property and complete the other items required on Schedule B - Site Inspection Form. Schedule meeting with the Waterford Compliance Committee to conduct a site inspection and to review Schedule B. 6. Waterford Compliance Committee: Inspect the building site and review Schedule B. Grant approval to begin construction. Monitor construction to insure it meets Waterford Guidelines. Note: It may be possible to combine steps 1 thru 6 so all can be done on the same day. 7. Property Owner: Submit Schedule C Change Application, if approved design plans are changed or something is added. 8. Property Owner: Upon completion of construction and landscaping, submit Schedule D Request for Final Inspection/Deposit Refund and mail it to the Waterford Compliance Committee at the above address. 9. Waterford Compliance Committee: Inspect the finished home and landscape to insure that it meets Waterford Compliance Committee Requirements. Notify the property owner if any problems are found. I further understand that these funds may be used to correct or remedy any violation(s) of the Waterford Association Construction Guidelines and the Waterford Declaration of Covenants. I acknowledge the Waterford Association Construction Guidelines and the Waterford Declaration of Covenants have been read and will be followed. In the event that the property is subsequently sold during the construction process, the builder, owner or responsible party assumes full responsibility for informing and providing the new home owner with the Declaration of Covenants Conditions and the Waterford Association Construction Guidelines. Schedule A-2 WATERFORD CONSTRUCTION APPLICATION and DESIGN APPROVAL SHEET To complete the approval process submit one (1) final site plan, one (1) foundation survey, one (1) set of final building plans and specifications, one (1) copy of the final septic permit from Oconee County and a completed Schedule A-1(including check).
